    Penghasilan vaksin yang mengandungi unsur najis menurut perspektif maqasid syariah

    Penggunaan vaksin pada masa kini telah menjadi popular bagi membendung penyakit yang mempunyai risiko kematian. Kerajaan Malaysia telah melaksanakan program imunisasi kebangsaan yang mewajibkan kanak-kanak mengambil 12 jenis vaksin sejak dari dilahirkan. Selain itu, kerajaan juga menggalakkan golongan dewasa untuk mengambil vaksin-vaksin tertentu bagi mengawal penyakit yang berbahaya. Namun begitu, terdapat vaksin-vaksin tertentu yang dihasilkan menggunakan bahan yang mengandungi najis seperti embrio daripada telur dan sel-sel mamalia. Penghasilan vaksin menggunakan bahan-bahan tersebut adalah kerana tiada bahan lain sebagai alternatif. Isu ini telah menjadi kemusykilan kepada umat Islam untuk menghasilkan vaksin kerana ia mengandungi unsur najis. Tujuan kajian ini dilakukan bagi menentukan pandangan syarak berkaitan isu ini. Kajian ini akan menganalisis secara deduktif prinsip-prinsip dan kaedah-kaedah syarak yang berkaitan dengan penggunaan najis bagi merawat penyakit. Kajian seterusnya merumuskan kedudukan penghasilan vaksin berasaskan bahan-bahan najis menurut perspektif maqasid syariah. Kajian ini merumuskan bahawa penghasilan vaksin yang mengandungi unsur najis pada masa kini adalah menepati prinsip maqasid syariah dan ia adalah tertakluk kepada syarat yang khusus

    حقوق المتهم في التشريع الاسلامي: دراسة تحليلية

    تهدف هذه الدراسة إلى إلقاء الضوء على مدى انسجام حقوق المتهم في الفقه الإسلامي مع حقوقه في القانون الوضعي. فالمتهم قد يتعرض لبعض الأفعال الضارة أثناء محاكمته، وهي أفعال تؤثر في مجملها على حقه، الأمر الذي يستوجب إقرار حقه في الدفاع عن نفسه. وقد عني الباحث ببيان حقوق المتهم في الفقه الإسلامي مقارنة بالقانون الوضعي، واعتمد الباحث في دراسته على المنهج الاستقرائي لجمع المعلومات المدونة في الفقه الإسلامي، كما اعتمد على المنهج المقارن بغية إجراء المقارنة بين آراء الفقهاء القدامى والمعاصرين ورأي القانون الوضعي وفي المسألة قيد البحث، ونقل أهل الشريعة وخبرائها إلى حقل الدراسات القانونية بهدف المقارنة والمقاربة والاستفادة، وبالعكس أيضاً. وخلصت الدراسة إلى أن القانون الوضعي لا يختلف كثيراً عن الفقه الإسلامي من حيث توفير الحقوق الشخصية للمتهم. فالفقه الإسلامي والقانون الوضعي يشتركان في أصل مبدأ المتهم برئ حتى تثبت إدانته

