Representações do princípio de nacionalidade na doutrina internacionalista do século XIX na construção do princípio de autodeterminação dos povos: continuidades e rupturas em um discurso liberal
Full text linkDissertação (mestrado) - Universidade Federal de Santa Catarina, Centro de Ciências Jurídicas, Programa de Pós-Graduação em Direito, Florianópolis, 2014.Na tentativa de se estabelecer uma relação entre o princípio de nacionalidade e o moderno princípio de autodeterminação dos povos, o presente trabalho parte de uma análise aprofundada do conceito principal elaborado por Pasquale Stanislao Mancini, a saber, o princípio de nacionalidade, posto pelo jurista italiano como fundamento do direito internacional. A partir desse conceito, é possível deduzir o núcleo da perspectiva manciniana, contida em sua proposta científica, a saber, a substituição do Estado pela Nação como sujeito primeiro do direito internacional. Após apontar os principais traços do pensamento manciniano, estabelece-se um diálogo entre o jurista italiano e outros autores da denominada escola italiana de direito internacional, da qual Mancini pode ser considerado o fundador e membro mais representativo. Portanto, são objeto de análise também as concepções de Terenzio Mamiani e de Pasquale Fiore e de outros autores estrangeiros que deixaram suas contribuições nesse sentido. Por fim, indaga-se quais seriam as possíveis influências dessas posições teóricas defendidas pelos diversos autores acima mencionados, a despeito das divergências existentes entre os mesmos, sobre o hodierno princípio de autodeterminação dos povos, e, para tanto, são apontadas as continuidades e rupturas entre esse e o princípio de nacionalidade.Abstract : In an attempt of establishing a relationship between the principle of nationality and the modern principle of self-determination, this text starts from a thorough analysis of the main concept developed by Pasquale Stanislao Mancini, that is, the principle of nationality, which would constitute the basis of international law, according to him. Starting from the very principle, it´s possible to infer the core of Mancini´s perspective, which is the substitution of State by Nation as the main subject of international law. After showing the main characteristics of Mancini´s thought, this work establishes a dialogue between Mancini himself and other authors of the Italian school of international law, of which Mancini can be considered the founder and the most representative member. Therefore, this work also analyzes Terenzio Mamiani and Pasquale Fiore´s conceptions, as well as other authors´ thoughts, which left their contribution in this field. At last, this work enquires about the possible influences of this theoretical positions championed by the different authors above-mentioned, despite the existing divergences among them, over the modern principle of self-determination and, for this purpose, the continuities and changes between this and the principle of nationality are highlighted
