PEMBATALAN AKTA JUAL BELI HAK ATAS TANAH KARENA SALAH SATU PIHAK MELAKUKAN WANPRESTASI
Full text linkWanprestasi adalah suatu pelanggaran terhadap kewajiban yang diatur
dalam perjanjian, yang dapat meliputi ketidakpenuhan kewajiban pembayaran,
penyerahan barang, atau hal lain yang telah disepakati. Wanprestasi dalam
akta jual beli hak atas tanah dapat menyebabkan ketidaksetujuan antara pihakpihak
yang terlibat, yang pada akhirnya dapat mengakibatkan sengketa
hukum. Tujuan dalam penelitian ini adalah untuk menganalisis:
1). Pembatalan akta jual beli hak atas tanah karena salah satu pihak
melakukan wanprestasi. 2). Perlindungan hukum terhadap pihak yang
dirugikan akibat pembatalan akta jual beli hak atas tanah karena salah satu
pihak melakukan wanprestasi.
Jenis penelitian ini termasuk lingkup penelitian hukum normatif. Metode
pendekatan dalam penelitian ini adalah pendekatan perundang-undangan
(statue approach). Jenis dan sumber data dalam penelitian ini adalah data
sekunder. yang diperoleh studi pustaka. Analisis dalam penelitian ini bersifat
deskriptif analitis.
Hasil penelitian disimpulkan: 1). Pembatalan jual beli hak atas tanah karena
salah satu pihak melakukan wanprestasi yaitu pihak yang merasa dirugikan berhak
menggugat ke Pengadilan untuk menuntut ganti rugi, berupa penggantian biaya,
kerugian dan bunga. Wanprestasi menyebabkan kepastian hukum terganggu
karena pihak lain menjadi tidak pasti mengenai hak dan kewajibannya. Mengatasi
problematika hukum dalam jual beli hak atas tanah akibat wanprestasi
memerlukan pendekatan yang komprehensif, yang mencakup kepastian hukum,
keadilan, dan kegunaan. Dengan memastikan perjanjian yang jelas, penegakan
hukum yang konsisten, sanksi yang adil, serta proses penyelesaian sengketa yang
efisien, sistem hukum dapat memberikan perlindungan yang memadai bagi pihak
yang dirugikan dan mencegah terjadinya wanprestasi di masa depan. 2)
Perlindungan hukum terhadap pihak yang dirugikan akibat pembatalan akta jual
beli hak atas tanah karena salah satu pihak melakukan wanprestasi yaitu harus
mencakup langkah-langkah preventif dan repressif. Dengan langkah preventif,
seperti pembuatan akta yang jelas dan pemeriksaan legalitas tanah, serta langkah
repressif, seperti gugatan ke pengadilan dan penegakan sanksi, sistem hukum
dapat memberikan perlindungan yang menyeluruh dan efektif bagi pihak yang
dirugikan. Pendekatan ini memastikan bahwa hukum tidak hanya berfungsi
sebagai alat penyelesaian sengketa tetapi juga sebagai mekanisme pencegahan
yang menjaga keadilan dan kepastian hukum dalam transaksi jual beli tanah.
Namun perlindungan hukum tidak berlaku untuk semua pembeli melainkan hanya
berlaku untuk kriteria pembeli tertentu. Kriteria pembeli yang dilindungi ialah
yang memiliki itikad baik.

No full textThis study aims to analyze: 1) Legal problems of land rights sale and purchase because one party is in default. 2). Legal protection for the injured party due to the cancellation of the land rights sale and purchase deed because one party is in default. This type of research is included in the scope of normative legal research. The approach method in this study is the statute approach. The type and source of data in this study are secondary data. obtained from literature studies. The analysis in this study is descriptive analytical. The results of the study concluded: 1). Legal problems of land rights sale and purchase because one party is in default, namely the party who feels aggrieved has the right to sue the Court to claim compensation, in the form of compensation for costs, losses and interest. Default causes legal certainty to be disturbed because the other party becomes uncertain about their rights and obligations. 2) Legal protection for the injured party due to the cancellation of the land rights sale and purchase deed because one party is in default, namely must include preventive and repressive measures. With preventive measures, such as making clear deeds and checking the legality of the land, as well as repressive measures, such as lawsuits and enforcement of sanctions, the legal system can provide comprehensive and effective protection for the injured party. This approach ensures that the law not only functions as a dispute resolution tool but also as a preventive mechanism that maintains justice and legal certainty in land sale and purchase transactions. However, legal protection does not apply to all buyers but only applies to certain buyer criteria. The criteria for buyers who are protected are those who have good intentions
Going Beyond Counting First Authors in Author Co-citation Analysis
Full text linkThe present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation
counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings
are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that
only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into
account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Kegiatan ekstrakurikuler band di SMP N 1 Sewon ditinjau dari aspek (1) pembelajaran ekstrakurikuler band, (2) Hambatan dan solusi dalam pembelajaran ekstrakurikuler band. Sebagai subyek penelitian adalah siswa kelas VIII yang memilih ekstrakurikuler band. Pada penelitian ini pengumpulan data dilakukan dengan studi kepustakaan, observasi, wawancara, dan dokumentasi dengan alat bantu handphone untuk merekam wawancara dan memutar Mp3 serta laptop untuk menayangkan Mp3. Data dianalisis dengan teknik deskriptif kualitatif, setelah itu data disajikan dan yang terakhir adalah menarik kesimpulan. Full text link“Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship
Appropriate Similarity Measures for Author Cocitation Analysis
Full text linkWe provide a number of new insights into the methodological discussion about author cocitation analysis. We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature. Our results contest some common arguments for the continued
use of first-author citation counts in the evaluation of scholars, such as high correlations between author rankings by first-author citation counts and other citation
counting methods, and high costs of using more realistic citation counting methods that are not well-supported by the ISI databases. No full textWe have done our best to complete the author checklist relating to the use of animals in the hut study. Note that the objective for the hut study was to evaluate the IRS treatment applications for residual efficacy against Anopheles mosquitoes, including the local An. coluzzii mosquito population. Cows were only used to attract mosquitoes into the huts and no tests were carried out directly on the cows. The author checklist is intended for use with studies where experiments are carried out on animals, which is why we have had such difficulty in completing this for the hut study, as many of the questions do not relate to how the cows were used
