No full textL’attesissima decisione delle Sezioni Unite si pronuncia sull’ostico problema della sorte dei contratti a valle di un’intesa anticoncorrenziale, ai sensi degli artt. 2 l. 10.10.1990, n. 287, e 101 TFUE. Dopo aver passato in rassegna le principali tesi che si sono contese il campo, viene accolta la soluzione della nullita` parziale di tali contratti, funzionalmente collegati al modello negoziale di fideiussione proposto dall’Associazione Bancaria Italiana (ABI), dichiarato nullo nella parte in cui prevedeva delle clausole lesive del gioco della concorrenza. Il percorso argomentativo tracciato dai giudici di legittimita` impone delle riflessioni in merito alla necessaria elasticita` dell’apparato rimediale predisposto dal codice civile, e alla sofferta dia- lettica tra principio dell’autonomia privata e diritto antitrust, della cui distanza, concettuale e pratica, e` agevole essere avvertiti

No full textCon la disciplina delle unioni civili contenuta nella l. 20.5.2016, n. 76 si è preso atto dell’emergere di nuove forme di convivenza umana – more uxorio, anche tra persone dello stesso sesso – che rivendicano non solo dignità sociale ma un riconoscimento giuridico quale struttura familiare tout court. Con il presente contributo ci si propone di ragionare sull’adeguatezza dei tentativi medio tempore compiuti da dottrina e giurisprudenza di predisporre un embrionale manifesto della genitorialità sociale in generale, con particolare attenzione all’omogenitorialità, con tutte le particolarità che derivano anche, e soprattutto, dalla transnazionalità del fenomeno che pone l’evidente rischio che si vengano a determinare discriminazioni
Variations on the Author
No full text“Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship

Morphological and functional alterations in hemocytes of Mytilus galloprovincialis exposed in high-impact anthropogenic sites
No full textThe work aimed to study the induction of morphological alterations in M. galloprovincialis in the field and its
suitability to be integrated into a sensitive, simple, and cost-effective cell-based multimarker approach for the
detection of the stress status induced by pollution in coastal marine environments in view of ecotoxicological
biomonitoring and assessment application. Cellular morphometric alterations was paralleled by the analysis of
standardized biomarkers such as lysosomal membrane destabilization, and genotoxocity biomarkers such as
micronuclei and binuclated cells frequencies were investigated. The study was carried out by means of a
transplanting experiment in the field, using caged organisms from an initial population exposed in the field in
two multi-impacted coastal sites of the central Mediterranean area, Bagnoli in the eastern Tyrrhenian Sea and
Augusta-Melilli-Priolo in the western Ionian Sea. Capo Miseno (NA) for the Tyrrhenian area and Brucoli (ME) for
the Ionian area were chosen as control sites.
Hemocyte enlargement and filopodial elongation increased frequencies were observed in organisms exposed to
the impacted sites. These morphometric alterations showed strong agreement with the lysosomal membrane
destabilization and biomarkers of genotoxicity, suggesting their usefulness in detecting the pollutant-induced
stress syndrome related to genotoxic damage
