TINJAUAN POLITIK HUKUM ISLAM TERHADAP SEMA NOMOR 2 TAHUN 2023
Get PDFMarriage registration occurs because of a court order. With the stipulation from the court, the decision that the judge will give will vary, some will grant the application and some will reject the application. Thus, the Supreme Court recently issued Supreme Court Circular Letter (SEMA) No. 2 of 2023 concerning Guidelines for Judges in Adjudicating Cases of Applications for Registration of Marriages between People of Different Religions and Beliefs which aims to end problems related to interfaith marriages. However, the issuance of SEMA No. 2 of 2023 still causes tension in the community due to political intervention in the issuance of SEMA No. 2 of 2023. This type of research is field research. As for answering research questions, the author uses a legal political approach with the theory of Policy Analysis. The author analyzes the politics of Islamic law against SEMA No. 2 of 2023. This thesis uses a qualitative method, while in collecting primary data the author conducts interviews with the Chairman of the Supreme Court Chamber of the Republic of Indonesia. While the secondary data the author obtains from various other sources to complement the research needs. This research reveals that there are factors in the emergence of SEMA No. 2 of 2023. The background of the issuance of SEMA No. 2 of 2023 has several factors. First, the factors for the emergence of SEMA No. 2 of 2023 are due to the variety of judges' decisions in adjudicating cases of applications for registration of marriages between people of different religions, some judges reject the application and some judges grant the application. Second, the emergence of SEMA No. 2 of 2023 was due to political intervention, namely the arrival of the Deputy Chairman of the MPR RI from the PAN faction who asked the Supreme Court to cancel the judge's decision that granted the application for registration of marriages between people of different religions. The issuance of SEMA No. 2 of 2023 concerning Guidelines for Judges in Adjudicating Cases of Application for Registration of Marriages between People of Different Religions was due to political intervention. In SEMA No. 2 of 2023, there was already a Working Group Meeting attended by religious assemblies, Supreme Court judges, family law experts, and so on. But this SEMA also has political intervention from Yandri Susanto's presence at the Supreme Court to ask for legal certainty in the practice of interfaith marriage. In this case, the state has the right to intervene like the Zakat Law and the Hajj Law. The state is not here to limit people's beliefs but has the aim that people's religious expressions do not deviate from their respective teachings

Get PDFIn 2023 the Supreme Court issued Supreme Court Circular Letter (SEMA) Number 2 of 2023 concerning Instructions for Judges in Adjudicating Cases on Applications for Registration of Marriages Between People of Different Religions and Beliefs . SEMA sparked a polemic because it was considered discriminatory and lacked urgency. This research was conducted to explore the actual regulations for interfaith marriages in SEMA Number 2 of 2023 from the perspective of MaqÄá¹£id SyarÄ«'ah Ibnu 'Ä€syÅ«r. In an effort to answer the perceived discriminatory policies contained in SEMA Number 2 of 2023 the author uses 4 bases of Ibn Asyur's MaqÄá¹£id asy-SyarÄ«'ah. The concept of MaqÄá¹£id ash-SyarÄ«'ah 'Ammah and Ibn Asyur's level of Maslahah will be used to formulate and track the level of urgency in promulgating SEMA Number 2 of 2023 through the benefits contained therein. In this process the author will use the statute approach and conceptual approach, with descriptive analysis. The research results show that the urgency of promulgating SEMA Number 2 of 2023 in the Indonesian context, according to the author, is at the level of hajiyat benefits . Meanwhile, efforts to enforce or supremacy of law through SEMA Number 2 of 2023 will be less effective. Apart from that, SEMA Number 2 of 2023 is considered to be less than fully successful in providing social stability and resilience to the justice-seeking community as desired by Ibnu Asyur through legal supremacy efforts
The effect of Employee Happiness Course on Subjective Well-being and Job Related Well-being: A Relational-Causal Screening Study on Graduate Students
