    This paper attempt to explain how Quraish Shihab’s argument on veil. In his books entitled Jilbab, the controversy emerges among Muslim in Indonesia. I argue that Quraish Shihab’s argument of veiling is based on Muslim scholars along classical period until now. There is no prohibition or suggestion specifically about the rule of veil. Quraish Shihab position himself as Muslim scholar who expose the whole argument that he believes its true.    &nbsp

    Reinforce Nationality Through Religious Local Tradition (Case Study of Malam Tirakatan in Yogyakarta)

    Celebrating of IndependenceDay became a part of symbol of honour from the citizenship for their country. In many places freedom is celebrated, including in Indonesia. The celebration is an annual event organized by goverment and citizen, both formal and informal. Formally, the goverment of Indonesia from local level to the centre celebrate this day by flag ceremony on the seventeent of August. Somehow in non-formal, citizen commemorate this day by various manner such aspanjatpinang contest etc. One form of celebration in Indonesia to celebrate the independence day is called “malam tirakatan†or “malam pitulasanâ€, especially in the area of Yogyakarta. Malam tirakatan is kind of acculturation from Moslem local tradition.This paper describe aboutmalam tirakatanas an acculturation between religious local traditions with a sense of nationalism. I use the method of triangulation for collect data which are participant observation, deep interview and documentation. The location of this research is focused on two different places, first in Dukuh the village of Bantul district and second in Ngaseman village, a part of village of Kulon Progo district. From this research known that Indonesian Moslems reinforce their nationality by their religious local tradition

    The basic concept of fatwa in its position of binding law is legal opinion in Indonesia. But in certain cases fatwa has a legal binding which is must be obeyed by people. This article demonstrate how fatwa has a legal binding in the context of Indonesia. The objects of research specifically is banking sharia act in which it is said Islamic economy activities must be appropriate  with the fatwa of national sharia council. As concluding remark, this article show the development of fatwa from legal opinion to legal binding through the constitution as represent by sharia banking act.  &nbsp

    Makalah ini berupaya untuk memaparkan sejarah dua organisasi Islam di Jawa Barat; Persis (Persatuan Islam) dan PUI (Persatuan Umat Islam), dan dampaknya terhadap konstruksi sosial, terutama dalam hal pendidikan Islam. Keduanya telah memainkan peran penting dalam aktivitas sosial, terutama dalam konteks da'wah Islam dan pendidikan. Signifikansi dari karya ini terletak pada temuannya bahwa sebuah pergeseran telah muncul baik di bidang praktik maupun konsep doktrinal dalam wacana Islam di Jawa Barat, sejak kemunculan Persis dan PUI. Artikel ini membangun sebuah opini bahwa kemunculan keduanya telah menandai modernisasi pemikiran umat Islam di Jawa Barat. Secara praktis, masyarakat Sunda yang menganut Islam tradisional pada akhirnya terpinggirkan dari daerah perkotaan ke pedalaman.Kata kunci: PUI, Persis, Jawa Barat, Peralihan Tradisi

    This Article examines the concept of Islamic agreement in Islamic banking on its regulation and implementation. The product of Bank Muamalat is the example for analyzed. Eventually, how compatible were the ideas and concepts of Islamic Agreement with Islamic Banking in Indonesia is one important question to be answered. I argue that Islamic Banking in Indonesia still has many problems for applying tightly the regulation of Islamic agreement in the basic of act (UUD) and the fatwa of Sharia National Council (DSN)

    Abstract Recently, Shi’a-Sunni’s controversy in Indonesia increase dramatically as occurring as geo-political clash in the Middle East, particularly between Saudi Arabia and Iran. The culmination of Indonesian Shi’a’s conflict is assigned by expulsion several communities from their home and village. Afterward, that’s discrimination is legitimated by the book of MUI entitled Mengenal dan Mewaspadai Penyimpangan Syi’ah di Indonesia. This article aims to review the book’s contents by using linguistic philosophy in form of Stephen Toulmin’s theory of argumentation. Stephen Toulmin is professor of Linguistic Philosophy Studies at Cambridge University. He develops six concepts for examine argumentation namely data, claim, warrants, backing, qualifier and rebuttal. Dialectically, its six concepts is related each other to form an argumentation. A good argumentation, as Toulmin’s opinion, is arranged from factual and objective data, supported by strong warrants and backing, truthful qualifier, and can defend from rebuttal. As one of result, this research shows that the correlation between data and claim in MUI’s book categorized as unilateral fact that produces negative issues and impacts to discriminative action for Shi’a community.   Keywords: Indonesian Shi’a, Stephen Toulmin, Theory of Argument Abstrak Perdebatan mengenai Syiah di Indonesia meningkat seiring dengan meruncingnya kontestasi geopolitik di Timur Tengah, khususnya  yang diwakili oleh Saudi Arabia dan Iran. Konflik Syiah di Indonesia mencapai puncaknya ditandai dengan pengusiran sebagian kelompok Syiah dari tempat tinggal dan kampung halamannya. Perbuatan diskriminatif atas komunitas Syiah itu kemudian mendapatkan legitimasi dengan terbit dan beredarnya buku atas nama MUI pusat yang berjudul Mengenal dan Mewaspadai Penyimpangan Syi’ah di Indonesia. Artikel ini hendak meninjau ulang bangunan wacana dalam buku tersebut dengan perspektif filsafat linguistik, tepatnya menggunakan teori argumentasi yang digagas oleh Stephen Toulmin. Sebuah wacana argumentatif dapat disebut baik, menurut Toulmin, apabila data yang disajikan merupakan fakta bersifat objektif yang didukung oleh warrant dan backing yang kuat, jujur atas qualifier, serta dapat mempertahankan diri dari rebuttal. Salah satu kesimpulan penelitian menunjukkan bahwa korelasi antara data dan claim  dalam buku MUI tentang Syiah dikategorikan sebagai fakta sepihak yang melahirkan isu negatif dan dapat berimplikasi pada sikap diskriminatif terhadap komunitas syiah.         Kata Kunci: Syiah Indonesia, Stephen Toulmin, Teori Argumentasi

    The Quran and Muslim Minority Scholar’s Perspective: A Comparative Study of Abdullah Saeed and Farid Esack

    This article discusses an alternative perspective in understanding the content of the Qur’an i.e., the perspective of minority Muslim scholars. The object of this study is the thought of tafsir Abdullah Saeed and Farid Esack who are positioned as Muslim scholars of Western institutions living as a minority, how their views of the Qur’an and how they develop interpretive methodologies according to the context of the environment in which they live. This article shows that the construction of the thought of Abdullah Saeed and Farid Esack positioned as minority scholars can represent its own contemporary model of interpretation. Abdullah Saeed with the idea of contextual interpretation laid out three bases of interpretive methodology: hierarchical values, contextual meaning, and systematic contextual interpretation. The three bases of the methodology are used to see the extent to which verses on ethical law can be understood and practiced in contemporary contexts while remaining grounded in the substance of the values carried when they are derived. While Farid Esack with his idea of liberative exegesis tried to break conservatism in South Africa with three methodological foundations: progressive revelation, reception hermeneutics, and the liberation theology of the Qur’an. The foundation of this methodology was used as a basis for value and legitimacy in supporting the agenda of popular solidarity between Muslims and non-Muslims in South Africa to overthrow the apartheid regime
