Liberdade de expressão e Hate Speeches: as influências da jurisprudência dos valores e as consequências da ponderação de princípios no julgamento do caso Ellwanger
Este trabalho pretende analisar a prevalência tardia da Jurisprudência dos Valores e a ausência de uma teoria da decisão no Supremo Tribunal Federal, tendo como paradigma o caso do HC 82.424-2/RS. Parte-se do pressuposto de que a liberdade de expressão é direito fundamental que está intimamente ligada à consolidação da democracia constitucional. Neste sentido, os contributos de Ronald Dworkin são utilizados para demonstrar, através de paralelo com a realidade da liberdade de expressão nos Estados Unidos da América, a imprescindibilidade da livre expressão de ideias para que o indivíduo se torne agente moral responsável no regime de democracia constitucional. Contudo, de acordo com a Constituição brasileira, com a legislação e com os tratados internacionais assinados pelo Brasil, essa liberdade não protege os discursos de incitamento ao ódio. O Supremo Tribunal Federal preferiu aceitar a ideia de que a Constituição é uma ordem concreta de valores por ele ponderáveis, o que ocasionou forte discrepância nas decisões dos ministros e demonstrou que, através da ponderação de valores, há uma fragilização da democracia e da proteção dos direitos fundamentais. Este panorama revela a necessidade de se construir uma teoria da decisão judicial, capaz de impedir juízos irracionais e decisionismos judiciais
Going Beyond Counting First Authors in Author Co-citation Analysis
The present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation
counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings
are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that
only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into
account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Variations on the Author
“Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship
Appropriate Similarity Measures for Author Cocitation Analysis
We provide a number of new insights into the methodological discussion about author cocitation analysis. We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature. Inteligência Artificial como ferramenta para otimização e automação das ações coletivas: uma análise a partir dos dados do Tribunal Regional Federal da 5ª Região
The Brazilian Judiciary faces one of its greatest challenges with the high number of active legal cases, which hinders the quick resolution of conflicts and compromises the fulfillment of constitutional principles, such as access to justice, efficiency, and the reasonable duration of proceedings. Thus, this article aims to assess the impact of class actions in the Federal Regional Court of the 5th Region (TRF5) and to understand how artificial intelligence is being applied within this court. The methodology employed consists of a quantitative analysis of data obtained through the Julia System API, complemented by data processing with Python, to examine the volume and evolution of class actions over the years, helping us to understand the true situation of such demands in this court. The results indicate a significant impact of such actions on TRF5. Furthermore, by analyzing the AI initiatives being applied and developed in TRF5, we observe that they can significantly optimize the processing of these actions, reducing the system's overload and improving the speed of judicial decision-making. However, the research also identified limitations to the use of AI: the lack of adequate technological infrastructure and the shortage of qualified professionals, which pose challenges to the effective implementation of AI. Finally, the originality of this study lies in its innovative approach by combining a quantitative analysis of the impacts of class actions with the practical application of AI, offering a valuable perspective on the use of emerging technologies to improve the administration of justice in Brazil and ensure a more accessible and efficient judicial system.O Poder Judiciário Brasileiro enfrenta um dos seus maiores desafios com a elevada quantidade de processos judiciais ativos, que dificulta a resolução rápida dos conflitos e compromete o cumprimento de princípios constitucionais, como o acesso à justiça, eficiência e a duração razoável do processo. Dessa forma, o objetivo deste artigo é verificar o impacto das ações coletivas no Tribunal Regional Federal da 5ª Região (TRF5) e compreender de que forma a inteligência artificial está sendo aplicada no âmbito deste tribunal. A metodologia empregada consiste em uma análise quantitativa dos dados obtidos por meio da API do Sistema Júlia, complementada pelo processamento dos dados com Python, para examinar o volume e a evolução das ações coletivas ao longo dos anos, nos auxilia a compreender a verdadeira situação de tais demandas neste tribunal. Os resultados indicam um forte impacto de tais ações no TRF5. Ainda, ao analisarmos as iniciativas de inteligência artificial aplicadas e que estão sendo desenvolvidas no TRF5, percebemos que estas podem otimizar significativamente o processamento dessas ações, reduzindo a sobrecarga do sistema e melhorando a celeridade na tomada de decisões judiciais. No entanto, a pesquisa também identificou limitações para a utilização da IA, dentre elas: a falta de infraestrutura tecnológica adequada e a escassez de profissionais qualificados, que representam desafios à implementação eficaz da IA. Por fim, a originalidade deste estudo reside em sua abordagem inovadora ao combinar uma análise quantitativa dos impactos das ações coletivas com a aplicação prática da IA, oferecendo uma perspectiva valiosa sobre o uso de tecnologias emergentes para melhorar a administração da justiça no Brasil e garantir um sistema judiciário mais acessível e eficiente
A FRAGILIZAÇÃO DO ESTADO-NAÇÃO NA PROTEÇÃO DOS DIREITOS HUMANOS VIOLADOS PELAS TECNOLOGIAS DA INFORMAÇÃO E COMUNICAÇÃO
Este artigo resulta da necessidade de situar a proteção dos direitos humanos diante da proliferação das tecnologias de informação e comunicação (TICs) e dos fluxos globais de dados, especialmente, levando-se em conta que a desterritorialidade e a fluidez desses fenômenos desafiam os mecanismos de controle jurídico, centrados, exclusivamente no Estado-nação Tendo como marco teórico e metodológico uma corrente da sociologia canadense denominada surveillance studies, o artigo demonstrará como a violação de direitos humanos pelas TICs vai muito além da privacidade. Demonstrar-se-á, ainda, que o Estado é palco fragilizado para a proteção desses direitos, o que permite considerar a teoria sistêmica como adequadas para proteger direitos violados por corporações transnacionais ligadas à tecnologia da informação. Conclui que a proteção dos direitos humanos afetados pelas TICs não pode depender, exclusivamente, dos meios de regulação jurídica associados ao Estado, dada a sua impossibilidade de lidar com problemas que escapam à esfera da política e ao container territorial, o que torna imprescindível a participação da iniciativa privada
Dispelling the Myths Behind First-author Citation Counts
We conducted a full-scale evaluative citation analysis study of scholars in the XML research field to explore just how different from each other author rankings resulting from different citation counting methods actually are, and to demonstrate the capability of emerging data and tools on the Web in supporting more realistic citation counting methods. Our results contest some common arguments for the continued
use of first-author citation counts in the evaluation of scholars, such as high correlations between author rankings by first-author citation counts and other citation
counting methods, and high costs of using more realistic citation counting methods that are not well-supported by the ISI databases. It is argued that increasingly available digital full text research papers make it possible for citation analysis studies to go beyond what the ISI databases have directly supported and to employ more

We have done our best to complete the author checklist relating to the use of animals in the hut study. Note that the objective for the hut study was to evaluate the IRS treatment applications for residual efficacy against Anopheles mosquitoes, including the local An. coluzzii mosquito population. Cows were only used to attract mosquitoes into the huts and no tests were carried out directly on the cows. The author checklist is intended for use with studies where experiments are carried out on animals, which is why we have had such difficulty in completing this for the hut study, as many of the questions do not relate to how the cows were used