No full textAraştırmanın amacı çalışan mutluluğu dersi alan yüksek lisans öğrencilerinin bireysel olarak mutluluk ve işe ilişkin iyilik algılarında pozitif yönde bir değişim olup olmadığının incelenmesidir. Araştırma örneklem grubu 2019-2020 Akademik yılı güz döneminde bir vakıf üniversitesinde seçmeli olarak “Çalışan Mutluluğu” dersi alan 31 yüksek lisans öğrencisidir. Öğrencilerin çalışan mutluluğu dersini almadan önce ve 12 haftalık akademik dönem boyunca dersi aldıktan sonra öznel iyilik algısı ve işe ilişkin iyilik algısı seviyeleri değerlendirilmiştir. Araştırmada veri toplama aracı olarak üç bölümden oluşan anket formu kullanılmıştır. Anket formunun birinci bölümünde demografik bilgi formu, ikinci bölümünde Hills ve Argyle (2002) tarafından geliştirilip Türkçe çevirisi sonrasında güvenirlik ve geçerlik çalışmaları Doğan ve Sapmaz (2012) tarafından yapılan Oxford Mutluluk Ölçeği (Öznel İyilik Algısı Ölçeği), üçüncü bölümünde Katwyk, Fox, Spector ve Kelloway (2000) tarafından geliştirilip Türkçe çevirisi sonrasında güvenirlik ve geçerlik çalışmaları Bayram, Kuşdil, Aytaç ve Bilgel (2004) tarafından yapılan İşe İlişkin Duyuşsal İyilik Algısı Ölçeği (Job-Related Affective Well-Being Scale- JAWS) kullanılmıştır. Araştırma sonucuna göre öğrencilerin çalışan mutluluğu dersi sonrası öznel iyilik algısı (mutluluk) ve işe ilişkin iyilik algısı değerlendirmeleri ders öncesi değerlendirmelere göre anlamlı düzeyde daha yüksektir. Çalışan mutluluğu dersi öğrencilerin öznel iyilik algısı ve işe ilişkin iyilik algısı seviyelerinde anlamlı düzeyde yükselme meydana gelmesini sağlamıştır.The purpose of the study is to examine whether there is a positive change in the perception of subjective well-being (happiness) and job-related well-being of the graduate students who take the course of employee happiness. The research sample group is 31 graduate students who take the “Employee Happiness” course at a foundation university in the fall semester of the 2019-2020 academic year. The subjective well-being perception and job-related well-being levels of students were evaluated before taking the employee happiness course and after taking the course in the 12-week academic term. A survey form occurred of three section was used to collect data in the study. There is a demographic form in the first section of the questionnaire, Oxford Happiness Scale (Subjective Well-Being Perception Scale) developed by Hills and Argyle (2002) and adapted to Turkish by Doğan and Sapmaz (2012) in the second part and The Job-Related Affective Well-Being Scale (JAWS) was developed by Katwyk, Fox, Spector and Kelloway (2000), adapted and reliability and validity studies were performed Turkish by Bayram, Kuşdil, Aytaç, and Bilgel (2004) is used in the third section. According to the results of the study, subjective well-being (happiness) perception and job-related well-being perception evaluations of students are significantly higher than the pre-lesson evaluations. Employee happiness lesson caused a significant increase in students' subjective well-being perception and job-related well-being levels
İŞ AİLE YAYILIMI VE ÖLÇME ARACININ TÜRKÇE’DE GEÇERLİK VE GÜVENİLİRLİK ANALİZİ
Get PDFBu çalışmada, iş aile yayılımı kavramı incelenerek, Grzywacz ve Marks (2000) tarafından geliştirilmiş olan İş Aile Yayılımı Ölçeği’nin Türkçe formunun geçerlilik ve güvenilirliğinin sınanması amaçlanmıştır. Çalışma iki farklı örneklemden (n=150, n=320) elde edilen verilerle yürütülmüştür. Doğrulayıcı faktör analizi sonuçlarına göre, orijinal ölçekten 2 madde çıkarılmış ve ölçek 4 boyut ve 12 ifade ile doğrulanmıştır. Ayrıca işgören performansı ölçeğinden yararlanılarak, ölçeğin ölçüt bağımlı geçerliliği de sağlanmıştır. Güvenilirlik analizi sonuçlarına göre, her iki örnek için deölçek ,70 ve üzerinde iç tutarlılık katsayılarına ulaşmıştır. Elde edilen sonuçlar, Türkçe’ye uyarlaması yapılan ölçeğin, ülkemizde iş aile yayılım düzeyinin ölçülmesinde geçerli ve güvenilir olarak kullanılabileceğini göstermiştir

Ancak mahalle kültürünün hâkim olduğu bölgelerde tüketicilerin pazara ilişkin bilgi aldığı kaynaklar, kullandığı iletişim biçimi farklılık gösterebilmektedir. Pazar kurtları ağızdan ağıza iletişimi yaygın olarak kullanan, pazardaki fırsatlar, tehditler ve gelişmeler hakkında bilgi veren ve tüketicilerin kararları, tutumları ve davranışları üzerinde etkili olan kişilerdir. Pazar kurtları literatürde geniş kapsamlı çalışılmayan bir kavram olmasının yanı sıra, mahalle kültürü kapsamında irdeleyen bir araştırmaya da rastlanılmamıştır. Bu çalışma ağızdan ağıza iletişim ve pazar kurtlarını kavramsal ve özellikleri açısından mahalle kültürü bağlamında incelemekte, literatüre farklı bir bakış açısıyla katkı sağlamayı amaçlamaktadır.Developments in communication technologies have made it easier for consumers to obtain market-related information from a wide variety of sources. Market mavens' are people who use extensively word of mouth communication, provide information about opportunities, threats and developments in the market and have an impact on consumers' decisions, attitudes and behaviors.'Market wolves' is a concept that has not been studied extensively in the literature. In addition, no research investigating the context of the neighborhood culture was found. This study examines 'word of mouth communication' and 'market wolves' concepts in terms of neighborhood culture and features, and aims to contribute to the literature with a different perspective
Sema Kaygusuz: From short story to novel
