    LEGITIMASI TINDAKAN EKSTRAKONSTITUSIONAL DALAM KETATANEGARAAN INDONESIA PERSPEKTIF MASLAHAH MURSALAH

    Ekstrakonstitusional merupakan konsep yang keberadaannya seperti kepingan puzzle, beberapa pakar menggunakan istilah ini, beberapa kali diterapkan, tetapi belum banyak kalangan yang mempelajari disiplin ilmu Hukum Tata Negara mengetahui istilah ini. Tindakan Ekstrakonstitusional sendiri pada dasarnya merupakan tindakan di luar konstitusi tertulis, secara konseptual tidak ada aturan eksplisit yang mendasarinya sehingga menimbulkan tanda tanya terkait legitimasinya. Dekrit Presiden 5 Juli tahun 1959 dan Dekrit Presiden 23 Juli 2001 adalah dua contoh tindakan ekstrakonstitusional yang mempunyai implikasi penerimaan yang berbeda. Oleh sebab itu penting untuk mengkaji legitimasi pada wilayah penerimaan dan keabsahan tindakan ini, kemudian mengulik kemaslahatan khususnya maslahah mursalah melalui penelitian ini. Adapun penelitian ini adalah penelitian hukum menggunakan metode kepustakaan (library research) berdasarkan sumber data berupa bahan hukum primer yakni Undang-Undang Dasar 1945, serta bahan hukum sekundernya meliputi buku, jurnal, laporan peneltian, artikel-artikel, dan karya ilmiah yang berkaitan dengan tema penelitian. Penelitian ini adalah penelitian hukum yuridis-normatif yang bersifat deskriptif-analitis dengan pendekatan konseptual. Hasil dari penelitian ini adalah tindakan ekstrakonstitusional oleh pemerintah tidak memiliki legitimasi dari aspek legalitas hukum, melainkan diterima karena legitimasi sosiologis oleh masyarakat. Kedaruratan bukan legitimasi utama, melainkan hanya salah satu sebab timbulnya legitimasi sosiologis, serta belum tentu membuat tindakan ekstrakonstitusional dapat diterima. Pada dasarnya dalam aspek maslahah mursalah tindakan ekstrakonstitusional hadir dalam kebuntuan dari aturan konstitusional yang dapat menyebabkan kemadharatan, akan tetapi tindakan ekstrakonstitusional dapat menimbulkan akibat serupa.     Energi terbarukan berbeda dengan energi konvensional karena sifat hijau serta persebaran dan potensi yang sangat besar pada daerah di Indonesia. Namun, saat ini belum terdapat regulasi terintegrasi terkait energi terbarukan karena masih menjadi Rancangan Undang-Undang (RUU) dalam Prolegnas tahun 2022. Penelitian ini akan memberikan pandangan terhadap beberapa undang-undang yang mengatur konsepsi kewenangan bagi pemerintah pusat dan daerah dalam pengelolaan energi terbarukan. Selanjutnya, akan dianalisis prospek pengaturan energi terbarukan dengan telaah penguasaan negara dan desentralisasi dengan mempertimbangkan potensi serta kesiapan daerah. Penelitian ini adalah yuridis normatif dengan metode penelitian kepustakaan. Sumber data dan bahan hukum yang diperoleh akan dianalisis secara kualitatif.  Temuan dari penelitian ini, konsep penguasaan negara memiliki irisan dengan desentralisasi dalam pengelolaan sumber daya energi.  Daerah di Indonesia memiliki potensi yang sangat besar namun bermasalah di kesiapan. Untuk itu perlu diundangkan RUU EBT sebagai dasar hukum untuk menunjang percepatan energi terbarukan di Indonesia. Dalamnya, lima fungsi penguasaan negara dijalankan berdasar desentralisasi secara ideal yang lebih cocok untuk pengembangan energi terbarukan.Renewable energy has great potential in Indonesia, but Indonesia does not have integrated regulations related to renewable energy considering that these regulations are still in the process of the 2022 Proleges Draft Law (RUU). This research aims to outline views on renewable energy through the concept of central and regional government authority in managing renewable energy and analyzing it through the prospects for state control and decentralization, in order to see the potential readiness of regions in Indonesia. This research was conducted using normative juridical research. The results of this research show that the concept of state control has an intersection with decentralization in the management of energy resources. Indonesia has enormous potential for renewable energy, but regions in Indonesia still have challenges regarding readiness. Therefore, it is necessary to accelerate the EBT Bill as a legal basis to support the acceleration of renewable energy in Indonesia and the importance of carrying out the five functions of state control based on decentralization ideally for the development of renewable energy

    Constituent Recall bagi Anggota Dewan Perwakilan Daerah (DPD) RI

    DPD institution has many problems. On the other hand, the recall mechanism (PAW) as a forum that guarantees DPD accountability to the constituents is also problematic. It has been proven, in practice since 2014, recalls in the DPD have not been carried out as effectively as in the DPR. Recall arrangements which are mandated by the constitution through Act of Legislative produce two main focuses of this research in the form of dissecting problems and providing recommendations for arrangements whose output is reforming laws. This research method is normative juridical with qualitative data analysis from legal materials related to the theme. This study concludes that the problem of recall in the DPD is in the form of a mechanism that is less participatory for local communities as well as potential conflicts of interest because it is resolved dominantly internally by the DPD leadership and BK (Honorary Board) of the DPD. Then, the ideal recall for the DPD is a constituent recall with the Regional Government (Governor and Provincial DPRD) which proposes an interim termination on the basis of the argumentation of the reciprocal relationship between the two on the aspect of regional autonomy. In order not to be co-opted, the regional government is obliged to make the aspirations of the people the main substance of the recall. In addition, decisions can be more objective and careful because there is a relationship of checks and balances between the Governor and the Provincial DPRD

    Legislation of the presidential institution has been proposed since 2001 through the draft of the Presidential Institution Law. The problem is that presidential impeachment as a mechanism for limiting presidential power is not regulated. This study aims to: First, compare the regulations on presidential impeachment and impeachment in countries. Second, examine the existence of regulations on presidential impeachment and impeachment that currently exist in Indonesia. Third, measure the urgency of carrying out legislation on presidential impeachment in the Presidential Institution Law. This study is a doctrinal legal study that conducts a literature study with a comparative, conceptual, and legislative approach. The results of this study indicate that based on the comparison there are variations in the regulation of presidential impeachment in countries. Still, starting from the important situation of regulating this in both the constitution and legislative products, the regulation of impeachment in Indonesia itself is spread among many laws and regulations which in some cases causes technical problems in resolving the impeachment mechanism. Therefore, it is necessary to codify impeachment in one Presidential Institution Law

    Going Beyond Counting First Authors in Author Co-citation Analysis

    The present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed.     “Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship

    Appropriate Similarity Measures for Author Cocitation Analysis

    We provide a number of new insights into the methodological discussion about author cocitation analysis. We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature.     Dispelling the Myths Behind First-author Citation Counts

    We conducted a full-scale evaluative citation analysis study of scholars in the XML research field to explore just how different from each other author rankings resulting from different citation counting methods actually are, and to demonstrate the capability of emerging data and tools on the Web in supporting more realistic citation counting methods. Our results contest some common arguments for the continued use of first-author citation counts in the evaluation of scholars, such as high correlations between author rankings by first-author citation counts and other citation counting methods, and high costs of using more realistic citation counting methods that are not well-supported by the ISI databases. It is argued that increasingly available digital full text research papers make it possible for citation analysis studies to go beyond what the ISI databases have directly supported and to employ more sophisticated methods
