    Telaah Problematika Perceraian (Thalaq) Perspektif Asghar Ali Engineer

    This article explains the thoughts built by Asghar Ali Engineer. The author focuses on one of the major sub-themes in the book The Qur’an Women and Modern Society, namely divorce in the Qur’an and Shari’ah. According to Asghar Ali Engineer, legal experts have agreed to a divorce that is still exclusive in the area of men. Basically, in the Qur’an there is no such explicit statement. Thus only conclusions, not holy rules, are interpreted by medieval scholars of QS. Al-Qur’an al-Baqarah 2: 237. According to him, there are several verses of the Qur’an about divorce which according to Asghar are not relevant to the current context, only at the time of the Prophet. The object of the study in this study is to describe the methodology of Asghar in interpreting verses about divorce. Furthermore, from the explanation of Asghar Ali Engineer who has been detailed, indeed he has used the method he built, namely liberation theology, which this time focused on the theme of gender equality. The concept that he built can be broken down by the model of liberative-sociological normative interpretation

    According to the view of liberation theology, Islamic education must be able to produce people who take a role in the social system that promotes justice as citizens and citizens of the world in the view of religion (just, not oppressed) who are damaged by humans themselves. From the explanation, the author was interested in conducting a study "Liberation Theology in Islamic Education Perspective of Asghar Ali Engineer".The formulation of the research problem is: 1. What is the meaning of Liberation Theology? 2. What is the Asghar Ali Engineer's Perspective  Liberation Theology? 3. How is the Liberation Theological Implication for Islamic Education Asghar Ali Engineer Perspective? This research was conducted with literature research. His research methods include data sources, data collection and data analysis. The results of the study concluded that the Liberation Theology according to Asghar Ali Engineer was interpreted as freedom that emphasizes the aspect of reason or construct of thinking in interpreting the book (holy text). For him, theology is a reflection of existing social conditions, and thus a theology is socially constructed. Asghar's method of thinking is normative and transcendental. Theological Implications of Liberation for Islamic Education include; Islamic Education is a practice of liberation, curriculum development is carried out in line with the development of non-curriculum factors, including the effects of economic, political, social, cultural, legal and other changes, including the academic factors of the kurikuluym, Asghar Ali Engineer views the Qur'an, as well as the text other texts, can be interpreted by various methods.Menurut  pandangan teologi pembebasan, pendidikan Islam harus mampu menghasilkan manusia yang mengambil peran dalam sistem sosial yang mengedepankan keadilan sebagai warga negara dan warga dunia dalam pandangan agama (manusia yang adil, tidak tertindas) yang dirusak oleh manusia sendiri. Dari paparan tersebut penulis merasa tertarik untuk melakuakan penelitian “Teologi Pembebasan dalam Pendidikan Islam Perspektif Asghar Ali Engineerâ€. Rumusan masalah penelitian ini adalah : 1. Apa makna Teologi Pembebasan? 2. Bagaimana Teologi Pembebasan Persepektif Asghar Ali Engineer? 3. Bagaimana Implikasi Teologi Pembebasan Bagi Pendidikan Islam Persepektif Asghar Ali Engineer? Penelitian ini dilakukan dengan penelitian literatur (Library research). Metode penelitiannya mencakup sumber data, pengumpulan data, dan analisis data. Hasil penelitian disimpulkan bahwa Teologi Pembebasan menurut Asghar Ali Engineer adalah diartikan sebagai kebebasan yang menitik beratkan pada aspek akal atau konstruk berpikir dalam menafsirkan kitab (teks suci). Baginya, teologi adalah refleksi dari kondisi sosial yang ada, dan dengan demikian suatu teologi adalah dikonstruksi secara sosial. Metode pemikiran Asghar bersifat normatif, kontekstual dan transendental. Implikasi Teologi Pembebasan Bagi Pendidikan Islam diantaranya; Pendidikan Islam Merupakan Praktik Pembebasan, Pengembangan kurikulum dilakukan searah dengan perkembangan faktor Non-Kurikulum, antara lain akibat perubahan ekonomi, politik, sosial, budaya, hukum dan lain-lain, termasuk faktor akademik kurikuluymnya, Asghar Ali Engineer memandang Qur’an, sebagaimana teks-teks lain, bisa diinterpretasikan dengan berbagai metode

