Uqud al-Khidmah and the Protection of Domestic Workers: A Comparative Study between Fiqh and Indonesian Positive Law

    No full text
The issue of legal protection for domestic workers (PRT) in Indonesia remains a pressing concern, as this group has yet to receive comprehensive recognition in national legislation. This study aims to analyze the concept of uqud al-khidmah in Islamic jurisprudence (fiqh) and compare it with Indonesian positive law regarding the legal protection of domestic workers. A normative qualitative approach is employed, examining classical and contemporary Islamic legal sources alongside relevant Indonesian legal instruments, including Ministerial Regulation No. 2 of 2015 on the Protection of Domestic Workers. In Islamic law, ijarah or uqud al-khidmah contracts emphasize principles such as justice, mutual consent (an taradin), the avoidance of ambiguity (gharar), and respect for human dignity, all of which reflect a holistic framework for worker protection. In contrast, Indonesia’s positive law has yet to provide full protection, due to the absence of a specific law governing domestic work. The findings reveal that fiqh offers significant normative contributions to formulating just and humane regulations for domestic workers. Therefore, integrating Islamic legal values into national policymaking may serve as a constructive alternative to address the existing legal vacuum and enhance the protection of this vulnerable labor sector

Indonesia is known as a country with the highest Mother Mortality Rate in South East Asia. According to the Women’s Health Foundation (YKP) the main causes of death are bleeding (46,7%), Eclampsia (14,5%), and infection which can be treated quickly. In addition, AKI is also caused because pregnant women are helped by incompetent people. Women’s reproductive health problems should require the involvement and care of many parties, families, communities, religious leaders, medical experts, law officers, and policy makers. Actually, it is normal if the topic is about reproduction health because it is the main problem for the women. The reproduction organ and function is the main distinction between men and women. But then the point is not about the anatomy and physic only. It mainly about how to sue the unbalanced reality relationship that can cause the women is unhealthy in implementing their reproduction function. In Islamic history, there are so many interpretations (Tafsir) that written by the priests in order to explain Al-Quran. The interpretations sometimes contain opinions, ideas, or quotations that discuss gender distinction in interpreting Al-Quran that can result in gender discrimination in the tafsir literature that the Moslems get. The understanding of women reproduction rights that is socialized by the priests really helps the understanding of the protection and prevention of mother mortality in the society that still has strong belief of their religion. In Islam, women reproduction rights are the rights that must be guaranteed because of its reproduction function. Quantitatively, the rights are balanced with the men’s rights as doer of reproduction function. Nowadays, the religion interpretation plays very strategic role to reinforce gender equality. The interpretation of this women reproduction rights contains several rights that have to guarantee the reproduction function. Moreover, if we know very high risk that the women have in implementing their reproduction function namely pregnancy, giving a birth and breast feeding. Religion exists to give secure peaceful and blessing feeling and to reinforce justice. Now, it’s time for Al-Quran and Hadits interpreter are demanded to involve intensely in order to overcome the high rate of violence in social area and exclusively in domestic area, that full of violence to the women. Reinterpretation of theological view and understanding of the right is no doubt

State, Islam, and Gender : Dynamics of Marital Rape Law in Indonesia

    Get PDF
Marital rape, which is an act of sexual violence in marriage, is often debated among the public because it is considered an act that is impossible to happen. There is debate about responding to acts of marital rape among the community, which is the background for writing this article in a review of positive law, Islamic law, and gender justice. The purpose of this research is to understand and analyze the dynamics of rape marital law in Indonesia according to positive law, Islamic law, and gender. Using a qualitative method with a normative legal approach, this paper describes and analyzes the laws, books, and articles related to this research. The results found from this study are that marital rape is included in the crime of sexual violence, although it is not explained in detail regarding the criminal sanctions for the perpetrators. This shows that Indonesia's positive law has not touched on marital rape in detail. Marital rape is not justified in Islamic law; this can be seen from the verses of the Quran, which emphasize a good relationship between husband and wife. Based on gender justice, it is the wife who becomes the victim of marital rape because the husband thinks that he is at a higher level, so the wife must obey her husband's orders because it is an obligation, while the husband ignores the wife's rights. &nbsp

Going Beyond Counting First Authors in Author Co-citation Analysis

    Get PDF
The present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed

    Variations on the Author

“Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship

Appropriate Similarity Measures for Author Cocitation Analysis

We provide a number of new insights into the methodological discussion about author cocitation analysis. We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature. Finally, we show by means of an example that our findings have a high practical relevance.information science;Pearson correlation;cosine;similarity measure;author cocitation analysis

Dispelling the Myths Behind First-author Citation Counts

    Get PDF
We conducted a full-scale evaluative citation analysis study of scholars in the XML research field to explore just how different from each other author rankings resulting from different citation counting methods actually are, and to demonstrate the capability of emerging data and tools on the Web in supporting more realistic citation counting methods. Our results contest some common arguments for the continued use of first-author citation counts in the evaluation of scholars, such as high correlations between author rankings by first-author citation counts and other citation counting methods, and high costs of using more realistic citation counting methods that are not well-supported by the ISI databases. It is argued that increasingly available digital full text research papers make it possible for citation analysis studies to go beyond what the ISI databases have directly supported and to employ more sophisticated methods
