HARMONISASI HUKUM PERDAGANGAN INTERNASIONAL: SEJARAH, LATAR BELAKANG DAN MODEL PENDEKATANNYA
AbstrakPerbedaan sistem hukum di bidang perdagangan dapat menjadi faktor penghambat bagi perdagangan internasional. Menyadari hal tersebut, masyarakat internasional dari waktu ke waktu berupaya untuk melakukan penyeragaman atau harmonisasi terhadap hukum perdagangan. Tulisan ini berupaya untuk mengkaji dan menganalisis upaya-upaya tersebut dengan memberikan k berat pada model pendekatan yang digunakan dalam mengharmoniskan hukum perdagangan lintas batas tersebut. Penelian ini menggunakan metode yuridis normaf dan semua data yang diperoleh dianalisa secara kualitaf dan diberikan penggambaran secara mendalam mengenai konsep model pendekatan harmonisasi hukum perdagangan internasional. Hasil penelian menunjukkan bahwa upaya harmonisasi hukum perdagangan internasional telah berlangsung cukup lama dalam berbagai fase, baik formal maupun informal dengan melibatkan berbagai pihak. Model pendekatan harmonisasi yang dipergunakan belakangan ini adalah dengan menggunakan perangkat so law, dan cenderung meninggalkan pendekatan hard law. Indonesia sebagai bagian dari masyarakat internasional perlu mencerma perkembangan tersebut dalam kerangka memperbarui dan sekaligus mengharmoniskan hukum perdagangan nasionalnya dengan norma hukum perdagangan yang berlaku universal.

Pembangunan Hukum Nasional dalam Perspektif Teori dan Filsafat Hukum
This paper discusses some strategic issues about national legal development, which is viewed in the light of legal theory and philosophy. The need to replace the laws of the colonial regime has been discussed for quite some time, and in fact, since Indonesia declared its independence. However, the process of replacing the Dutch laws and developing its own national law is quite slow. There are some strategies issues discussed in this writing, namely, among others: what is the legal politics/policy of the issue of legal unification and legal pluralism in Indonesia, what is the legal approach about the development of unwritten and written laws, what is the legal policy to address the issue of adat law as one of the material legal sources for the future Indonesian laws, and how jurisprudence (court decisions) may be used to develop Indonesian national legal system. With those backgrounds, the formulation of the problems is as follows: how can legal theory and philosophy be used as theoretical and philosophical argumentation to address some strategic issues of Indonesian legal development as mentioned above, and what is the legal politics/policy for the development of national legal system of Indonesia, in particular, of those strategic legal issues. The method used in this research paper is normative juridical or library research with a descriptive-qualitative analytical approach. The result of the research shows that, as of today, there are no official documents or any existing laws that comprehensively give direction to the legal politics/policy on the strategic issues of Indonesian legal development. In general, the discussion on the issues of national legal development is limited among legal experts and academicians, and the debate on contentious issues has fundamental arguments based on legal theory/philosophy. So far, legal positivism has a a significant influence on the way we respond to those strategic issues. However, there has been an interesting development recently. We can gradually see a paradigm shifting from legal positivistic to a more sociological, human and ethical approach.Tulisan ini membahas beberapa isu strategis mengenai pembangunan hukum nasional dalam perspektif teori dan filsafat hukum. Keinginan untuk menggantikan rezim hukum kolonial Belanda sudah digaungkan sejak lama, bahkan sejak awal kemerdekaan Indonesia. Namun proses untuk menggantikan hukum kolonial dengan hukum nasional tersebut berjalan sangat lamban. Ada beberapa isu strategis yang dibahas dalam tulisan ini, diantaranya: bagaimanakah politik hukum terkait unifikasi dan pluralisme hukum di Indonesia ?, bagaimana kebijakan negara terhadap hukum tertulis dan tidak tertulis ?, termasuk di dalamnya kebijakan negara terhadap pengembangan hukum adat sebagai salah satu sumber hukum bagi pembangunan hukum nasional ke depan. Rumusan masalah dari penelitian ini adalah bagaimana teori dan filsafat hukum dapat digunakan sebagai landasan teoritis dan filosofis untuk menjawab beberapa isu strategis dalam konteks pembangunan hukum nasional, dan bagaimana politik hukum pembangunan hukum nasional, khususnya terhadap beberapa isu strategis yang telah dikemukakan di atas. Metode yang digunakan dalam penelitian ini adalah metode penelitian hukum normatif atau penelitian kepustakaan dengan pendekatan analisis deskriptif kualitatif. Hasil penelitian menunjukan bahwa sampai dengan saat ini belum ada dokumen (hukum) ataupun peraturan perundang-undangan yang secara komprehensif memuat arah politik hukum pembangunan hukum nasional. Secara umum, pembahasan terkait isu pembangunan hukum nasional masih terbatas dikalangan ahli hukum dan akademisi hukum. Hasil penelitian juga menunjukan bahwa sejauh ini paham atau aliran positivisme mempunyai pengaruh yang signifikan terhadap konsep pembangunan hukum nasional yang berkembang saat ini. Namun demikian, secara perlahan terjadi perubahan paradigma dari cara berpikir yang sangat positifistis ke arah pendekatan yang lebih sosiologis, humanis dan etis
UPICC SEBAGAI MODEL BAGI PEMBARUAN HUKUM KONTRAK INDONESIA DALAM RANGKA MENGANTISIPASI BERLAKUNYA MASYARAKAT EKONOMI ASEAN TAHUN 2015
The current Indonesian contract law which is inherited from then Dutch colonial is no longger compatible with the the rapid development of international trade and business practice. Indonesia, therefore for quite long time, has made an effort to reform its contract law. However, those efforts are not successful so far. The entry into force of the ASEAN Economic Community in 2015 is a good momentum for Indonesia to revisit the idea of the reform. This research tried to find out the most possible approach for the reform. The research applied normative juridical method with futuristic approach. In conclusion, UPICC as an international instrument may well serve as model for the new Indonesian contract law. With its soft law character, UPICC may flexibly be adjusted in order not to prejudice the fundamental principles of Pancasila.</p
Going Beyond Counting First Authors in Author Co-citation Analysis
The present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation
counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings
are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that
only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into
account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed
Variations on the Author
“Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship
Appropriate Similarity Measures for Author Cocitation Analysis
We provide a number of new insights into the methodological discussion about author cocitation analysis. We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature. Legal Aspects of Moral Rights and Economic Rights in Music Creation Using AI Music Generators
The advancement of artificial intelligence (AI) technology has had a significant impact across various sectors, including the music industry. One of the latest innovations is the AI Music Generator, which is capable of automatically creating musical compositions without direct human involvement as the creator. However, this development raises various legal issues, particularly concerning moral rights and economic rights in the context of copyright protection for music works produced by AI. This study aims to analyze the legal aspects related to moral and economic rights in the creation of music generated by AI Music Generators. The study also compares copyright regulations in several countries, including Indonesia, the United States, and the European Union, to understand how international and national laws accommodate AI advancements in the music industry. The findings show that, to date, there are no specific regulations governing copyright ownership of AI-created works. This results in legal uncertainty in the distribution of moral and economic rights over AI-generated music. Therefore, legal policy reforms are needed to accommodate AI developments in the music sector while ensuring fairness for creators, AI owners, and music users
