    La présente recherche aura essentiellement pour objectif de comparer les différentes formes du testament adoptées par le Droit Civil Français, avec celles adoptées au Liban, en Égypte et en Jordanie.L'étude des formes du testament dans ces trois pays permet de comprendre toutes les formes du testament adoptées dans les Pays Arabes.En premier lieu, on remarque que la « Loi des Successions et des Testaments de 1959 pour les communautés chrétiennes » au Liban forme une « copie » du Droit Civil Français en matière des formes du testament avec certaines petites nuances à clarifier.Alors que les communautés musulmanes « Sunnite » et « Chi'ite » au Liban ont soumis leur question du testament aux dispositions du Droit Musulman, et tous les conflits en la matière seront soumis aux tribunaux religieux libanais. Par contre, la communauté musulmane « Druze » a adopté en matière des formes du testament les dispositions de la « Loi de 1948 » qui forme un mixte entre le Droit Musulman et le Droit Civil.L'Égypte qui a une vocation d'être un État Civil, car il soumet toutes les questions concernant leurs testaments aux tribunaux civils ; a adopté les dispositions de la « Loi de 1946 » qui s'étaient largement inspirées du Droit Musulman. Alors que la Jordanie reste toujours un État à vocation islamique, vu que sa « Loi n. 36 de 2010 » s'était totalement basée sur des sources doctrinales de « Al Chari'a » islamique.The main objective of this research will be to compare the various will forms adopted by French Civil Law with those adopted in Lebanon, Egypt and Jordan. The study of the will forms in its three countries allows us to understand all the adopted will forms in the Arab countries. In the first place, we notice that the «Law of Succession and Wills of 1959 for the Christian communities» in Lebanon forms a «copy» of the French Civil Law in matters of will forms with some nuances to be clarified.While the «Sunnite» and «Shi'ite» communities in Lebanon have submitted their will question to the previous of Muslim Law. All conflicts in this matter will be submitted to the Lebanese religious courts. On the other hand, the Muslim community «Druze» has adopted the previous of the «Law of 1948», which forms a hybrid between Muslim Law and Civil Law.Egypt that has a vocation to be a Civil State; because it submits all questions concerning their wills to the civil courts; has adopted the previous of the «Law of 1946» which were largely inspired by Muslim Law.     Les institutions de l'Union européenne et du Conseil de l'Europe poursuivent deux objectifs a priori inconciliables : la valorisation des traditions juridiques nationales d'une part et la sauvegarde et le développement des droits et libertés d'autre part. Or, l'équilibre entre ces deux finalités est délicat. Bien qu'elles ne soient pas clairement définies, les traditions juridiques nationales feraient l'objet d'une attention particulière à l'échelle régionale. En effet, l'inscription du respect aux articles 67 et 82 du Traité de Lisbonne et son acception en droit européen des droits de l'Homme laissent présager une influence importante des normes et institutions séculaires sur l'élaboration et la mise en œuvre des droits européens. Animées par le souci de protéger les traditions, les institutions supranationales contribuent à leur préservation et à leur diffusion. Cependant, cette affirmation est insuffisante à garantir l'immutabilité des spécificités juridiques enracinées en droit interne. Le respect porte en lui-même le tempérament inhérent au développement des droits européens et de l'union sans cesse plus étroite entre les États contractants. Les héritages juridiques nationaux doivent alors se combiner et le cas échéant s'effacer devant les objectifs supranationaux. Malgré la valorisation affichée, les deux Europes participent à la réduction de la diversité des traditions juridiques nationales.The institutions of the European Union and the Council of Europe follow two objectives a priori irreconcilable : the valorisation of the national legal traditions on the one hand and the safeguard and development of rights and freedoms on the other hand. But the balance between these two purposes is delicate. Even though they are not clearly defined, the national legal traditions would be the subject of a special attention at a regional scale. Indeed, the inscription of the respect in the articles 67 and 82 of the Lisbon Treaty and its meaning in European human rights law foreshadows an important influence of the standards and old-age institutions on the development and implementation of the European rights. Driven by the aim of protecting the traditions, the supranational institutions contribute to their preservation and dissemination. However, this assertion is not sufficient to ensure the immutability of the legal specificities rooted in national law. The respect carries in itself the inherent temperament to the development of the European rights and the ever closer union between the contracting States. Thus, the national legal legacies have to be combined and, if need be, yield to the supranational objectives. Se analiza la implementación de la justicia restaurativa, pilar central de la misión de la JEP, que busca restaurar el tejido social dañado por las graves violaciones a los derechos humanos en Colombia.     The collectivization of remedies in consumer law : domestic and international aspects

