    Persepsi Pesantren terhadap Non-muslim dalam Kitab Fiqh Klasik (Studi Kasus di Provinsi Gorontalo)

    This study concentrates on the views of pesantren residents towards non-Muslims. According to the kitab kuning (yellow book) studied by Islamic boarding schools, non-Muslims are categorized in the second position in life. In this study, we found that although non-Muslims are the second category in the yellow book from the opinion of the ulama, pesantren residents who have experience living with non-Muslims can still give an equal level. Specifically from this research, the formulation of the problem is how is the perception of pesantren towards non-Muslims? and is the pesantren\u27s religious view of non-Muslims influenced by the yellow book? To analyze the perception of pesantren towards non-Muslims, we use qualitative analysis with three approaches: normative, sociological, and cultural. We used the collective data method with observations, interviews, and documents. This study argues that although non-Muslims are the second category in the yellow book but when the teacher has new knowledge, he will interpret it, trying to interpret the yellow book that is friendly because they have the reality of living with non-Muslims. Pesantrens that have experience living with non-Muslims tend to be inclusive, while pesantrens that do not have experience of living with non-Muslims tend to be exclusive.Penelitian ini berkonsentrasi kepada pandangan warga pesantren terhadap nonmuslim. Menurut kitab kuning yang dipelajari dipesantren-pesantren, nonmuslim dikategorikan pada posisi kedua dalam hidup ini. Dalam penelitian ini, kami menemukan walau nomuslim adalah kategori kedua dalam kitab kuning dari pendapat para ulama tetapi warga pesantren yang memiliki pengalaman hidup dengan nonmuslim tetap dapat memberi level setara. Khusus dari penelitian ini, rumusan masalahnya adalah bagaimana persepsi pesantren terhadap nonmuslim? dan apakah pandangan keagamaan pesantren tentang nonmuslim dipengaruhi oleh kitab kuning? Untuk menganalisis, persepsi pesantren terhadap nonmuslim, kami menggunakan analisis kuwalitatif dengan tiga pendekatan : normatif, sosiologi dan budaya. Kami menggunakan metode data kolektif dengan pengamatan, wawancara, dan dokumen. Penelitian ini berargumen bahwa walaupun nonmuslim kategori kedua dalam kitab kuning tapi ketika pengajarnya memiliki pengetahuan baru maka ia akan menginterprestasi, berusaha menafsirkan kitab kuning yang ramah karena mereka memiliki reality hidup bersama nonmuslim. Pesantren yang memiliki pengalaman hidup bersama masyarakat nonmuslim cenderung inklusif sementara pesantren yang tidak memiliki pengalaman hidup bersama nonmuslim cenderung eksklusif

    Dalam sejarah pemberlakuan hukum Islam di Indonesia, muncul teori “receptio in complexu†oleh L.W.C. Van Der Berg yaitu orang-orang muslim Indonesia menerima syri’at secara keseluruhan. Teori ini mendapat tantangan dari C. Van Vollenhopen dan C. Snouck Hurgronye dengan teori “receptio†yaitu hukum Islam berlaku setelah diresepsi oleh hukum adat. Kemudian Hazairin menantangnya dengan teori “receptio exitâ€. Teori ini selanjutnya dikembangkan oleh Sayuti Thalib dengan teori â€receptio a contrario†yang menyatakan bahwa hukum yang berlaku bagi rakyat Indonesia adalah hukum agamanya yang berarti hukum adat hanya berlaku kalau tidak bertentangan dengan hukum agama. Di tengah pertarungan teori-teori itu, kini masyarakat Indonesia telah memiliki hukum tertulis walaupun sifatnya masih terbatas, tentang Peradilan Agama, Kompilasi Hukum Islam, Wakaf Tanah Milik dan sebagainya

    This paper concentrates on a happy family in Interfaith Marriage. According to the majority ulama, marriage is a theological activity that couple interfaith marriage will not a happy family. In this paper, I examine the interfaith marriage couple can be a happy family. Specifically, I ask how to concept a happy family according to the interfaith married couples? Further, how to manage family conflict on interfaith marriage for to get a happy family? To analyse a happy family on interfaith marriage couple, I use a qualitative analysis method with three approaches: Islamic law, sociology and psychology context.  I use data collection methods with observation, interviews, and documents. This research argues that religion is not a major factor in a happy family because interfaith marriage can be a happy family. Worries Ulama that interfaith couples cannot be a happy family does not happen. The contribution of this study as the antithesis according to ulama about interfaith marriage, that happiness is not correlated with religion

    Fatwa dalam Pemikiran Hukum Islam

    Fatwa is a product of Islamic legal thought which gives answers to the questions of law determined by the mufti. The answer given by the mufti can only verbally, but usually in written form. Philosophically, giving fatwa means gave the law of God to man. Therefore, one must know what the mufti delivered and to be a famous person\u27s right, good behavior and credible, both words and deeds. Although the fatwa is not binding, but factually fatwa play an important role and occupies a strategic position in the treasures of the dynamics of Islamic law globally mainly in various parts of the Islamic world. Institutions such as the MUI fatwa in Indonesia, Nahdlatul Ulama Bahtsul Masa\u27il (hereinafter referred to as NU) and Muhammadiyah Legal Affairs Committee.Fatwa adalah produk pemikiran hukum Islam yang memberikan jawaban atas pertanyaan yang berketetapan hukum oleh mufti. Jawaban yang diberikan oleh mufti dapat saja secara lisan, akan tetapi lazimnya dalam bentuk tertulis. Secara filosofis, memberi fatwa berarti menyampaikan hukum Allah kepada manusia. Karena itu, seseorang mufti harus mengetahui apa yang disampaikan dan harus orang yang terkenal benar, baik tingkah lakunya dan kredibel, baik perkataan maupun perbuatannya. Meskipun fatwa tidak mengikat, namun secara faktual fatwa memainkan peran penting dan menempati posisi strategis dalam khazanah dinamika hukum Islam secara global terutama diberbagai belahan dunia Islam.     Indications of Discrimination in Regional Regulation Against Migrants in Bali (Bali Regulation Number 4 of 2019)