Get PDFBu çalışmanın amacı, Türk edebiyatının yeni kuşak yazarlarından olan Sema Kaygusuz'un edebiyat serüvenini, yayımladığı ilk üç öykü kitabı ve yazdığı iki romanla birlikte incelemektir. Yazarın iki romanı ve seçilen dokuz öyküsü, kurduğu dil, karakterler, tekrar eden temalar ve biçem açısından ele alınarak öykü ve roman anlayışı ortaya koyulmuştur. Türk edebiyatında 1990'ların sonunda yerini almaya başlayan yazarlardan biri olan Sema Kaygusuz, kendi edebiyat anlayışını oluşturmuş ve kendi dil evrenini kurarak yenilikçi ve deneysel biçimlerde eserler vermiştir. Sema Kaygusuz'un öykü anlayışında öyküler olaylara değil kırılma anlarına odaklanır, insanlık durumlarıyla ilgilidir. İnsanın doğayla ilişkisini merkeze alarak kurguladığı romanlarında ise yazar, kadim hikâyelere, kutsal metinlere, mistik ve tarihi kişiliklere yer verir; romanlarını adeta iç içe geçmiş hikâyelerle oluşturur. Zaman ve mekândan bağımsız olarak oluşturulmaları metinlerine aynı zamanda evrensellik de katar.The purpose of this study is to explore Sema Kaygusuz?s literary journey with reference to her two novels and three short story collections published to date. To depict her perception of novel and story, the verbal construction, characters and repetitive themes and stylistics have been analyzed in her two novels and nine stories. Sema Kaygusuz, a new generation author emerging on the literary scene at the end of the 1990s, set her own understanding of literature and by creating her own world of language she produced innovative and experimental works. The story-making process of Sema Kaygusuz emphasizes not on the plot but on the moments of breaking and is related to the state of humanity. Her novels, woven with man?s relation with nature, are built upon ancient stories, sacred texts, mystical and historical personalities, and seem to have been culminated upon stories intertwined. Her works achieve universality by their independent construction from time and space

A review on short story writing of Sema Kaygusuz
Get PDFYüksek Lisans TeziModern Türk edebiyatının yaşayan kadın yazarlarından biri olan Sema Kaygusuz, öykü, roman, deneme, oyun gibi pek çok edebi türde eserler kaleme almış üretken bir yazardır. Bu çalışmanın amacı Sema Kaygusuz'un öykülerini ve edebiyat serüvenini inceleyerek Sema Kaygusuz öykücülüğünün özellikleri hakkında çeşitli çıkarımlar elde etmektir. Edebiyat dünyasına öykü türüyle giriş yapan Kaygusuz, 90'lı yılların sonunda ortaya çıkan ve adından söz ettiren bir yazardır. İlk öykü kitabı Ortadan Yarısından ve ikinci öykü kitabı Sandık Lekesi ile önemli ödülleri alan yazar küçük yaşlarda başladığı öykü serüvenine halen devam etmektedir. 90 kuşağı öykücülüğü içerisinde değerlendirilen Kaygusuz bu dönemde kendine özgü bir öykü tarzı yakalamış ve yenilikçi bir edebiyat anlayışı geliştirmiştir. Kaygusuz öykülerinde, modern insanın yalnızlığını, insanın doğayla olan ilişkisini, kenti, sokakları ve Anadolu insanını anlatırken olaylardan çok kırılma anlarına yoğunlaşmış ve tek etki bırakma derdinde olmuştur. Kaygusuz öykülerinde güncel olaylardan uzak durmuş, toplumda yaşanan acıları doğrudan ifade etmektense bunları kavramsallaştırarak anlatmış ve hep "şimdi"yi yakalamayı amaçlamıştır. Yazar öykülerinde kullandığı üslup ile standart dilin sınırları dışına çıkmış, dilin imkanlarını zorlamış ve kendi dil evrenini yaratmıştır. Çalışmamızda, Sema Kaygusuz'un yazın dünyasını etkileyen hayatı, eserleri, edebi kişiliği, öykü anlayışı ele alınmış ve Kaygusuz'un dört öykü kitabındaki öyküler tema ve yapı bakımından incelenmiştir. Ulaşılan sonuçlarla Kaygusuz'un Türk öykücülüğü içindeki yeri saptanmıştır.Kaygusuz who entered the literary world with the genre of story, is a writer who emerged in the late 90s and made a name for herself. The author, who won important awards from her first short story book, Mid-Half, and her second short story book, Sandık Stain, continues her story adventure which she started at a young age. In this period, Kaygusuz, who was evaluated within the 90th generation of storytelling, captured a unique style of story and developed an innovative understanding of literature. In her stories Kaygusuz told the loneliness of modern man, her relationship with nature, city, streets and Anatolian people, she focused on moments of breaking rather than events and she was concerned about leaving only one effect. In her short stories, Kaygusuz avoided current events, conceptualized them rather than directly expressing the pain experienced in society and always aimed to catch the "now.. The author went beyond the boundaries of the standard language with the style she used in her stories, pushed the possibilities of the language and created her own language universe. In our study, Sema Kaygusuz's life, works, literary personality and story understanding that affect the world of literature were discussed and the stories in Kaygusuz's four story books were examined in terms of theme and structure. According to the results, the place of Kaygusuz in Turkish storytelling was determined