    Amorcé en réponse aux manquements de grande ampleur menaçant constamment les consommateurs, le phénomène de collectivisation des recours se caractérise par une mutation dans le traitement des litiges de masse. Aussi, d’une conception judiciaire et éminemment individuelle, le droit processuel a progressivement évolué vers une conception assurant une meilleure prise en compte des spécificités de ces litiges tout en réservant une place à la négociation. Les réformes initiées par la loi du 17 mars 2014 avaient pour ambition de stimuler le phénomène de collectivisation lequel semblait presque à l’arrêt. Toutefois, les mécanismes qui en sont issus, notamment l’action de groupe, restent largement décevants. Ainsi, à la veille d’un nouvel élan, d’origine européenne cette fois, dans la collectivisation des recours consuméristes, cette étude vise non seulement à expliquer les termes de cette déception, mais aussi à proposer des moyens à mettre en œuvre en vue d’y remédier. Dans cette perspective, une fois le sens de ce phénomène précisé, notamment à travers la systématisation de ses finalités essentielles, de nombreuses améliorations semblent devoir être apportées à ses mécanismes. Au plan interne d’abord, il faut en premier lieu déverrouiller tant le domaine que les conditions d’exercice des recours collectifs, notamment l’information délivrée au public. À cette fin, le recours au numérique constitue un levier important. En second lieu, ce sont les propriétés dissuasives de l’action de groupe en cessation et/ou réparation qui méritent d’être renforcées. Outre la consolidation de l’impératif de confiscation des profits illicites moyennant une ouverture mesurée sur le système de l’opt-out, la possibilité de sanctionner les fautes lucratives doit être reconnue. En troisième et dernier lieu, un cadre juridique plus approprié, conciliant attractivité et équité de la médiation collective, mérite d’être mis en place. Au plan international ensuite, des règles permettant la concentration du contentieux collectif international devant un for unique et l’application d’une seule loi au fond méritent l’attention. De même, il convient de faciliter la circulation des décisions issues des recours collectifs.Initiated in response to the large-scale breaches that constantly threaten consumers, the phenomenon of collectivization of remedies is characterized by a change in the way mass disputes are handled. Thus, from a judicial and eminently individual conception, procedural law has gradually evolved towards a conception ensuring a better consideration of the specificities of these disputes while reserving a place for negotiation. The reforms initiated by the law of March 17, 2014, had the ambition to stimulate the phenomenon of collectivization which seemed almost at a standstill. However, the mechanisms that have emerged, notably the group action, remain largely disappointing. Thus, on the eve of a new European impetus in the collectivization of consumer remedies, this study aims not only to explain the terms of this disappointment, but also to propose the means to be implemented to remedy it. In this perspective, once the meaning of this phenomenon has been clarified, through the systematization of its main purposes, many improvements seem to be necessary to its mechanisms. At the domestic level, it is first necessary to unlock both the field and the conditions required for the exercise of the collective redress, particularly the information provided to the public. To this end, the use of digital technology seems to be a valuable tool. Second, the deterrent properties of the group action for injunction and/or compensation should be reinforced. In addition to consolidating the imperative of confiscating illicit profits by means of a measured opening to the opt-out system, the possibility of sanctioning lucrative misconduct must be recognized. Third and lastly, a more appropriate legal framework, reconciling attractiveness and fairness of collective mediation, should be put in place. At the international level, rules allowing the concentration of collective litigation before a single forum and the application of a single law on the merits deserve attention. Similarly, the circulation of decisions resulting from collective redress should be facilitated

