    The European Convention on Human Rights and Its Impact on National Private Law: An Introduction

    Over the last two decades, the European Convention on Human Rights (ECHR) has come to play a major role in a large number of private law issues. The aim of this book is to provide a broader view of the impact of the ECHR on national private law. To that end, it begins with a comparative analysis of the interaction between the ECHR and Contracting States’ domestic laws. The chapters forming the main part of the book explore, also from a comparative perspective, the influence of the ECHR on a wide range of fields of private law, including family law, data protection law, media law, copyright law, labour law as well as private international law and procedural law. The analysis of cases reveals many common features, but likewise some inconsistencies, in the decisions of the European Court of Human Rights (ECtHR). The final part of the book focuses on a number of overarching issues, in particular the role of comparative law in the reasoning of the ECtHR and the contribution of the ECHR to European harmonisation of private law. What becomes apparent from the various contributions is that the ECHR and the case-law of the ECtHR are becoming important elements of a common European private law

    Adaptive iterative thresholding algorithms for magnetoencephalography

    We provide fast and accurate adaptive algorithms for the spatial resolution of current densities in MEG. We assume that vector components of the current densities possess a sparse expansion with respect to preassigned wavelets. Additionally, different components may also exhibit common sparsity patterns. We model MEG as all inverse problem with joint sparsity constraints, promoting the coupling of non-vanishing components. We show how to compute solutions of the MEG linear inverse problem by iterative thresholded Landweber schemes. The resulting adaptive scheme is fast, robust, and significantly Outperforms the classical Tikhonov regularization in resolving sparse current densities. Numerical examples are included

    Visible spectroscopic and photometric survey of Jupiter Trojans: Final results on dynamical families

    We present the results of a visible spectroscopic and photometric survey of Jupiter Trojans belonging to different dynamical families. The survey was carried out at the 3.5 m New Technology Telescope (NTT) of the European Southern Observatory (La Silla, Chile) in April 2003, May 2004 and January 2005. We obtained data on 47 objects, 23 belonging to the L5 swarm and 24 to the L4 one. These data together with those already published by Fornasier et al. [Fornasier, S., Dotto, E., Marzari, F., Barucci, M.A., Boehnhardt, H., Hainaut, O., de Bergh, C., 2004a. Icarus 172, 221 232] and Dotto et al. [Dotto, E., Fornasier, S., Barucci, M.A., Licandro, J., Boehnhardt, H., Hainaut, O., Marzari, F., de Bergh, C., De Luise, F., 2006. Icarus 183, 420 434], acquired since November 2002, constitute a total sample of visible spectra for 80 objects. The survey allows us to investigate six families (Aneas, Anchises, Misenus, Phereclos, Sarpedon, Panthoos) in the L5 cloud and four L4 families (Eurybates, Menelaus, 1986 WD and 1986 TS6). The sample that we measured is dominated by D-type asteroids, with the exception of the Eurybates family in the L4 swarm, where there is a dominance of C- and P-type asteroids. All the spectra that we obtained are featureless with the exception of some Eurybates members, where a drop-off of the reflectance is detected shortward of 5200 Å. Similar features are seen in main belt C-type asteroids and commonly attributed to the intervalence charge transfer transition in oxidized iron. Our sample comprises fainter and smaller Trojans as compared to the literature's data and allows us to investigate the properties of objects with estimated diameter smaller than 40 50 km. The analysis of the spectral slopes and colors versus the estimated diameters shows that the blue and red objects have indistinguishable size distribution, so any relationship between size and spectral slopes has been found. To fully investigate the Trojans population, we include in our analysis 62 spectra of Trojans available in literature, resulting in a total sample of 142 objects. Although the mean spectral behavior of L4 and L5 Trojans is indistinguishable within the uncertainties, we find that the L4 population is more heterogeneous and that it has a higher abundance of bluish objects as compared to the L5 swarm. Finally, we perform a statistical investigation of the Trojans's spectra property distributions as a function of their orbital and physical parameters, and in comparison with other classes of minor bodies in the outer Solar System. Trojans at lower inclination appear significantly bluer than those at higher inclination, but this effect is strongly driven by the Eurybates family. The mean colors of the Trojans are similar to those of short period comets and neutral Centaurs, but their color distributions are different

