No full textDer Band versammelt 16 Abhandlungen zur Phänomenologie und zum Deutschen Idealismus, die der führende japanische Philosoph Jiro Watanabe (1931–2008) in deutscher Sprache verfaßt und veröffentlicht hat. Nach seiner eigenen »Philosophie des Seins aus der Existenz« suchend, findet Watanabe als obersten Grundsatz der Phänomenologie, daß das Sehen des Selbst zugleich das Sehen der Welt ist und daß das Sehen der Welt das Sehen des Selbst einschließt. Um auf die von Heidegger gestellte Frage zu antworten, wie das eigentlich gewordene Selbst sich zu den Dingen und den Anderen verhalten kann, entdeckt Watanabe die von Hegel inspirierten dialektisch-dynamischen Verhältnisse der Eigentlichkeit und Uneigentlichkeit. Obwohl der Mensch seine durch ein nichtendes Nichts bestimmte Seinsstruktur nicht zu überwinden vermag, verliert er nicht sein »eigentliches Miteinandersein«. Watanabe verbindet den Ansatz der Zusammengehörigkeit des Seins und des Nichts mit der auf Schellings Schriften gründenden Hoffnung auf die göttliche Erlösung des Menschen

Direito.O Código de Defesa do Consumidor, editado pela Lei nº 8.078/90, dispõe acerca da proteção dos direitos individuais e coletivos do consumidor, incumbindo ao Estado esse de dever (art. 5º, XXXII), por meio de normas de ordem pública e interesse social. O objetivo deste trabalho é demonstrar a forma que as cláusulas abusivas incidem nos contratos de adesão, para que a parte vulnerável aja com cautela ao contratar e busque revisão dos contratos já formados. Para tanto, primeiramente, definir-se-á a relação jurídica de consumo e todas as partes e objetos contidos nesta, além de conceituar contrato de adesão. Em seguida, será apresentado o rol de cláusulas abusivas com suas respectivas definições. Por fim, serão apresentados exemplos de contratos comuns ao dia-a-dia, a forma com que as cláusulas abusivas se apresentam e o entendimento do Tribunal de Justiça de Santa Catarina, assim como o do Superior Tribunal de Justiça sobre o tema
