REKONSTRUKSI SANKSI PIDANA DALAM KUHP TERHADAP PELAKU TINDAK PIDANA ABORSI BERBASIS PADA NILAI KEADILAN
Aborsi merupakan salah satu topik yang selalu menarik untuk diperbincangkan. Para ahli agama, ahli kesehatan, ahli hukum dan ahli sosial- ekonomi masing masing memiliki pendapat tentang aborsi. Pendapat yang dilontarkan oleh para ahli tersebut ada yang bersifat menentang, abstain, bahkan ada yang mendukung aborsi. Perdebatan mengenai aborsi sampai saat ini tetap menjadi isu yang hangat dibicarakan. Aborsi selalu menjadi perbincangan, baik dalam forum resmi maupun tidak resmi yang menyangkut bidang kedokteran, hukum maupun disiplin ilmu lain. Aborsi bukan persoalan baru, aborsi merupakan persoalan lama yang selalu menuai kontroversi. Salah satu kontroversi mengenai aborsi adalah dikedepankannya wacana Hak Asasi Manusia sebagai alasan pro aborsi maupun alasan kontra aborsi.
Tujuan dari penelitian yang dilakukan antara lain: Untuk menganalisis dan menemukan sanksi pidana yang dijatuhkan oleh Hakim kepada pelaku tindak pidana aborsi di Indonesia ; Untuk menemukan dan menganalisis tentang penerapan sanksi-sanksi oleh Hakim terhadap tindak pidana aborsi belum berbasis nilai keadilan; dan Untuk merekontruksi penerapan sanksi pidana dalam KUHP terhadap pelaku tindak pidana aborsi di Indonesia untuk masa yang akan datang ;
Metode pendekatan yang dipergunakan dalam penelitian ini adalah metode yuridis normatif. Bertitik tolak dari judul dan permasalahan yang mendasari penelitian ini, maka penelitian ini termasuk jenis penelitian deskriptif analisis. Tehnik pengumpulan data sekunder dilakukan dengan studi pustaka. Bahan hukum primer yang digunakan yaitu peraturan perundang-undangan.
Hakim dalam menerapan sanksi pidana terhadap pelaku tindak pidana aborsi di Indonesia masih sangat jauh dari ancaman hukuman penjara yang terdapat di dalam KUHP. Sanksi Pidana Yang Diterapkan Oleh Hakim Kepada Pelaku Tindak Pidana Aborsi Di Indonesia Belum Berbasis Pada Nilai Keadilan dikarenakan hakim belum bisa menggali nilai nilai yang terkandung dalam Pasal tersebut dan dalam mempertimbangkan belum melihat wisdom lokal dan wisdom internasional.
Rekonstruksi Sanksi Pidana Dalam Kuhp Terhadap Pelaku Tindak Pidana Aborsi Berbasis Pada Nilai Keadilan, dengan menggeser nilai nilai, dengan mendasarkan pada wisdom lokal dan wisdom internasional. Nilai wisdom lokal antara lain nilai keadilan, nilai keseimbangan, dan nilai perlindungan.

OPTIMALISASI REGULASI DALAM RANGKA PENCEGAHAN TRAFFICKING DI INDONESIA
This article discusses the understanding, actors, and the drivers of trafficking and also the impact of trafficking in Indonesia. Trafficking is one form of violence committed against children, which concerns physical, mental and/or sexual violence. The purpose of writing this article is to explore the trafficking issue from the human rights perspective and to understand its impact and to seek the solution to this kind of crime. In article 4 of the Universal Declaration of Human Rights (UDHR) it has been argued that slavery and trade of slaves in any form shall be prohibited. In addition to the provisions of this article, the prohibition of human trafficking as a violation of human rights is also contained in Article 8 of the ICCPR. Trafficking practices have been conducted in various ways, including threats, coercion, kidnapping, and fraud. Traffickers include the initial trading party, the providing party and the end party ie the recipient or the buyer. The vulnerable targets for trafficking victims are the children, especially street children. In short, people who are looking for work and do not have enough knowledge will also be targeted. So then the women and children who are in conflict areas or become refugees. In addition to the list, women, and children from poor families and women and children residing in border areas between countries, as well as women and children whose families are in debt. The targets expanded to the victims of domestic violence and victims of rape. The list shows us that it can be concluded that the main factor of the rampant crime of trafficking is poverty. As a result of this crime, from the physical aspects, the victim will get the disease, and from the psychological side, the victim will experience the depression. The solutions could be obtained from two ways: people follow government counseling on employment system, or the government expanding employment fields. It is expected that the government, along with religious leaders and parties concerned with criminal acts of trafficking in Indonesia, to be willing to provide counseling to the community. The government is also expected to maximize the performance of the national child protection commission, national human rights commission, and the government is expected to maximize SMEs (UMKM) in order to make the field work more widely
Analisis Yuridis Dampak Over Kapasitas pada Ruang Tahanan terhadap Hak-Hak Narapidana: Studi di Lembaga Pemasyarakatan Kelas IIB Wonogiri