    It would be natural if at this time, there were no more disparities in acces and participation for women in the world of education. But in reality, patriarchal values are still widely held by society and become an obstacle to gender awareness in various aspects of life. This study attempts to critically examine Asghar Ali Engineer’s thoughts on the interpretation of women offered, as a Islamic values for college students to face today’s life. In addition, the author attempts to formulate Asghar Ali Engineer’s thoughts as a perspective in understanding the issue of gender awareness in higher education. The approach used is this study uses an exploratory type that is qualitative-descriptive and has a pure research pattern. Looking at the current reality, there needs to be integration and interconnection between the problems today with the reading of several Islamic thinkers, one of which is Asghar Ali Engineer. The results obtained indicate that gender awareness in the world of higher education is better, but still needs to be optimized. The concept of gender justice put forward by Asghar Ali Engineer can be a kind of basis for improving and optimizing awareness of the importance of gender equality in the scope of students and universities

Based on these main issues, after a theoretical study of the problems that arise, the opinion of Asghar Ali Engineer regarding the provision of a living for his ex-wife is that there are several who are entitled based on the criteria.     Asghar Ali Engineer is known as a Contemporary Islamic thinker. One of his thoughts also discusses Islamic economics, including the issue of Zakat. Asghar\u27s thoughts on Zakat are based on a critique of the function of Zakat as a solution to the current poverty alleviation problem. In this research, the writer wants to describe the concept of distributive justice in Zakat. The author also wants to see how Asghar\u27s process is formulating the idea. This research includes library research, which uses a qualitative approach. This study finds that distributive justice is the basis for building Islamic economics, and al-adl, al-ihsan, and al-qist are the keywords in distributive justice as universal values. Then Asghar\u27s criticism of the problem of Zakat is related to the size of Zakat and how it is distributed. This thinking is based on his analysis of the current context, concluding that Asghar\u27s process of understanding the text engages in a dialogue between the text and reality.     This paper focuses on the contribution of Asghar Ali Engineer’s services, views and his methodology of liberation and emancipation of human beings from unreasonable shackles of religious restraints through dialogue, as the best method for liberation from all sorts of sufferings and troubles, with the references to modern Quranic exegesis and the traditions of the prophet Muhammad (PBUH). He contributed in praxis for the settlement of socio-religious and communal issues and had the vision to reduce the disputes and differences of such clashes through dialogue. He argues that the Quran condemns the superiority of one’s race and faith, and it determines to liberate people from injustice, oppression, and inequality. He concludes that the message of the Quran is, first, to liberate people from suffering, and second to build the good relations with other people of faiths. The Quran, according to Engineer, suggests that there is no compulsion in religion, he openly invites for dialogue to understand and respect each other to build communal, cultural and religious harmony and peaceful coexistence