    This paper investigates some core aspects of Guy de La Brosse’s (1586-1641) botanical work. In the first section, the focus is on the epistemological principles of La Brosse’s botany by analyzing the first and second book of the treatise De la nature, vertu et utilité des plantes (1628). In the second section, the author discusses the role of Paracelsus’s chemistry in La Brosse’s work, with a particular attention to the third book of the De la nature. The final section deals with La Brosse’s interest in the visualization of plants. Here, the author provides the transcription and first Italian translation of a short manuscript related to Abraham Bosse’s engravings for La Brosse’s unfinished book Icones posthumae

    Spatially Inhomogeneous Evolutionary Games

    We introduce and study a mean-field model for a system of spatially distributed players interacting through an evolutionary game driven by a replicator dynamics. Strategies evolve by a replicator dynamics influenced by the position and the interaction between different players and return a feedback on the velocity field guiding their motion. One of the main novelties of our approach concerns the description of the whole system, which can be represent-dimensional state space (pairs (x, σ) of position and distribution of strategies). We provide a Lagrangian and a Eulerian description of the evolution, and we prove their equivalence, together with existence, uniqueness, and stability of the solution. As a byproduct of the stability result, we also obtain convergence of the finite agents model to our mean-field formulation, when the number N of the players goes to infinity, and the initial discrete distribution of positions and strategies converge. To this aim we develop some basic functional analytic tools to deal with interaction dynamics and continuity equations in Banach spaces that could be of independent interest. © 2021 The Authors.     Spectroscopic comparison of aqueous altered asteroids with CM2 carbonaceous chondrite meteorites

    In the last year we have started a spectroscopic investigation of asteroids located in the region of the main-belt between about 2.2 and 3.6 AU. The aim of this work is to study the aqueous alteration process which acted in that zone, dominated by low albedo C-type asteroids, and to compare the spectra of these hydrous objects with those of CM2 carbonaceous chondrite meteorites. In fact, the spectra of these meteorites reveal features probably due to aqueous altered materials on their surfaces. The study of the aqueous alteration process can give important information on the chemical and thermal evolution of the earliest Solar System. More that 65% of the investigated objects have revealed features suggesting the presence of hydrous materials. The comparison of the spectra of the hydrated asteroids obtained to date with those of several CM2 carbonaceous chondrite meteorites seems to indicate that aqueous altered asteroids could be the parents of CM2 meteorites. The data have been obtained during several observational runs at the Asiago Observatory with the 1.8 m telescope and at ESO-LaSilla with the 1.5 m telescope.     A performance Measurement System for Facility Management: the Case Study of a Medical Service Authority

    Purpose – This study sets out to introduce an innovative performance measurement system (PMS) for business process outsourcing in facility management (FM) industry and analyse, comprehend and explain the main criticalities in the relationship among the actors involved in an outsourcing non core services contract, which is typical of the FM business sector. The aim of the tool is to improve performances and enhance their integration towards a partnership. Design/methodology/approach – A case study research has been carried out on a medical service authority and on its FM service provider in order to investigate, understand and explain the main criticalities in their relationships. Starting from a literature analysis on empirical applications of PMS, an adaptation of a balanced scorecard (BSC) has been realized to exceed the criticalities of the case study and to propose a PMS for facility management. Findings – As highlighted in the case study, the need for an improved actors’ partnership has been fulfilled through an innovative approach, i.e. a performance measurement system which shares some indicators among FM service provider and customer. Research limitations/implications – The limitation of this research lies in the fact that PMS has been designed from a single case study. Despite this fact, the PMS can be easily adapted for wide applications inside the FM business sector. Practical implications – The PMS allows a better integration and coordination of the actors involved in an outsourcing services contract. It could be implemented in FM software tools. Originality/value – The proposed performance measurement system is an innovative integration between the balanced scorecard and service balanced scorecard (SBC) for the facility management service industry.
