POTENSI SERTIFIKASI HALAL DALAM MENGHADAPI MASYARAKAT EKONOMI ASEAN (MEA)
Abstract: Countries in various parts of the world are currently very concerned about the importance of an adequate standard of living with a sense of safety in the use of a product. Product quality is determined based on a standard of eligibility with evidence of a packaging label. The label is a guideline for determining the level of a product used. ASEAN as a single market and a unified production base, with free flow of goods, services, production factors, investment, and capital, as well as the elimination of tariffs for trade between ASEAN countries, is a reality that ASEAN countries, especially Indonesia, cannot negotiate. The movement of goods in ASEAN in free trade causes the Muslim community in Indonesia and other ASEAN countries to question the halalness of products that enter from abroad, therefore. This article aims to discuss the potential for halal certification in the scope of development of the ASEAN economic community market. This research method is normative juridical and analytical descriptive. The results show that halal certification for food products must be carried out, by taking into account the uniformity of requirements, labels, and registration in one application for registration of halal certification in ASEAN Countries ASEAN national cooperation related to halal certification such as the establishment of institutions (regional halal accreditation boards), the establishment of a single registration system. application, uniformity of requirements, halal standards, regional certification, the establishment of regulations, and approval in the field of halal certification are the right solutions today to provide convenience for business actors while ensuring the safety of halal products in Indonesia
Aspek Hukum Standarisasi Produk di Indonesia dalam Rangka Masyarakat Ekonomi ASEAN
Standardization is an important aspect for Indonesia in global market competition, especially in the MEA (ASEAN Economic Community). This study raises the issues of, first, the strategy to improve product quality through Product Standardization in Indonesia in relation to MEA from the perspective of consumer protection law. Second, how ASEAN MRA (Mutual Recognition Arrangement) is adopted by ASEAN countries in the framework of MEA. The method used in this study is a normative juridical method, which includes research on positive legal inventory, research on legal principles, and in concreto legal research as well as legal comparisons. The results indicate that, first, the strategy to improve product quality through national product standardization is done by harmonizing national regulations to accelerate trade relations and protection of the Southeast Asian market. Second, ASEAN MRA is adopted by ASEAN countries with the use of MRA at the regional level, which can be seen in practice in ASEAN. The MRA concept is used by ASEAN through the ASEAN Framework Agreement on Mutual Recognition Arrangements that is currently contained in the ASEAN MRA used to support the AFTA free trade regime that was established to actualize trade liberalization among ASEAN countries
Implementasi Besaran Bunga Peer to Peer Lending Berdasarkan Asas Itikad Baik dalam Pemanfaatan Teknologi Informasi Serta Pengawasannya
Peer to Peer Lending (“P2P Lendingâ€) is one of financial technology products as financing alternative for public. The execution of P2P Lending is under supervision of OJK which regulated in POJK Number 77/POJK.01/2016. OJK appointed AFPI as OJK’s strategic partner who is authorized to make regulations on the execution of P2P Lending for Providers which accommodated in Code of Conduct formed by AFPI. In brief, this Code of Conduct contains rules that have not been accommodated in POJK Number 77/POJK.01/2016, which interest rates regulation is a part of the Code of Conduct. Interest rates in P2P Lending only accommodated in Code of Conduct, but it has not been well obeyed by the Providers because there are still infringement in determining the interest rates which exceed the predetermined standard with the unclear interest rate information notice. Therefore, this article aims to analyse the application of P2P Lending interest rates which only regulated in Code of Conduct. Furthermore, researcher will also analyse the utilization of information technology in P2P Lending to find out whether the implementation of P2P is in accordance with the good faith principle of the use of information technology in Law Number 11 of 2008 concerning Information and Electronic Transactions. The results of this legal research indicate that OJK are expected to set loan interest rates in P2P Lending individually so that it can provide legal certainty for each party in P2P Lending which impacts on the implementation of P2P Lending
