Penyerobotan tanah bukanlah sesuatu yang baru terjadi di Indonesia, penyerobotan tanah merupakan kasus yang sering ditemukan dalam masyarakat karena secara esensial tanah memiliki keterikatan dengan manusia, bahkan negara Indonesia menyadari pentingnya nilai dan arti dari tanah dan diundangkan secara khusus dalam Undang-Undang Pokok Agraria Nomor 5 Tahun 1960. Berkaitan dengan kasus penyerobotan tanah, bagaimana penanganan kasus penyerobotan tanah yang dilakukan melalui hukum perdata, apakah sudah benar-benar menjawab kebutuhan penggugat atas tanah yang disengketakan. Dengan membuat rumusan masalah skripsi ini: Apakah perbuatan Penyerobotan Tanah merupakan perbuatan melawan hukum dan Bagaimana Penanganan Perdata Tentang Penyerobotan Tanah.
Penulis menggunakan metode penulisan berdasarkan studi kepustakaan yang bersifat yuridis normatif, dengan data primer dari undang-undang dan data sekunder dari studi dokumen melalui studi putusan pengadilan.
Hasil penelitian menunjukkan bahwa usaha hukum yang dilakukan melalui gugatan perdata atas dasar perbuatan melawan hukum, sesuai dengan ketentuan Pasal 1365 KUH Perdata, belum sepenuhnya menjawab kebutuhan penggugat dikarenakan proses hukum perdata yang lama kerap menimbulkan pertanyaan penggugat terkait kepastian hukum atas perlindungan hak dari tanah miliknya dan kekosongan peraturan terkait ukuran pasti ganti rugi atas tindakan perbuatan melawan hukum berpotensi menimbulkan putusan yang tidak adil.

Confiscation of land is not something new in Indonesia, land grabbing is a case that is often found in society because land is essentially connected to humans, even the Indonesian state realizes the importance of the value and meaning of land and is promulgated in the Basic Agrarian Law Number 5. 1960. Regarding land grabbing cases, how are cases of land grabbing carried out through civil law, do they really answer the plaintiff's needs for the disputed land. By formulating the problem of this thesis: Is the act of grabbing land an act against the law and how is the civil handling of land grabbing.
The author uses a writing method based on a juridical normative literature study, with primary data from laws and secondary data from document studies through court decision studies.
The results of the research show that the legal efforts carried out through civil suits on the basis of unlawful acts, in accordance with the provisions of Article 1365 of the Civil Code, have not fully answered the plaintiff's needs because the long civil legal process often raises questions from the plaintiff regarding legal certainty over the protection of the rights of his land and the absence of regulations regarding the exact size of compensation for actions against the law has the potential to lead to unfair decisions.

No full textTujuan penelitian ini adalah menjabarkan sikap para tokoh utama terhadap entitas dalam mitos dan ritual Dayak Maanyan yang ditampilkan oleh pengarang dalam novel Kariau, Dalung, dan Minyak Bintang karya Neno Christiandi Nelis. Penelitian ini memakai pendekatan psikoanalisis Sigmund Freud. Metode penelitian yang digunakan adalah deskriptif kualitatif. Objek penelitian berupa kata, frasa, kalimat, alinea, dan wacana yang terdapat pada ketiga novel karya Neno Christiandi Nelis. Hasil penelitian ditemukannya adanya kecemasan yang dialami para tokoh utamanya dalam kaitannya dengan konflik id dengan superego. Fungsi id yang mendominasi para tokoh utama karena menginginkan adanya perlindungan, kekuatan dan keselamatan dari berbagai kekuatan yang mereka yakini, yaitu bersekutu pada makhluk penguasa alam gaib. Namun akibat fungsi superego terabaikan oleh para tokoh utamanya menyebabkan para tokoh utama tersebut mendapat teror berbagai kekuatan makhluk gaib tersebut yang terus menerus sehingga muncul konflik batin di antara mereka berupa kecemasan dan ketakutan. Untuk memulihkan keadaan tersebut, para tokoh utama tersebut lalu melakukan pemulihan dengan melakukan ritual wadian, seperti wadian Pamungkur dan wadian Dadas. Dalam hal ini, sisi superegolah yang diperlukan untuk menjaga keharmonisan mirokosmis dalam alam pemikiran religius masyarakat dayak Maanyan