    This study aims to find out the background of the formation of Peraturan Daerah (Regional Regulation – Regional Regulation) Number 4 of 2019. The researcher found that there is an effort by the Bali provincial government to provide a legal umbrella to the Customary Village in regulating its citizens and forming awig-awig or village rules respectively as a customary village. But the migrants in Bali who are mostly Muslims in Bali feel this is a form of discrimination. To analyze this problem the author uses qualitative research. Primary data sources are from the Bali Provincial Legal Bureau, from the Village Development Office, Traditional Village administrators, and migrants in Bali.  Meanwhile, migrants on the island of Bali, the majority of whom are Muslims, feel that the Adat Village regulation as the embodiment of Regional Regulation Number 4  of 2019 is a discriminatory regional regulation because it provides a legal umbrella for the implementation of fees/collections carried out by Adat Villages in Bali. There is also competition or competition such as in the economic field, migrants or tamiu who live in Bali to try their luck and make a living are considered obstacles for residents. The 2011 bombing incident was also the peak of the conflict because the perpetrators were migrants/tamiu in Bali.  This research finds that the relationship between Islam and Hinduism in Bali appears to be harmonious, but in fact it is shrouded in several hidden conflicts called Pragmatic Tolerance. The contribution of this research is expected to benefit the meaning of religious moderation in the scheme of real religious tolerance in Indonesia

    This study discusses effective communication for polygamy couples in Bone Bolango Regency. This research is a field research with data collection methods such as observation, interviews and documentation. The data collected is processed and analyzed with descriptive qualitative using a communication approach. The results showed that polygamists in Gorontalo Regency in living their household life remained harmonious. This is because the couple always get used to communicating effectively, so that all household problems can be resolved properly.Penelitian ini membahas komunikasi efektif bagi pasangan poligami di Kabupaten Bone Bolango. Penelitian ini adalah penelitian lapangan dengan metode pengumpulan data berupa pengamatan, wawancara dan dokumentasi. Data yang dikumpulkan diolah dan dianalisis dengan deskriptif kualitatif dengan menggunakan pendekatan komunikasi. Hasil penelitian menunjukkan bahwa pelaku poligami di Kabupaten Gorontalo dalam menjalani kehidupan rumah tangganya tetap harmonis. Hal ini dikarenakan pasangan tersebut senantiasa membiasakan berkomunikasi secara efektif, sehingga segala persoalan rumah tangga dapat diselesaikan dengan baik

    This paper aims to determine the sociological factors which underlying the birth of the old fatwas (qaul qadim) and the new fatwas of Imam Shafi\u27i. This research is a qualitative descriptive with the sociology of Islamic law approach. The results showed that the birth of the old fatwas and the new fatwas of Imam Shafi\u27i because the time difference and the case in the area of Baghdad and Egypt when he settled there. The fatwa difference to accommodate legal issues that arise at the moment and this requires ijtihad, so that Islamic law will contribute significantly and functional in anticipation of social dynamics with different complexity of the problems it causes

    The Pogogutat Tradition of the Mongondow Tribe in North Sulawesi on Maslahah Mursalah Perspective

    This study aims to discuss the Mongondow tribal pogogutat tradition in North Sulawesi with a maslahah mursalah approach. This research is field research and data collected through observation, interviews and documents. The collected data were analyzed by qualitative descriptive through fiqh approach, namely the problem masseah. The results showed: First, there was a shift in the practice of pogogutat, starting from the business of making tent services, catering services, increasing people\u27s income, without the terms and conditions of the goods. Pogogutat value shift due to lack of social life, tribal and cultural assimilation, village government regulations, lack of community awareness in understanding local culture, lack of cultural communication, lack of cultural learning and pogogutat tradition, environmental changes, and the influence of modern culture; Second, although the Pogogutat tradition has negative values, the Pogogutat tradition tends to have positive values ​​as a primary need (darûriyât).Penelitian ini bertujuan untuk mengetahui tradisi pogogutat suku Mongondow di Sulawesi Utara dengan pendekatan maslahah mursalah. Penelitian ini adalah penelitian lapangan dan data dikumpulkan melalui observasi, wawancara dan dokumen. Data yang terkumpul dianalisis dengan deskriptif kualitatif melalui pendekatan fikih, yaitu maslahah mursalah. Hasil penelitian menunjukkan: Pertama, adanya pergeseran praktek pogogutat, mulai dari usaha dagang jasa pembuatan tenda, jasa katering, meningkatnya pendapatan masyarakat, tanpa syarat dan ketentuan barang. Pergeseran nilai pogogutat dikarenakan kurangnya jiwa sosial masyarakat, asimilasi suku dan budaya, peraturan pemerintah desa, kurangnya kesadaran masyarakat dalam memahami budaya lokal, minimnya komunikasi budaya, kurangnya pembelajaran budaya dan tradisi pogogutat, perubahan lingkungan, dan pengaruh budaya modern; Kedua, walaupun tradisi pogogutat mempunyai nilai-nilai negatif, namun tradisi pogogutat cenderung mempunyai nilai-nilai positif sebagai kebutuhan primer (darûriyât)

    Going Beyond Counting First Authors in Author Co-citation Analysis

    The present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed
