Registration of Marriage Book Perspective of Needs Level Theory Abraham Maslow and Syatibi

The research aims to reveal the level of human need in the current era for the registration of marriage books. This research uses a document analysis approach and a literature study. Analysis of the Compilation of Islamic Law (KHI), the Marriage Law, and other related documents. This research explores the phenomenon of unregistered marriages in Indonesia, and the legal consequences caused by unregistered marriages and then analyzes the need level of the Indonesian people for the importance of registering marriage books using Abraham Maslow's and Syatibi's need level theory. This study concludes that the registration of marriage books in the analysis of Maslow's theory of needs level can include five levels of needs. Maslow's version of the five levels of needs is relevant to Syatibi's theory of needs at the level of primary needs (daruriyat). Unregistered marriages will result in a loss of civil rights, which can be life-threatening, especially for children born from unregistered marriages. Therefore, the current and future contexts have become a necessity for the obligation to fulfill the marriage book. Unregistered marriages will cause successive losses and crimes. Therefore, marriages without registration in a marriage book must be expressly annulled by the government with strict laws accompanied by sanctions. This research is expected to be a stimulant for scholars, legislators, and the government to have the confidence and courage to prevent unregistered marriages by the state

Wife\u27s Permission as a Polygamy Requirement in The Perspective of Islamic Law and Positive Law

    No full text
The four schools of Islamic jurisprudence do not consider the wife\u27s permission as a requirement for polygamy. Muslim countries around the world also do not explicitly mention the wife\u27s permission as a condition for polygamy. However, the Compilation of Islamic Law and Marriage Law in Indonesia mandates the prior permission of the wife as a requirement for polygamy. Therefore, wife’s permission as a polygamy requirement in Indonesia is a requirement that stems from the process of ijtihad by Indonesian scholars, utilizing relevant theories adjusted to the social and cultural structure of Indonesia. This research is a literature study using a normative juridical approach. It is a qualitative study analysing, explaining, elaborating, and revealing research findings. The data collection technique used is a literature review. The analysis employed is the theory of saddu al-zariah wa fathuha, which prohibits all means leading to something prohibited and necessitates all means leading to something required. This research concludes that based on the analysis of saddu al-zariah wa fathuha, the wife\u27s permission in polygamy can change its status from an administrative requirement (syurut al-kamal) to a valid requirement (syurut al-sihhah). This is because polygamy without the wife\u27s permission in Indonesia can lead to successive harms (mudarat) to the rights of the wife and children. Conversely, making the wife\u27s permission a condition for polygamy fulfils the means to achieve justice in polygamy. Making the wife\u27s permission a condition for polygamy is implementing the command to safeguard and protect the rights of the wife and children referred to as al-ahl in the Qur\u27an. This research is expected to convince the global community that the requirement of the wife\u27s permission in polygamy applied in Indonesia is in line with the social and cultural structure of Indonesia, thus the resulting ijtihad is also in accordance with the proper principles of ijtihad

Going Beyond Counting First Authors in Author Co-citation Analysis

The present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed

    Variations on the Author

“Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship

Appropriate Similarity Measures for Author Cocitation Analysis

We provide a number of new insights into the methodological discussion about author cocitation analysis. We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature. Finally, we show by means of an example that our findings have a high practical relevance.information science;Pearson correlation;cosine;similarity measure;author cocitation analysis

Dispelling the Myths Behind First-author Citation Counts

We conducted a full-scale evaluative citation analysis study of scholars in the XML research field to explore just how different from each other author rankings resulting from different citation counting methods actually are, and to demonstrate the capability of emerging data and tools on the Web in supporting more realistic citation counting methods. Our results contest some common arguments for the continued use of first-author citation counts in the evaluation of scholars, such as high correlations between author rankings by first-author citation counts and other citation counting methods, and high costs of using more realistic citation counting methods that are not well-supported by the ISI databases. It is argued that increasingly available digital full text research papers make it possible for citation analysis studies to go beyond what the ISI databases have directly supported and to employ more sophisticated methods

We have done our best to complete the author checklist relating to the use of animals in the hut study. Note that the objective for the hut study was to evaluate the IRS treatment applications for residual efficacy against Anopheles mosquitoes, including the local An. coluzzii mosquito population. Cows were only used to attract mosquitoes into the huts and no tests were carried out directly on the cows. The author checklist is intended for use with studies where experiments are carried out on animals, which is why we have had such difficulty in completing this for the hut study, as many of the questions do not relate to how the cows were used

Marriage Guardianship for Adopted Children in Akeguraci Village: A Perspective of Fiqh Munakahat

This study aims to analyze the practice of adoptive siblings acting as marriage guardians for adopted children in Akeguraci Village from the perspective of fiqh munakahat. A marriage guardian (wali) is one of the essential pillars of marriage; without a guardian, a marriage is deemed invalid, especially for individuals who have not yet reached the age of accountability (mukallaf). There are two types of marriage guardians: guardians by lineage (wali nasab) and judicial guardians (wali hakim). In Akeguraci Village, there is a case where the marriage guardian did not fulfill the essential requirements for guardianship. The guardian in this marriage was the biological son of the adoptive father. The mistake in the guardianship of the adopted child's marriage, performed by the adoptive sibling, occurred because the biological father refused to act as the guardian. This qualitative research collects field data through observation and interviews to uncover the practice of adoptive siblings acting as marriage guardians in Akeguraci Village. The findings reveal two main points: first, the practice of having the biological son of the adoptive father serve as the marriage guardian occurred because the biological father was unwilling to officiate the marriage, citing the child’s adoption at a young age as the reason. Second, from the perspective of fiqh munakahat, the marriage of an adopted child officiated by an adoptive sibling is invalid, as there is no lineage (nasab) relationship between the adopted child and the adoptive sibling.Al-Jaziri, A.
