O Direito social de moradia viabilizado pela vinculação da receita tributária

Este estudo vincula-se à linha de pesquisa "Direito, Estado e Constituição" do Curso de Pós-graduação em Direito, do Programa de Mestrado (MINTER) da Universidade Federal de Santa Catarina. A pesquisa foi produzida sob orientação do Professor Doutor Ubaldo Cesar Balthazar, no período de janeiro a setembro de 2011. Teoricamente o estudo é baseado nas ideais de Immanuel Kant e Ingo Sarlet e foi desenvolvido com base na técnica de pesquisa bibliográfica, conduzida pelo método de abordagem dedutivo e método de procedimento monográfico. A dissertação divide-se em três capítulos. O primeiro capítulo destina-se inicialmente a compreensão da trajetória histórica do Estado Liberal ao Estado Democrático de Direito. No momento seguinte, busca-se compreender a função social do tributo na República Federativa do Brasil. O segundo capítulo discute os conceitos de direito e a caracterização do direito de moradia como direito social fundamental, que compõe o mínimo existencial delineado pela dignidade humana. Por fim, no terceiro capítulo faz-se um estudo constitucional sobre as possibilidades de vinculação da receita tributária. Indicam-se métodos de interpretação da Constituição que orientam para a efetividade dos direitos sociais. Apresenta-se a perspectiva da vinculação de percentuais da receita do imposto de renda (IR) e do imposto sobre propriedade territorial urbana (IPTU) ao Fundo de Habitação de Interesse Social para a execução de políticas locais permanentes de garantia do direito de moradia. O resultado do estudo demonstra é juridicamente possível vincular a receita tributária do IR e do IPTU à produção social de moradia. Para tanto, há necessidade de Emenda alterando o artigo 167, IV da Constituição Federal para fazer constar, entre as ressalvas, a vinculação da receita do IR e do IPTU à moradia e, ainda, a alteração na Lei 11.124/2005 prevendo o repasse dos recursos do IR aos Fundos locais (municipais)

The researchers’ attention is deservedly raised by the query how come that this parabolical story with biblical tone was included in Enea Silvio’s work; if it had been borrowed who the

might have been he borrowed it from. The answer seems to be very simple: from the
Conversio Bagoariorum et Carantanorum
drafted regarding the lawsuit proceeded against Methodius. In the case narrated in the
Conversio
Ingo sent a charter or much rather a parchment without any writing, or letters on it

, which provided his legate with sufficient authenticity to demand obedience from the people.In this study-after having compared the two narratives and outlined the place of De Europa in Enea Silvio Piccolomini’s oeuvre and the circumstances of the drafting and tendencies of the Conversio Bagoariorum et Carantanorum-the author attempts to answer the following questions. To what extent can duke Ingo, mentioned by Enea Silvio and not questioned in the literature for long centuries, be considered a real historical person? Does the Conversio refer to Ingo as a duke, and if it does, what is his existence as a duke and introduction in the literature as a duke owing to? What could the meaning of carta sine litteris referred to in Conversio have been, and why did Enea Silvio not take this item over although he could have put it forward as a further proof of Ingo’s dignity? To what literary prefigurations can the description of the feast held by Ingo be traced back to, and what role did it play in the Conversio? Regarding the borrowing of the Ingo story by Enea Silvio, what possible intermediary writing and author can be reckoned with
Phase diagrams, phase separation mechanisms and morphologyin liquid crystalline materials: Principles and theoretical foundations
No full textPolymer-Liquid crystal composites are heterogeneous materials that display a rich phase behavoiur and a variety of morphologies, and are typically used in electro-optical technological applications. This chapter presents general introduction to phase behaviour and morphologies of these materials. The fundamental physics underlying the formation of different morphologies is described, with a strong emphasis in how the trajectory in the phase diagram determines phase separation mechanism and the morphology. Direito.Diante da complexidade atinente às relações familiares, em especial às relações paterno-filiais, e da premente necessidade de tutelar o direito de toda criança e adolescente ao seu pleno desenvolvimento para a vida em sociedade, visa o presente trabalho a consagrar a aplicação dos institutos da responsabilidade civil pelo não cumprimento dos deveres parentais perante sua prole, vista sob um prisma que lhe é peculiar. Por meio deste trabalho monográfico, buscar-se-á arrolar todo um arcabouço normativo e principiológico existente para garantir à criança e ao adolescente, enquanto sujeitos de direitos e seres em desenvolvimento, o direito à prestação afetiva e ao convívio familiar, tão essenciais à sua criação quanto o próprio alimento que lhe sustenta. Visualizar-se-ão as normas atinentes à configuração da responsabilidade civil por danos extrapatrimoniais, seus elementos, pressupostos e excludentes, tendo por escopo demonstrar que é legalmente permitida a condenação de genitores omissos quanto às suas obrigações perante os filhos, desde que observadas essas regras. Ao cabo, perquirir-se-á a aplicação fática dos institutos estudados quando submetidos ao crivo do Poder Judiciário de Santa Catarina e o atual ponto de vista do Superior Tribunal de Justiça acerca do assunto. Observando que não se faz cediço o entendimento pelos aplicadores do direito sobre o tema proposto, pretende-se, ainda, tecer algumas considerações sobre as dificuldades percebidas para a uniformização da compreensão em torno do assunto e sua consequente aplicação nas cortes brasileiras

Authorship as cultural performance: new perspectives in authorship studies
No full textThis article proposes a performative model of authorship, based on the historical alternation between predominantly 'weak' and 'strong' author concepts and related practices of writing, publication and reading. Based on this model, we give a brief overview of the historical development of such author concepts in English literature from the Middle Ages to the twentieth century. We argue for a more holistic approach to authorship within a cultural topography, comprising social contexts, technological and media factors, and other cultural developments, such as the distinction between privacy and the public sphere