    Le non-exercice des droits subjectifs est un phénomène courant auquel tout justiciable est un jour confronté. Il s'agit du titulaire d'une option qui ne sait pas quel parti prendre et se prononce trop tard, de celui qui subit une atteinte à l'un de ses droits mais ne sait pas comment le défendre, de celui qui est bénéficiaire potentiel, sans le savoir, d'une prestation sociale qu'il oublie de réclamer. L'époque est loin du petit commerce de village dont le propriétaire ménage certains clients connus de longue date qui, ayant promis de le payer une prochaine fois, n'ont jamais tenu leur parole, et auxquels il ne viendra pas réclamer son dû. L'inaction est aujourd'hui massive puisque le droit est complexe et les prérogatives individuelles multiples. Derrière elle se nichent une multitude de comportements, de la passivité consciente à la résignation, de l'oisiveté à la vulnérabilité. Pour les comprendre, ce travail propose de dévoiler le panel d'attitudes envisageables en les catégorisant selon des ensembles cohérents, tel le rassemblement ordonné des pièces d'un puzzle forme une image. Cette limpidité trouvée, le constat est fait que chaque type de non-exercice mérite une réponse adaptée. Le traitement juridique du non-exercice s'effectue donc en considération du comportement initial, le vulnérable est incité à agir, quiconque subissait une influence extérieure et ne pouvait agir est assisté pour le faire, celui qui profitait de l'inaction pour nuire à autrui est sanctionné. Mais l'éventail de comportements étant large, le panel de sanctions est logiquement complet. L'étude du non-exercice des droits subjectifs est ainsi l'occasion d'aborder l'état d'esprit du justiciable et de revisiter diverses notions, comme la prescription, la renonciation, eu égard à une thématique capitale et pourtant très peu étayée.Non-exercisise of subjective rights is an old theme, which is common to relationships between people. With the evolution of laws, the time of the baker of a village who doesn't ask to a client to pay bread because he is poor is now far away. With social aids, rights of personality, options, everyone can become passive one day. Behind a passive person is hidden someone vulnerable, lazy, malicious. As a mirror-effect, the legal answer is adaptated to the behaviour of the passive person, from an incentive mesure to sanctions.     Advertising freedom of expression : critical reflections