    SCIENTIFIC APPROACH AS THE BASIS FOR THE FORMATION OF MAQĀṢID AL-SHARĪ‘AH CONCEPT AND PRINCIPLES: A COMPARATIVE STUDY

    Maqāṣid al-sharī‘ah is acknowledged as one of essential foundations in determining shariah rulings. However, some contemporary fatwās continue to be issued that disregard maqāṣid al-sharī‘ah, while some groups have also misunderstood it leading to misapplication. This paper will analyze the methodology employed by classical Islamic scholars in establishing the concept and principles of maqāṣid al-sharī‘ah. The analysis will compare the methods of determining maqāṣid al-sharī‘ah by Muslim scholars with current scientific research methods. This study utilizes the qualitative methodology by examining classical and modern scholarly writings. The collected data is analyzed thematically based on an inductive approach. Findings of this study demonstrate that formulating maqāṣid al-sharī‘ah concept and principles involves analyzing textual injunctions. The istiqrā’ inductive reasoning applied by Muslim scholars bears similarities with thematic analysis in modern qualitative research. Hence, maqāṣid al-sharī‘ah represents the implicit objectives unifying diverse shariah rules. It holds greater epistemic certainty compared to individual scriptural proofs, being supported by multiple textual evidences across various domains of rulings. As the mafhūm(implicit meaning) of the Sharī‘ah corpus, maqāṣid guides ijtihād without compromising fundamental sharī‘ah tenets. Proper application of maqāṣid al-sharī‘ah facilitates determining contemporary rulings that fulfill the objectives of sharī‘ah itself. This paper advocates grounding ijtihād and fatwās in maqāṣid al-sharī‘ah through holistic textual analysis. This enables addressing new challenges through appropriate sharī‘ah rulings while avoiding rigid legalism or unfettered rationalism

    The Indigenous Idea of Gender Equality: Husband-Wife Relationship in the Manuscript of Adābul Mu’āsyarah

    Literacy in pesantren still places women as the second class, especially in the study of women's fiqh or husband-wife relations. This phenomenon has attracted researchers to conduct research on one of the books by Nusantara scholars used by Islamic boarding schools, whether it contains gender equality or not. This research focused on one of the books, Adābul Mu’āsyarah, which describes the ethics of husband and wife relations in fostering a harmonious family. By using a literature study with analytical techniques in the form of content analysis and a gender studies approach, this research found that the contents of this book by KH Yasin Asmuni have provided equal space in household relations between husband and wife. Although it cannot be denied that there are still many patriarchal terms, such as defining women as humans who lack reason and emotion, which makes men superior to women in several ways. This phenomenon of patriarchal understanding has been impacted by several factors, such as the author's background, patriarchal culture and the wave of studies that narrowed a unique case into a general provision. This research is expected to provide references and a new paradigm in describing equal husband-wife relations

    As the use of language terms plays a more and more crucial role in economic movements with the globalization of the world economy, there is rising curiosity in the relationship between language and economic view. Undeniably, the literature connected to this field is growing rapidly in this world. Related to this issue, online learning also includes a spectrum of technologies such as email, the world wide web, chat, new groups and texts, and video conferencing in the field of education. This type of online learning supports learners in understanding their swiftness, according to their flexibility. The focus of education is the key to success in academic opportunities. Education has many benefits for individuals. The purpose of this study is to grasp the Arabic terms of Maqasid Syariah via online learning using bitcoin in the post-pandemic among learners in Malaysia. The objectives of the study are; a) explore individual views from students focusing on problems in understanding terms in Maqasid Syariah related to bitcoin via online learning during the post-pandemic era and b) assess the level of readiness among Malaysian learners regarding understanding Arabic terms in Maqasid Syariah related to bitcoin via online learning during the post-pandemic era. The research methodology in this study is based on an exploratory design that includes quantitative and qualitative data collection sources. For students, moving from conventional classrooms and engaging in face-to-face activities to online learning in a virtual classroom makes learning methods radically vary in other modes

    The Importance of Applied Behavior Analysis (ABA) Therapy in Nurturing Children with Autism Spectrum Disorder (ASD) According to Maqāṣid al-Sharī’ah

    This study evaluates applied behavior analysis (ABA) therapy for individuals with autism spectrum disorder (ASD) from the perspective of maqasid syariah, addressing the lack of research in this area. The research questions focus on how ABA therapy aligns with the principles of Maqāṣid al-Sharī’ah in ASD treatment. This qualitative study collected data from journal articles, reference books, and authoritative internet sources, which were thematically analyzed using an inductive approach. The findings indicate that ABA therapy plays a crucial role in helping individuals with ASD achieve the objectives of Maqāṣid al-Sharī’ah, including the preservation of religion, life, intellect, lineage/dignity, and property. ABA therapy was found to be effective in enhancing the ability of individuals with ASD to understand and practice religious teachings, reducing harmful behaviors, obtaining proper nutrition, improving cognitive function and mental health, addressing problematic sexual behaviors, and increasing work capacity and independence

