Subjective human rights of children are reasonably fathomed cooperatively by practice, activism and research. Kinderarbeit auf Kosten der Kindheit – oder: Wege zu anderer Kindheit?
Wenn Kinder ein „Recht zu arbeiten“ für sich beanspruchen, wie es seitens einiger Organisationen von arbeitenden Kindern in Afrika, Asien und Lateinamerika seit Jahren geschieht (vgl. Liebel 2001, S. 33ff.), ruft dies meist Verwunderung und Kopfschütteln hervor. Spätestens seit im Europa des 19. Jahrhunderts Regulative und Gesetze erlassen wurden, in denen die Erwerbsarbeit von Kindern verboten wurde, gehört es zum Grundverständnis westlichen Denkens, dass es das Beste für Kinder sei, nicht zu arbeiten und sich stattdessen der Schule zu widmen.Allerdings gab es auch in Europa immer wieder andere Stimmen. So erschien unter dem provozierenden Titel „Kinderarbeit ist gut“ vor nunmehr 23 Jahren ein Buch zweier norwegischer Pädagogen (Linge/Wille 1984), die das umstrittene Thema von einer ungewohnten Seite angehen. Sie zeigen an konkreten Beispielen, dass die Arbeit von Kindern auch gute Seiten haben und das Leben und Lernen von Kindern bereichern kann. Mit Blick auf ihr Land und die „lebensfernen“ Schulen und Kindergärten, in denen die beiden sich jahrelang abgemüht hatten, forderten sie: „Führt Kinderarbeit wieder ein!“Im folgenden Beitrag gehe ich einigen Kontroversen über die Auswirkungen der Kinderarbeit auf Kinder nach und diskutiere verschiedene Handlungsansätze, die darauf abzielen, die Situation arbeitender Kinder zu verbessern. Mit Blick auf die Forderung Kindern ein Recht zu arbeiten einzuräumen, setze ich mich mit der Befürchtung auseinander, die Kinder würden schutzlos ausbeuterischen Praktiken ausgeliefert und skizziere schließlich einige Gedanken über sich abzeichnende neue Praxisformen von Kindheit und mögliche Konsequenzen für pädagogisches Handeln in der Schule.„Wer wie wir heute in der fatalen Situation steht, infolge des bedingten Zweifel[s] bereits an der Möglichkeit der Wahrheit, die auch wieder geradezu die Voraussetzung unseres gewohnten verständigen/ verstandesgemäßen Gebrauchs der Wörter und Begriffe ist, nach Mitteln zu fahnden, um die Grenzen des Verstandes Überschreiten zu können, greift nach jedem Strohhalm. Child Work and Child Labour in Italy: The Point of View of the Children
Not much attention was dedicated to the problem of child labour in Italy until the Nineties, probably because child labour was a marginal phenomenon and had almost disappeared following promulgation in 1967 of a law that prohibited any type of work until school leaving age had been reached ( or until fourteen years of age) and the introduction of sanctions to protect children’s rights to health and education.
Since the end of the Nineties attention to the subject has progressively grown and, partially through studies and research projects, greater understanding of the problem has been promoted – but the extreme difficulty of investigating the phenomenon has also emerged quite markedly, along with the general confusion about the subject and the fragmentary results of research.
As a demonstration of this, it should suffice to analyse the estimates made by scholars, research institutes, institutions and labour unions in recent years, which differ from each other by hundreds of thousands of units, with oscillations between 50 thousand and 500 thousand working minors. Although there is still open debate on child work today in Italy, it is possible to outline some recurrent characteristics that contribute to defining the phenomenon in Italy from the various research projects that have been conducted, especially those conducted in specific territorial contexts that are of a qualitative nature, as well as the only investigation conducted on the national level on a representative sample of the population, commissioned by the Ministry of Labour and Social Policy from ISTAT (Italian National Statistical Institute), which was published in 2002.
Not all research projects took into consideration the point of view of children in the objectives pursued but almost two research projects take children’s point of view into consideration, from which some useful information may be gleaned: the ISTAT research, and a qualitative research performed by the author (Tagliaventi M.T., Lavoro minorile e percorsi formativi in una società industriale avanzata, Morlacchi editore, Perugia, 2002).
These researches, albeit with all due caution in dealing with a problem-fraught phenomenon such as child work, underline that what children think of their work differs a great deal from what many adults think, who are responsible for their education, especially educators, teachers, pedagogues and the parents of minors who do not work, who generally demand that minors under fifteen years of age be removed from actual working situations. But if adults do not consider or ask themselves why working activities not only are requested by children but also judged as quite positive experiences, they will not be able to look at premature work in the right way or to provide alternatives to these satisfying activities. All of this obviously forces to reconsider the conceptual paradigms on childhood and calls upon all the agencies concerning the socialization of children
Love in the First Degree: Manfred, Byron, and Incest

The final version is freely available from the University of Colorado via the link in this recordNote that the text of the manuscript varies considerably from the final published versionThis essay suggests that Byron’s Manfred contains not an expression of Byron’s guilt about his incest with his half-sister Augusta Leigh, as previous critics have suggested, but rather considerable evidence of his lack of guilt. It argues that the play displays incest and torment, but in fact does not link the two, instead displaying Manfred’s love for Astarte as deeply felt without regrets. The essay then argues that one finds the same combination of deep love and lack of regret in Byron’s remarks about his relationship with his half-sister, as well as in the representations of incest in his other works. It suggests that this acceptance of incest links to Byron’s commitment to rational thinking and personal freedom, and it invites future criticism to explore this connection in more detail