    L’instauration d’une véritable alliance entre les droits fondamentaux et le marché par l’extension de l’article 10§1 de la CEDH au discours publicitaire pourrait menacer la majesté de l’instrument conventionnel. Dépassant l’étonnement et les critiques suscités par la fondamentalisation de la publicité commerciale, notre étude s’est penchée sur le poids réel que pourrait avoir la liberté d’expression dans un domaine aussi complexe que celui de la publicité commerciale. L’enjeu a donc consisté à se poser la question de savoir si l’extension de l’article 10§1 de la CEDH à ce domaine s’avérait judicieuse. De l’étude des aboutissements de la fondamentalisation du discours publicitaire sur le terrain de la liberté d’expression publicitaire de l’émetteur ressort un constat préoccupant. La complexité du domaine de la publicité commerciale et son utilité relative pour le bon fonctionnement de la « société démocratique » affaiblissent le retentissement de la liberté d’expression et rendent finalement la liberté d’expression publicitaire « théorique et illusoire ». Les risques de marchandisation (une liberté au service du marché) et de banalisation (une liberté sans effet) de la liberté d’expression sont alors très présents. Afin de conjurer ces risques tout en conférant une pleine efficacité à cette liberté, une étude prospective menée sur le terrain de la liberté de réception publicitaire était nécessaire et elle s’est avérée fructueuse. Envisagée du point de vue de la réception, l’extension de l’article 10§1 de la CEDH semble produire des effets juridiques. De surcroît, une liberté fondamentale en devenir, la liberté, négative et positive, de réception publicitaire est en mesure de contribuer à la moralisation de la publicité commerciale.The establishment of a true alliance between fundamental rights and the market by extending Article 10§1 of the ECHR to now encompass advertising could threaten the majesty of the conventional instrument. Going beyond the astonishment and criticisms caused by the fundamentalization of commercial advertising, our study investigates the real implications that freedom of expression could have in a field as complex as commercial advertising. The issue at stake was therefore to evaluate whether the extension of article 10§1 of the ECHR to this field is to be considered a judicious decision. On the basis of studies concerned with fundamentalization of advertising speech in the field of the freedom of expression of the sender, a preoccupying conclusion emerges. Both the complexity of the field of commercial advertising and its relative usefulness for the proper functioning of "democratic society" weakens the impact of freedom of expression and ultimately makes freedom of advertising expression "theoretical and illusory". Consequently, the risks of commodification (a freedom at the service of the market) and trivialization (a freedom without effect) of freedom of expression are very likely. In order to remedy these issues meanwhile conferring full effectiveness on this freedom, a prospective study carried out in the field of the receiver's freedom of advertising reception was necessary and proved fruitful. If seen from the reception point of view, the extension of Article 10§1 of the ECHR seems to be having legal effects. Furthermore, a fundamental freedom in the making, the freedom, both negative and positive, of advertising reception is capable of contributing to the moralization of commercial advertising

    Going Beyond Counting First Authors in Author Co-citation Analysis

    The present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed

    Respect for the Charter of fundamental rights of the european Union in the european judicial area in civil and commercial matters

    En même temps que le traité de Lisbonne conférait valeur juridique contraignante à la charte des droits fondamentaux de l’Union européenne, il créait, par l’article 67, paragraphe 1, du traité sur le fonctionnement de l’Union européenne, une obligation pour l’Union et les États membres de respecter les droits fondamentaux dans la construction de l’espace de liberté de sécurité et de justice. Parce qu’il vise chacune des normes composant cet espace, ce commandement interroge particulièrement dans l’espace judiciaire européen en matière civile et commerciale où les règles de coordination des ordres juridiques nationaux sont partiellement réfractaires à l’influence des droits fondamentaux. La polysémie de la notion de respect permet d’envisager divers modes d’articulations de la charte et du droit de l’espace judiciaire européen en matière civile et commerciale. Si le principe hiérarchique paraît la modalité la plus évidente pour assurer le respect de la charte, il s’avère inapte à y parvenir, tant par lui-même que par le contexte spécifique d’application de la charte qu’impose l’espace judiciaire européen. Aussi conviendrait-il d’y substituer un mode d’articulation plus souple, la combinaison, afin de conformer la construction de l’espace sous étude à l’article 67, paragraphe 1, du traité sur le fonctionnement de l’Union européenne.When the treaty of Lisbon gave Charter of Fundamental Rights of the European Union its legally binding force, it gave rise, in article 67, paragraph 1, of the Treaty on the Functionning of the European Union, to a legal obligation to respect fundamental rights while building the Freedom, Security and Justice Area. As this legal obligation concerns all the rules of this space, it raises questions in the European Judicial Area in civil and commercial matter where rules coordinating national legal systems are partially resistant to the influence of fundamental rights. Polysemy of the notion of respect make it possible to consider different ways for the Charter and the European Judicial Area law to interact. If the hierarchical principle seems to be the most obvious way to ensure the respect of the Charter, it transpires to be inappropriate by itself and because of the specific context fort the application of the Charter commanded by the European Judicial Area. So, it would be more convenient to substitue the hierarchical principle with a more supple way of interaction, the combination, so as to conform the studied space to the article 67, paragraph 1, of the Treaty on the Functionning of the European Union