These debt agreements are made by creditor and debtor, where both parties are partners. In this case the debtor owes a sum of money to the creditor to be used as venture capital. However, the Debtor within the predetermined time period cannot repay the debt, causing the creditor to incur losses. For this reason, the creditor submits a claim to the District Court on the basis that the Debtor has defaulted. Thus the purpose of the research conducted by the author is to find out the Process of Settlement of Default Cases for Debt-Receivable Agreements between Business Partners for Business Capital starting from determining the evidence, judges' considerations in deciding cases, and the legal consequences. The method of approach in this study uses the normative method, because in this study the study is the principles, norms, legal principles, legal aspects, in the settlement of default cases in a debt agreement. The type of research the author applies is descriptive research, this research which reveals a problem and the situation as it is, so it is a disclosure of legal facts. Then the result of this research is a debt-receivable agreement is an agreement where one party gives a certain amount of goods on condition that the other party pays back the goods with the agreed amount. The contents of this debt agreement are denied by the Debtor which causes the creditor to suffer losses so that the claim is filed with the District Court and the Debtor is declared default by the judge. Where the Plaintiff in the arguments of his lawsuit can prove so that it has been proven, while Defendant I cannot prove the arguments of Defendant I and the Defendants II and III are declared not to have defaulted because the Defendants II and Defendant III are only asked to help show the assets of Defendants I and the Defendants II and III are declared not to have defaulted because the Co-Defendants II and Defendant III are only asked to help show the assets of Defendant I and the Defendants II and III are declared not to have defaulted because the Co-Defendants II and Defendant III are only asked to help show the assets of Defendant I and the Defendants II and III. in which Defendant II and Defendant III are the holders of guarantee of land rights owned by Defendant I, the judge has decided to grant part of the Plaintiff's claim and decide on the confiscation of equality. The legal consequence of this case was that Defendant I was declared in default and had to pay debts to the Plaintiff, and the judge decided on confiscation of equality.

No full textGrado en Relaciones Internacionales y Grado en Traducción e InterpretaciónEste trabajo comprende un análisis de Memorias dun neno labrego, el libro de mayor éxito de la literatura gallega, y su representación del medio rural gallego en el contexto de la depresión económica de la posguerra. En ella se analizan los elementos sociales derivados del atraso económico que sufrió la región y que influyó en el autor para la redacción de la obra. Dicha obra recibió aclamación universal por parte de los críticos gallegos en el momento de su publicación por su fiel representación de la vida de los campesinos. Además, los críticos elogiaron la forma en que los complejos problemas se reproducen a través de un niño que, debido a su inocencia, no puede comprenderlos plenamente y vierte una opinión subjetiva sobre ellos. Por lo tanto, la presente investigación compara la realidad subjetiva percibida por el protagonista y la realidad objetiva a partir de estudios previos realizados sobre los elementos detallados. Los principales temas a estudiar son la emigración, el caciquismo y el analfabetismo de la población rural de posguerra. Así, a través de una exhaustiva comparación de estos temas, se examinará la fidelidad del autor al contexto social en el que se enmarca.This work includes an analysis of Memorias dun neno labrego, the most successful book in Galician literature, and its representation of the Galician rural environment in the context of the post-war economic depression. In it, the social elements derived from the economic backwardness that the region suffered and that influenced the author for the writing of the work are analyzed. This work received widespread critical acclaim at its release for its faithful representation of the life of the peasants. Moreover, critics praised how the complex problems are reproduced through a child who, because of his innocence, cannot fully understand them and gives a subjective opinion about them. Therefore, the present research compares the subjective reality perceived by the main character and the objective reality based on previous studies carried out on the detailed elements. The main subjects to be studied are emigration, chieftaincy and illiteracy in the post-war rural population. Thus, through an exhaustive comparison of these subjects, the author's fidelity to the social context in which it is framed will be examined

The Effect of Internet Usage on Social Capital in Indonesia
Get PDFThe development capital consists of financial capital, physical capital, human capital, and social capital. Social capital focuses on efforts to empower social relations. The relationship between social capital and ICT, especially the internet, has become an interesting debate. In fact, several studies have been conducted with quite diverse findings. The internet is able to connect people who are far from each other, but on the other hand, it often makes people who are physically close to each other seem far apart. This study aims to examine the effect of internet use on social capital in Indonesia. The data is obtained from the fifth Indonesian Family Life Survey (IFLS-5). The study found that in general, internet users have lower social capital than non-internet users. Likewise, highly educated people have higher social capital than people with low education. Then, internet users with higher education have higher social capital when compared to internet users with lower education. This means that the use of the internet must be accompanied by the readiness of human resources (digital literacy) in accepting new technology, filtering the flow of incoming information, and educating the public about how to use the internet in healthy, safe, and wise manner