To address the issue of overcrowding in correctional institutions, one of the alternative approaches is to replace imprisonment with other forms of sentencing, such as remission, conditional leave, and parole. These alternatives serve as optional punishments outside the primary criminal sanctions. This study employs an empirical juridical method with a descriptive approach. The findings reveal several key factors contributing to prison overcrowding, namely: (1) the rising crime rate; (2) the ease with which individuals are detained upon suspicion or indictment; (3) the lack of clear standard operating procedures (SOP) regarding detention postponement; (4) the underutilization of alternative punishments other than imprisonment; (5) the high rate of recidivism; and (6) the implementation of stricter remission policies for inmates convicted of corruption and narcotics-related crimes. The impacts of overcrowding in the Class IIB Correctional Facility in Wonogiri include: (1) difficulties for inmates in resting and engaging in activities; (2) obstruction of the right to file complaints; (3) inadequate sanitation; (4) limited access to proper healthcare services; (5) insufficient supervision; (6) suboptimal rehabilitation and self-reliance programs; and (7) increased potential for conflict among inmates

Life is a gift given by God Almighty that must be respected by everyone. Life is given to every human being is a human rights that can only be revoked by the Giver of life. The right to life is one of the human rights that are set out in the Constitution of the State, as described in Article 28 (a) of the Constitution of the Republic of Indonesia in 1945 which states that "Everyone has the right to live and to defend life and living". With the right to life of the country will preserve and protect the right to life of every citizen so that the state through the state law enforcement tool will act if there is known to occur and the removal of the right to human life. Abortion (abortion) is always a conversation, either in forumresmi and unofficial concerning the fields of medicine, law and other disciplines. Abortion is not a new issue, abortion is an old problem that is always controversy. One of the controversies about abortion are the priority discourse of human rights as an excuse or reason for the pro-abortion cons of abortion. Jaringan Perempuan Usaha Kecil (Jarpuk) Mekar Sari Kabupaten Karanganyar berdiri sejak tahun 2004 yang lalu. Anggota maupun pengurus Jarpuk Mekar Sari mayoritas adalah ibu rumah tangga dan telah berusia lebih dari 40 tahun. Sehingga usaha yang dimiliki dan dijalankan para anggotanya relatif sudah berlangsung lama dan masih tradisonal dalam segala aspeknya. Meskipun usahanya sudah berjalan lama, mayoritas para anggota belum memahami arti penting sebuah Nomor Induk Berusaha (NIB). NIB adalah identitas pelaku usaha dalam rangka pelaksaanaan kegiatan berusaha sesuai bidang usahanya. Permasalahan lain adalah para anggota Jarpuk juga mayoritas belum menyusun laporan keuangan usaha, karena mereka menganggap menyusun laporan keuangan adalah hal yang merepotkan. Solusi yang ditawarkan untuk mengatasi permasalahan yang dihadapi mitra adalah dengan pelatihan dan pendampingan pembuatan legalitas dan laporan keuangan dengan menggunakan aplikasi Siapik. Untuk melihat efektivitas dari pelatihan ini, maka diperlukan pemeriksaan untuk memastikan ketersediaan NIB dan laporan keuangan versi aplikasi Siapik dari anggota inti Jarpuk
Going Beyond Counting First Authors in Author Co-citation Analysis
The present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation
counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings
are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that
only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into
account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. “Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship
Appropriate Similarity Measures for Author Cocitation Analysis
We provide a number of new insights into the methodological discussion about author cocitation analysis. We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature. Dispelling the Myths Behind First-author Citation Counts
We conducted a full-scale evaluative citation analysis study of scholars in the XML research field to explore just how different from each other author rankings resulting from different citation counting methods actually are, and to demonstrate the capability of emerging data and tools on the Web in supporting more realistic citation counting methods. Our results contest some common arguments for the continued
use of first-author citation counts in the evaluation of scholars, such as high correlations between author rankings by first-author citation counts and other citation
counting methods, and high costs of using more realistic citation counting methods that are not well-supported by the ISI databases.