Kekerasan Berbasis Gender Online (KBGO) dalam Game Online Menurut Hukum di Indonesia Serta Perbandingan dengan Negara Lain
Kekerasan Berbasis Gender Online (KBGO) menjadi suatu permasalahan hukum baru secara global yang terjadi di berbagai platform online. Adapun kekerasan berbasis gender online ini terdiri dari berbagai bentuk perbuatan salah satunya adalah pelecehan seksual. Pelecehan seksual yang dimaksud ialah pelecehan seksual secara virtual yakni secara verbal yang terjadi di ruang virtual salah satunya dalam game online. Adapun secara internasional, KBGO dikategorikan sebagai kekerasan yang diatur dalam pelanggaran hak asasi manusia. Adanya kerangka hukum yang memadai menjadi salah satu prasyarat penting bagi pencegahan KBGO dan perlindungan korban atas KBGO terutama bagi Indonesia. Dalam langkah mendorong dan memperkuat pencegahan KBGO serta memberikan perlindungan kepada korban KBGO, penelitian ini akan menelaah bagaimana kerangka hukum Indonesia menanggapi kasus KBGO terkhusus dalam dengan memperbandingkan kerangka hukum di negara lain. Metode penelitian yang digunakan dalam penelitian ini adalah metode pendekatan yuridis normatif dengan spesifikasi penelitian deskriptif analitis yang didukung dengan data primer dan sekunder melalui pengumpulan data penelitian kepustakaan. Dalam hal ini, hasil penelitian bertumpu pada langkah yang diperlukan untuk diterapkan negara Indonesia dalam membangun kerangka hukum positif dalam merespon adanya perbuatan KBGO dengan memperbandingkan kerangka hukum di negara Filipina dan negara Uni Eropa. Diharapkan, dengan adanya penelitian ini, kerangka hukum di Indonesia tidak hanya dapat mencakup tindak kejahatan yang terjadi di dunia nyata, tetapi juga di dunia maya
Perlindungan Hukum Terhadap Konsumen Peer To Peer Lending Atas Perbuatan Melawan Hukum Yang Dilakukan Oleh Debt Collector
The Financial Services Authority (OJK) in carrying out the regulatory function has regulated peer to peer lending in POJK No.77 / POJK.01/ 2016 (POJK LPMUBTI), but in the POJK LPMUBTI does not regulate the use of third parties or debt collector when collecting loans to consumers. This is only regulated in the Code of Conduct created by AFPI and there are still infringement by third parties or debt collectors peer to peer lending to consumers when collecting loans to consumers. This research is to analyse the regulation of the use of third parties or debt collectors in peer to peer lending when collecting loan to consumers and dispute resolution that can be done by consumers against debt collectors who commit unlawful acts in collecting loans. The method used in this article is normative juridical approach, which focuses on examining the implementation of written legal regulations and literatures. The results of this research shows that the Financial Services Authority has not yet regulated about the regulation of the use of debt collectors in peer to peer lending, it is only regulated in the Code of Conduct prepared by AFPI, so that it does not have a legal position thereby causing legal uncertainty. And it also shows that consumers can do dispute resolution in two steps, first complaint through the peer to peer lending providers and the second is through litigation process or non litigation process such as through the Alternative Dispute Resolution Institution (LAPS) provided by the OJK.Â
Penggunaan Aplikasi Virtual Private Network (VPN) Point To Point Tunneling Protocol (PPTP) Dalam Mengakses Situs Terblokir
The discovery of a Virtual Private Network (VPN) makes it easy to access the internet wherever and whenever. Many service providers see the advantages of VPN being commercially usable, VPNs are very vulnerable to hacker attacks, cracking that supports data or information from VPN application users, this research offers to provide information about VPN security Point to Point Tunneling protocol (PPTP) and whether the VPN security system has been licensed and is in accordance with applicable law or not. This research is normative juridical. By using analytical descriptive analysis, this research provides facts about VPN security point to point tunneling protocol (PPTP) in accessing blocked sites, discussed with the Electronic Transaction Information Act. Keywords: Virtual Private Network (VPN), point to point tunneling protocol (PPTP), Blocked Site, Penemuan Virtual Private Network (VPN) memberi kemudahan untuk mengakses internet dimanapun dan kapanpun. Banyak penyedia layanan melihat keuntungan bahwa VPN ini bisa digunakan gratis secara komersial, VPN sangat rentan dari serangan hacker, cracking yang mampu mencuri data atau informasi dari pengguna aplikasi VPN, penelitian ini bertujuan untuk memberikan informasi mengenai keamanan VPN Point to Point Tunneling protocol (PPTP) dan apakah sistem keamanan VPN tersebut sudah mendapatkan perizinan dan sesuai dengan Undang-Undang yang berlaku atau tidak. Strengthening Regulations towards Implementation of Intellectual Property-Based Financing Scheme with YouTube Content as Collateral