    INDONESIA: Sebagaimana telah tercantum dalam Al-Qur'an surat An-Nisaa' ayat 3, poligami merupakan sebuah sistem perkawinan yang diperbolehkan dalam Islam. Namun sangat disayangkan poligami yang diperbolehkan dalam syariat tersbut, ternyata menimbulkan berbagai masalah, dan tidak sedikit yang berujung pada perceraian. Adapun fokus masalah dalam penelitian ini adalah bagaimana analisis putusan Pengadilan Agama Jakarta Pusat Nomor 449/Pdt.G/2018/PA.JP dalam perspektif Muhammad Syahrur dan Asghar Ali Engineer. Jenis penelitian yang digunakan oleh peneliti adalah jenis penelitian yuridis normatif. Pendekatan penelitian yang digunakan adalah pendekatan kasus (case approach) dan pendekatan konseptual (conceptual approach). Sumber data yang digunakan dalam penelitian yuridis normatif adalah data sekunder. Metode Pengolahan dengan cara pemeriksaan data, klasifikasi, verifikasi, analisis dan kesimpulan. Adapun teori yang digunakan oleh peneliti dalam penelitian ini adalah teori mengenai Poligami, Cerai Gugat, serta Pendapat Muhammad Syahrur dan Asghar Ali Engineer Mengenai Poligami. Berdasarkan hasil analisa yang telah dilakukan, Penulis memperoleh kesimpulan bahwa poligami dapat menimbulkan banyak masalah disebabkan oleh interpretasi yang salah terhadap ayat poligami. Muhammad Syahrur, dan Asghar Ali Engineer menyatakan bahwa konteks poligami tidak dapat dipisahkan dari konteks pemeliharaan anak yatim, bukan untuk pemuasan nafsu, maupun alasan lain yang tidak tercantum dalam Al-Qur-an. Selain itu, pemerintah juga memiliki wewenang dalam hal memperbolehkan/melarang poligami dengan mempertimbangkan kondisi yang ada dalam masyarakat. Namun, pengaturan mengenai poligami yang ada Indonesia belum lengkap dan tidak konsisten sehingga dalam memutus perkara ini, Majelis Hakim tidak terlalu mempertimbangkan poligami sebagai alasan istri pertama menggugat cerai suaminya. ENGLISH: As stated on the Quranic verse An-Nisaa' verse 3, polygamy is a marriage system permitted in Islam. But unfortunately, the polygamy permitted in the Sharia turns out to be the cause of various problems, and not a few of those lead to divorce. The focus issue of this study is how the decision of the Central Jakarta Religious Court Number 449/Pdt.G/2018/PA.JP analyzed with the contemporary ulama perspective. The type of research used by the author is normative juridical. The research approaches are case approach and conceptual approach. The data source used in normative juridical research is secondary data. The processing method is done by data examination, classification, verification, analysis, and conclusion. The theory used by the author in this study is the theory of Polygamy, Contested Divorce, and the opinions from Muhammad Syahrur, and Asghar Ali Engineer on poligamy are quoted in this regard. Based on the results of the analysis, the author concludes that polygamy can induce many problems due to incorrect interpretations of the verse on polygamy. Muhammad Syahrur and Asghar Ali Engineer stated that the context of polygamy cannot be separated from the context of maintaining orphans, not for the satisfaction of lust, as well as other reasons which are not listed in the Al-Quran. In addition, the government also has the authority to allow/forbid polygamy considering the conditions which exist in society. However, the polygamy regulation in Indonesia is incomplete and inconsistent thus the Panel of Judges do not consider polygamy as the reason for the first wives to contest a divorce