    The manifestations of differences in Islamic jurisprudential branches have been evident since the early Islamic period, emerging in the ijtihād (independent reasoning) of the Companions after the Prophet\u27s (PBUH) death and continuing in subsequent eras. Initially, ijtihād was not a cause of conflict and division, but a means to define concepts that lead to the truth. However, over time the differences devolved into sectarian fanaticism and blind adherence to opinions, leading to discord within the Muslim community. This study examines the efforts of Imam al-Shātibī in reconciling the viewpoints of jurists and legal theorists on issues amenable to convergence and unity, and his proposed approach to dealing with madhhab (school of thought) differences, through an analysis of his seminal work "al-Muwāfaqāt fī Uṣūl al-Sharīcah". This study employs an inductive-analytical approach, tracing and analyzing the relevant content in al-Shātibī\u27s al-Muwāfaqāt, as well as a comparative method to contrast Imam al-Shatibi\u27s views with those of others, in order to highlight his contributions and limitations, and validate the findings. The study concludes that Imam al-Shatibi\u27s efforts in this regard were focused on affirming the principle of "consideration of disagreement" (murācāt al-khilāf). This work is found to be beneficial and deserving of further scholarly attention to address the reprehensible differences in the Muslim world. Finally, this research provides a valuable contribution to the international scholarship on Islamic jurisprudence and legal theory, by shedding light on a critical and timely issue of sectarian divisions, and highlighting the constructive approach proposed by a prominent Islamic scholar, Imam al-Shatibi, to address this challenge.   الملخص في الحقيقة أنَّ مظاهر الخلافات في الفروع الفقهيَّة قد ظهرت بوضوح منذ بداية العهد الأوَّل، وتبيّن ذلك في اجتهادات الصَّحابة بعد وفاة النبي -صلّى الله عليه وسلّم-، ثمّ ما تلاه من العصور. وفي بداية الأمر، لم يكن حدوث الاجتهاد سببًا في النِّزاع والفرقة، ولكن كان وسيلة إلى تحديد مفاهيم الأشياء، بل للوصول إلى الحقِّ. ولكن بمرور الزمن تحوّل الخلاف إلى التَّعصب المذهبي وقبول الرَّأي بلا حجة ممَّا أدَّى إلى النِّزاع بين الأمَّة. هذه الدِّراسة عن جهود الإمام الشَّاطبي – رحمة الله عليه - في تقريب وجهة نظر الفقهاء والأصوليين في المسائل التي تقبل التَّقارب والاتِّحاد، ومحاولة الإتيان بأسلوب التعامل مع الخلافات المذهبية، وذلك عبر قراءة كتابه النَّفيس "الموافقات في أصول الشَّريعة"، حيث تميَّزت طريقة الشَّاطبي الأصوليَّة في معالجة هذا الموضوع من خلال اقتراح قواعد مقاصدية في ذلك. واعتمدت الدِّراسة على المنهج الاستقرائي والتَّحليلي، وذلك بتتبُّع ما أورده الإمام الشاطبي في كتابه الموافقات وجمع المعلومات ذات العلاقة بالموضوع وتحليلها، كما استخدمت المنهج المقارن لمقارنة آراء الإمام بغيره، لإبراز ما للإمام وما عليه، وللتأكُّد من سلامة نتائج التَّنـزيل والتَّطبيق. وتوصّلت الدِّراسة إلى أنَّ جهود الإمام الشَّاطبي في هذا الصّدد منصبة على تأكيد الإمام قاعدة مراعاة الخلاف. وأخيرًا خلُصت الدِّراسة إلى أنَّ هذا العمل نافع وينبغي أن توجه تجاهه أقلام العلماء والباحثين للقضاء على الاختلاف المذموم في العالم الإسلامي.The manifestations of differences in Islamic jurisprudential branches have been evident since the early Islamic period, emerging in the ijtihād (independent reasoning) of the Companions after the Prophet\u27s (PBUH) death and continuing in subsequent eras.