This research aims at examining how the regulator can make regulation to optimize financing implementation with YouTube content as a collateral. This research is considered necessary, because besides Government Regulation Number 24 Year 2022 which becomes the basis to give financing under an intellectual property as a collateral, banking institutions might still be in doubt to implement such a financing scheme due to many weak supporting regulations. This research is conducted with a normative-juridical approach method. The research shows that there are still many regulations which have not accommodated the financing implementation of intellectual property-based financing scheme basis, especially those regulations related to valuation, recognition of intellectual property as a banking asset and execution of intellectual property when a debtor default. The weak regulation of these three aspects makes financial institutions doubtful to implement the intellectual property-based financing especially because bank activities are to collect and distribute funds to the society. The conclusions of this research show that basically there has been a method or way to anticipate the three problems, but it needs to be legalized in a form of regulation so that the bank has legal certainty and protection in its financing with intellectual property as the collateral. The regulators are supposed to be able to create regulation to optimize financing implementation with intellectual property as the collateral
Reliability and Security in the Implementation of Digital Health Service Application with the Application of "Reliability Certification or Electronic Certification" based on Indonesian Law
Societies are always changing rapidly. Initially, societies recognize ordinary health services. Now, people acknowledge web application based digital health services. This rapid change raises potential problems such as the sale of illegal drugs, user data theft, and illegal health workers. Unfortunately, the government has not provided actions to respond the issues quickly. There is no law that underlies the implementation of web application. It increases the possibility of other potential problems. Therefore, it is necessary to question the reliability and security of the implementation of the application and the form of legal responsibility of the organizer. This study used a normative juridical method, which is carried out by examining secondary data as the main study material. The study reveals that the reliability and security in the implementation of applications both as an electronic system and as a health service facility can still be optimized. JURIDICAL REVIEW OF THE PRINCIPLE OF JUSTICE IN THE PROTECTION OF COPYRIGHT OWNERSHIP FOR WORKS CREATED IN COURSE OF PUBLIC SERVICE RELATIONS ACCORDING TO LAW NUMBER 28 OF 2014 ON COPYRIGHT DAN ITS COMPARISON WITH COPYRIGHT REGULATIONS IN FRANCE AND GERMA
The regulation of copyright ownership of works created in Public Service Relations, as stated in Article 35 of the Copyright Law, indicates an injustice in the protection of copyright ownership for creators. This research aims to examine the implementation of the principle of justice in copyright ownership of works created in Public Service Relations and to compare this with the regulations in Germany and France. This study employs a comparative normative juridical approach with a descriptive-analytical research specification. Data collection is conducted through literature studies. The method of analysis used is descriptive-analytical. The results show that the regulation in Article 35 of the Copyright Law lacks elements of justice for creators in Public Service Relations. This is due to the difference in recognition given to creators of works made in Public Service Relations compared to works made in employment relationships. Compared to the regulations in Germany and France, the regulation of copyright ownership for "works made for hire" in Indonesia does not yet provide adequate protection for creators