    مستخلص البحث إندونيسيا جمهورية حكومية المتعلقة بالفصل 1 الآية 3 في القانون الأساسي 1945. نناسب نظام المحكمة العظيم بالقانون رقم 12 لسنة 2011 عن صنع نظام القوانين الذى يعبّر عن نظام المحكمة العظيم هو جزء من نظام القوانين. حتى لابد أن يربط نظام المحكمة العظيم خارجيةً. ولكن نظام المحكمة العظيم رقم 3 لسنة 2017 عن المبادئ للنساء اللائي يواجهن قانونا لفريسة الطلاق من الداخلية. وكان الغرض من هذا البحث الجامعى هي معرفة موقف نظام المحكمة العظيم في مراجعة مفهوم التشريع في إندونيسيا و معرفة وضع القانوني للائحة المحكمة العظيم رقم 3 لسنة 2017 بشأن المبادئ للنساء اللائي يواجهن قانونا لفريسة الطلاق في المحكمة وللاطلاع على آراء علي أصغر إنغينير عن لائحة نظام المحكمة العظيم رقم 3 لسنة 2017 لفريسة الطلاق بالمرأة في المحكمة الدينية. ينتمي هذا النوع من الأبحاث إلى البحث القانوني المعياري الذي يستخدم أسلوبًا مفاهيميًا. المواد الأولية المستخدمة في هذا البحث الجامعى هي رقم 3 لسنة 2017 بشأن المبادئ التوجيهية لفريسة الطلاق بالمرأة اللائي يتعاملن مع القانون. ثم تحليلها باستخدام مفاهيم من الخبراء القانونيين. والنتائج من هذا البحث الجامعى هي أنّ نظام المحكمة العظيم هو جqزء من نظام القوانين ويؤسس هذا الحال إلى المحكمة العظيم الذى يملك ملك البعثة في صنع نظام القوانين، وقد إعتلق في القانون رقم 12 لسنة 2011 عن صنع نظام القوانين. ولكن لا يرنبط المحكمة العظيم إلا الحاكم أو جزء داخلي. حتى بهذا الحال كاتب نظام المحكمة العظيم لم يكن على حد أعلى في إعطاء التعديل لفريسة الطلاق بالمرءة في المحكمة الدينية. ونافع نظام المحكمة العظيم ماهيةً ومناسب بآراء علي أصغر إنغينير عن معادلة الجنس. ABSTRACT Indonesia is a Law State, written in Article 1 Section (3) 1945 Constitution of Republic of Indonesia. Supreme Court Law, according to the Law Number 12 of 2011 concerning The Establishment of Law stated that Supreme Court Law is a part of statutory law. So that, Supreme Court Law should be external binding. However, Supreme Court Number 3 of 2017 concerning guidelines to carry out the court for woman who are dealing the law only binds internally. The objective of this research were to find out the concept of the legal positions of Supreme Court Law in reviewing the concept of law in Indonesia. Then, to find out legal status of Supreme Court Law Number 3 of 2017 concerning guidelines to carry out the court for women who are dealing the law for women victims of divorce in trial. Last to find out the idea of Asghar Ali Engineer against Supreme Court Law Number 3 of 2017 about divorce’s victim in the Religious Court. This study use the normative research with conceptual approach. The primary material used in this research is Supreme Court Law Number 3 of 2017 concerning guidelines to carry out the court for woman who are dealing the law. Then analyzed using concept from the jurist. In this study it were found that Supreme Court Law is a part of statutory law, this is based on The Supreme Court having the authority of the delegation to make legislation and has been written in Law Number 12 of 2011 concerning the Establishment of Law but Supreme Court Law only binds internally (Judge). Therefore, according to the author Supreme Court Law is not maximal in providing justice to the women victims of divorce in Religious Court. However, substantially Supreme Court Law is very usefull. That is in accordance with the idea of Asghar Ali Engginer on Gender Equality. ABSTRAK Negara Indonesia merupakan Negara Hukum yang tercantum di dalam pasal 1 ayat (3) UUD 1945. Peraturan Mahkamah Agung, sesuai dengan Undang-Undang Nomor 12 Tahun 2011 tentang Pembentukan Perundang-undangan menyatakan bahwa Peraturan Mahkamah Agung merupakan bagian dari peraturan perundang-undangan. sehingga Perma seharusnya mengikat eksternal. Akan tetapi Perma Nomor 3 Tahun 2017 tentang pedoman mengadili perempuan yang berhadapan dengan hukum hanya mengikat internal. Tujuan penelitian ini adalah untuk mengetahui konsep kedudukan peraturan Mahkamah Agung dalam tinjauan konsep perundang-undangan di Indonesia, untuk mengetahui kedudukan Hukum Peraturan Mahkamah Agung Nomor 3 Tahun 2017 tentang Pedoman mengadili perempuan yang berhadapan dengan hukum bagi perempuan korban perceraian di pengadilan derta untuk mengetahui pandangan Asghar Ali Engineer terhadap peraturan Mahkamah Agung Nomor 3 Tahun 2017 korban perceraian di Pengadilan Agama. Jenis penelitian ini tergolong dalam penelitian hukum normatif yang menggunakan pendekatan konseptual. Bahan primer yang digunakan dalam penelitian ini adalah Perma Nomor 3 Tahun 2017 tentang Pedoman Mengadili Perempuan yang berhadapan dengan hukum. Kemudian dianalisa menggunakan konsep-konsep dari para ahli hukum. Adapun hasil penelitian ini adalah Perma ini merupakan bagian dari peraturan Perundang-undangan, hal ini berdasarkan pada Mahkamah Agung memiliki kewenangan delegasi untuk membuat peraturan perundang-undangan dan telah termuat di dalam UU Nomor 12 Tahun 2011 tentang Pembentukan peraturan perundang-undangan. akan tetapi Perma tersebut hanya mengikat internal (Hakim). Sehingga hal ini penurut penulis Perma tersebut tidak maksimal dalam memberikan keadilan bagi perempuan korban perceraian di Pengadilan agama. Akan tetapi secara substansi Perma ini sangat bermanfaat. Yakni sangat sesuai dengan pemikiran Asghar Ali Engginer tentang Kesetaraan Gender

    The scope of activities of international organizations, including the United Nations and its organs, has undergone significant changes in recent years. Among these, the activities of the Security Council have seen remarkable qualitative and quantitative expansion. One aspect of this development is the increased likelihood of illegal or extralegal actions being taken, causing harm to other subjects of international law. For instance, while the Council’s involvement in peacebuilding and peacekeeping operations has significantly contributed to maintaining international peace and security, it has also resulted in some violations of international rules during implementation. The undertaking of illegal and extralegal activities opens another window in the field of international law, namely international responsibility. The issue of the responsibility of international organizations in general, and the Security Council in particular, is important in the discussion of the rule of law governing this Council and should be considered as a practical outcome
