    Agreement on court jurisdiction pursuant to Brussels II ter Regulation and its impact on the jurisdiction of other courts

    The paper discusses the form of the agreement on the choice of court according to Council Regulation (EU) 2019/1111 on jurisdiction, the recognition and enforcement of decisions in matrimonial disputes and the matters related to parental responsibility and on international child abduction (amendment) and impact agreement to the jurisdiction of other courts. The specificity of this agreement is the possibility of choosing a court in matters of family law, which was not previously possible. The goal of the study is to analyse the formal conditions for the validity of the agreement and to indicate its implementation in practice. The findings of the study showed the ways that the agreements on the choice of the competent court are concluded, and how to ensure their legal effect towards all courts in the European Union, i.e. their influence on the rules of lis pendens

    The paper procedure for determining abuse of dominant position in the competition law of Bosnia and Herzegovina. Competition laws is very important for the functioning of the market, and is in line with the European Union. It is interesting that during the decision-making Competition Council, the purpose of assessment of the case, can be used the practice of the European Court of Justice and the decisions of the European Commission. The main role of the Competition Council is to determine the violation of competition laws, while in the European Union's role entrusted to the Commission. Following the example of the Commission should be strengthened and the capacity of the Competition Council in order to prevent more harm to competition regarding abuse of dominant position. Competition Council decided to initiate the procedure, but it can be at the request of a party or ex officio. When making decisions, we find that the mischaracterization of constituent status, which creates space obstruction, thus the possible ineffectiveness of the Council. Judicial protection provided Court of Bosnia and Herzegovina, because it are against the decisions of the Competition Council may declare claim. The specificity of the existence of the extraordinary remedy to review the decision of the Competition Council. The jurisdiction of the Competition Council and the forced execution of decisions

    U radu se analizira uticaj Brexita na nadležnost, priznanje i izvršenje sudskih odluka u građanskim i trgovačkim stvarima u pravu Evopske unije i Ujedinjenog Kraljevstva Velike Britanije i Sjeverne Irske. Nakon što Ujedinjeno Kraljevstvo napusti Evropsku uniju, prestat će se primjenjivati pravo Evropske unije u Ujedinjenom Kraljevstvu i imat će status države nečlanice. Ujedinjeno Kraljevstvo će napustiti sistem civilne pravosudne saradnje koji postoji između država članica Evropske unije i Ujedinjenog Kraljevstva. Sada nije poznato na koji način će se urediti odnosi između Evropske unije i Ujedinjenog Kraljevstva za sistem civilne pravosudne saradnje. Najbolje rješenje bi bilo da se zaključi poseban sporazum kojim će se urediti nadležnost, priznanje i izvršenje sudskih odluka. Ukoliko se ne postigne sporazum, primjenjivat će se međunarodne konvencije koje su trenutno na snazi, što neće biti odgovarajući pravni okvir za pravnu saradnju u skladu sa potrebama tržišta. Pravne posljedice Brexita imat će i Evropska unija, a ne samo Ujedinjeno Kraljevstvo

    Sažetak: Predmet rada je način rješavanja privatnopravnih odnosa sa međuentiteskim elementom u statusnim i nasljednim odnosima u pravu Bosne i Hercegovine. Radi se o materiji međunarodnog privatnog prava iako se odlučuje o interlokalnom sukobu zakona. Postojanje interlokalnog sukoba zakona je posljedica složenog pravnog poretka Bosne i Hercegovine. Ne može se zanemarivati postojanje međuentitetskog elementa u privatnopravnim odnosima, posebno iz razloga što su zakonska rješenja različita i mogu dovesti do potpuno drugačijih rješenja slučaja, s obzirom da je većina privatnoravnih odnosa normirana od strane entiteta i Brčko distrikta. Cijeneći da određeni privatnopravni odnos može da utiče na cjelokupan život određenih osoba, jasno je koliko se ozbiljno mora pristupiti ovom problemu. U statusnim stvarima razlika se prvenstveno ogleda u tome da je u Federaciji Bosne i Hercegovine i Brčko distriktu propisana mogućnost sticanja poslovne sposobnosti i za maloljetnu osobu, stariju od 16 godina koja je postala roditelj, u vanparičnom postupku na prijedlog maloljetne osobe. U nasljednim odnosima takođe postoji niz razlika, a posebno se ističe različit krug zakonskih nasljednika, mogućnost nasljeđivanja vanbračnog partnera i oblik testamenta.     Predmet je rada kontradiktornost pravila parničnog postupka za dosuđivanje troškova u slučaju djelomičnoga povlačenja tužbe. Do utvrđivanja kontradiktornosti dolazi se analizom pravila za odlučivanje o troškovima parničnog postupka u slučaju djelomičnog povlačenja tužbe i pravila za dosuđivanje troškova u slučaju djelomičnog uspjeha u parnici. Na hipotetičko postavljenom primjeru ukazuje se na razlike do koji se dolazi primjenom tih pravila. Na temelju pravila za tumačenje prava lex specialis derogat legi generali i lex posterior derogat legi priori, dolazi se do zaključka da kod djelomičnog povlačenja tužbe treba primijeniti pravila za dosuđivanje troškova parničnog postupka u slučaju djelomičnog uspjeha.The subject of the paper is the contradiction of the rules of civil procedure for awarding costs in case of partial withdrawal of the lawsuit. The existence of contradictions is established on the basis of the analysis of the rules for deciding on the costs of civil proceedings in the case of partial withdrawal of the lawsuit and the rules for awarding costs in the case of partial success in litigation. A hypothetically set example shows what differences are made by applying these rules. Based on the rules for the interpretation of the law lex specialis derogat legi generali and lex posterior derogat legi priori, it is concluded that in case of partial withdrawal of the lawsuit, the rules for awarding litigation costs in case of partial success should be applied

    Going Beyond Counting First Authors in Author Co-citation Analysis

    The present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed.     “Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship

    Appropriate Similarity Measures for Author Cocitation Analysis

    We provide a number of new insights into the methodological discussion about author cocitation analysis. We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature.     Dispelling the Myths Behind First-author Citation Counts

    We conducted a full-scale evaluative citation analysis study of scholars in the XML research field to explore just how different from each other author rankings resulting from different citation counting methods actually are, and to demonstrate the capability of emerging data and tools on the Web in supporting more realistic citation counting methods. Our results contest some common arguments for the continued use of first-author citation counts in the evaluation of scholars, such as high correlations between author rankings by first-author citation counts and other citation counting methods, and high costs of using more realistic citation counting methods that are not well-supported by the ISI databases. It is argued that increasingly available digital full text research papers make it possible for citation analysis studies to go beyond what the ISI databases have directly supported and to employ more sophisticated methods
