    Tetranuclear [MDy]<sub>2</sub> Compounds and Their Dinuclear [MDy] (M = Zn/Cu) Building Units: Their Assembly, Structures, and Magnetic Properties

    The reactions between a salen ligand N,N′-bis­(3-methoxysalicylidene)-1,2-cyclohexanediamine (H2L) and different metal salts lead to the formation of four 3d-4f [MDy] and [MDy]2 (M = Zn/Cu) compounds, where the [MDy]2 can be considered as resulting from the assembly of two [MDy] building blocks. Field-induced single molecule magnet (SMM) behavior was observed in [ZnDy] and [CuDy] compounds with the effective suppression of fast quantum tunneling under a dc field. Moreover, the [ZnDy]2 compound demonstrates typical SMM behavior, which may originate from the high axial anisotropy of Dy ions correlating to the change of coordination geometry and enhanced ferromagnetic interactions between Dy ions via the coupling of two [DyZn] units. The result suggests the positive effects of coupling blocking units to enhance their SMM behavior, presenting a promising strategy for constructing efficient heterometallic SMMs

    Enforcement of Open Source Software Licenses: The MDY Trio\u27s Inconvenient Compliations

    The Federal Circuit’s ruling in Jacobsen v. Katzer [535 F.3d 1373 (Fed. Cir. 2008)] finally settled the question of whether open source licenses are enforceable. Unfortunately, three recent cases from the Ninth Circuit have complicated matters. I call this trio of cases the “MDY Trio” in honor of the Ninth Circuit’s prior trio of licensing cases known as the “MAI Trio.” On the surface, the MDY Trio provides a boost for the enforceability of software licenses, but the MDY Trio also creates two significant complications for open source licenses. First, the MDY Trio’s test for distinguishing between licenses and copyright “first sales” does not fit open source licenses. Second, the MDY Trio’s method of delineating between contractual covenants and license conditions will prevent many open source licensors from obtaining injunctive relief. This complication is particularly dire because injunctive relief is the most critical remedy in enforcing open source licenses. My article proposes a modification to the MDY Trio’s test for determining whether a transaction is a license or first sale that better fits open source licenses. The article also proposes a more effective approach to distinguishing between contractual covenants and license conditions by focusing on remedies. My alternative approach capitalizes on the experience of trial courts in granting injunctive relief, serves the public policies underlying copyright and contract law, and better fits open source licenses. Given the importance of licensing as a transaction model in the information economy, other federal courts soon will be deciding whether to follow or diverge from the MDY Trio’s lead in future licensing cases

    In dieser Diplomarbeit wird der Schutz von Spielesoftware anhand des österreichischen Urheberrechts untersucht. Ausgangsfall für diese Arbeit ist der US-amerikanische Fall ?MDY vs. Blizzard?. Eingangs wird die US-amerikanische Entscheidung samt der Parteien, dem Verfahren und der technischen Grundkenntnisse des relevanten Sachverhaltes erläutert. Hinsichtlich der Frage, ob es einen urheberrechtlichen Schutz für das Gesamtwerk Computerspiel gibt, manifestierte sich im Verlauf der Arbeit zu der Erkenntnis, dass ein solcher verneint wird. Es kommt nur ein Schutz der einzelnen Teile eines Computerspieles infrage. In dieser Arbeit wird angeführt, für welche ein urheberrechtlicher Schutz möglich ist und unter welchen Voraussetzungen. Einer dieser Teile ist das Computerprogramm, dem auch ein Großteil dieser Arbeit gewidmet wird. Weiters werden die Spielidee, die Graphik und die Musik auf ihre Schutzwürdigkeit nach dem österreichischen Urheberrecht untersucht. Ebenfalls wurden die verschiedenen Rechtsdurchsetzungsmöglichkeiten, die das Urheberrechtsgesetz beinhaltet, erarbeitet. Aufgrund der Entscheidung ?MDY vs. Blizzard? sind besonders der Schutz von Computerprogrammen und der Schutz von technischen Maßnahmen von Interesse. Abschließend wird eine Analyse des Sachverhaltes ?MDY vs. Blizzard? nach österreichischem Urheberrecht durchgeführt.This diploma thesis examines the protection of computer games based on Austrian copyright. The precedent for this work is the American case of ?MDY vs. Blizzard". Regarding the question of whether copyright protection applies to the entire computer game it was concluded that such protection is not provided/available. Moreover only the copyright protection for the individual components of a computer game seems possible. This paper exhibits under which conditions these parts of an electronic game can achieve sufficient copyright protection. The majority of this paper?s research is dedicated to the protection of software. This includes the required qualifications to gain protection according to §40a UrhG and all rights guaranteed by copyright. Oriented on the facts of the precedent the special protection of technical security measures is of particular interest. Further the paper presents the requirements for the protection of the initial idea, the graphics and the music under copyright law. The various possibilities of protecting the rights, granted by copyright law, are also included in this paper.     Going Beyond Counting First Authors in Author Co-citation Analysis

    The present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed

    “Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship

    Appropriate Similarity Measures for Author Cocitation Analysis

    We provide a number of new insights into the methodological discussion about author cocitation analysis. We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature.     La investigación “El Estrés Laboral y la Calidad de Servicio de los Trabajadores del Call Center MDY – Claro, Lince 2018”, tiene como objetivo determinar la relación entre el estrés laboral y la calidad de servicio. Las teorías utilizadas en este trabajo fueron Origen De La Calidad De Servicio, Seto (2004) y Fidelización de los Clientes, Cuevas (2004). El diseño usado fue no experimental de corte transversal, el tipo de investigación fue aplicada, nivel descriptivo – correlacional, de enfoque cuantitativo, la población fue de 40 asesores administrativos y la muestra fue censal, el instrumento fue un cuestionario tipo Likert con 19 preguntas. Finalmente, la conclusión de la tesis fue que: el estrés laboral no tiene relación con la calidad de servicio de los trabajadores del Call Center MDY
