Metode yang digunakan dalam penelitian ini adalah pendekatan penelitian kepustakaan, dengan mengkaji literatur yang telah ada yang ditulis oleh an-Naim sendiri dan penulis lain yang tertarik dengan pemikirannya. An-Naim memandang bahwa hak setiap manusia untuk memilih agama dan keyakinannya tidak boleh menjadi batu sandungan untuk mendapatkan hak waris dari kerabatnya. Oleh karena itu, An-Naim menawarkan konsep pemikiran yang menurutnya lebih luwes dan aplikatif dalam memahami teks-teks yang berkaitan dengan hukum dalam Alquran dan Sunnah; An-Naim dalam sejarah pemikirannya pada akhirnya menawarkan tiga konsep pemikiran; 1). dekonstruksi syariah 2). Pendekatan Evolusi dan 3). Negara sekuler. Menurutnya, ketiga konsep pemikiran tersebut sangat aplikatif dalam memahami komunitas personal di era modern ini. Menurut an-Naim, agama tidak bisa dijadikan sebagai penghalang warisan. Bagi ahli HAM kelahiran Sudan ini larangan mewariskan dari agama yang berbeda merupakan pelanggaran HAM yang sudah tertulis di pasal 17 dan 18 DUHAM dan juga tidak sejalan dengan konsep Islam sebagai agama rahmatan lil alamin
