    SCOPE OF PROTECTION FOR SCIENTIFIC WORKS – RELEVANCE OF THE DIFFERENCE BETWEEN FORM AND CONTENT

    Efekty pracy naukowej stanowią dobro wspólne. Dla nauki szkodliwe jest jednak przyzwalania na nieuczciwe przejmowanie rezultatów pracy naukowców. Szczególny charakter utworów naukowych jest źródłem pewnych problemów, które pojawiają się wówczas, gdy zachodzi konieczność ustalenia zakresu ochrony tego typu dzieł. Art. 1 ust. 21 prawa autorskiego mówi bowiem: ochroną objęty może być wyłącznie sposób wyrażenia; nie są objęte ochroną odkrycia, idee, procedury, metody i zasady działania oraz koncepcje matematyczne. Nie ulega wątpliwości, że odwołanie się do tezy o ochronie wyłącznie formy w znacznym stopniu ułatwia rozstrzygnięcie wielu sporów. Tak czytelne kryterium pozwala z łatwością ustalić, czy inne dzieło zostało stworzone z naruszeniem cudzego prawa do autorstwa, czy też jest ono samodzielnym utworem, mającym swe źródło w umyśle tego, kto podaje się za jego autora. Ponieważ kryterium formy jest sprawdzalne, gwarantuje ono obiektywność dokonywanej oceny. Ten „ślad”, którym jest forma wyrażenia, pozostawiony przez twórcę w procesie odkrywania obiektywnych prawd pozwala ocenić cały proces badawczy. Oparcie się na porównaniu formy przy badaniu zarzutu naruszenia prawa do autorstwa stanowi rodzaj ułatwienia dowodowego. Nie oznacza to jednak, iż treść dzieła powinna pozostawać poza zasięgiem ochrony. Zasługuje na nią wówczas, gdy wykazuje ona cechy indywidualnej twórczości. Stwierdzenie to odnosi się przede wszystkim do tego typu dzieł, w których nakreślenie linii granicznej pomiędzy formą a treścią albo nie jest w ogólne możliwe, albo nastręcza znacznych trudności. To właśnie w przypadku tego typu dzieł naukowych szczególnego znaczenia nabiera postulat postrzegania utworu jako pewnej harmonicznej całości. Prawo autorskie chroni połączenie formy i treści, chroni indywidualizm twórczy przybierający postać dzieła. Stwierdzenie to nie zmienia faktu, że rezultaty badań naukowych są dobrem wspólnym, z którego nie tylko mamy prawo, ale wręcz obowiązek czynić użytek.The scope of protection of scientific works from copyrights laws violation – the relevance of the division of form and content. The results of scientific work represent common goods. Nevertheless permitting fraudulent interceptions of scientific works can be harmful for science. The peculiar character of scientific works provides a myriad of problems, which occur when there is a necessity to ascertain the range to be provided for protection of this type of works. Article 1. 21 polish Copyright Law from 4 February 1994 states: “Only the manner of expression may be subject to protection. Protection shall not be afforded to inventions, ideas, procedures, methods, principles of operation, or mathematical concepts”. It goes without saying that referring to the thesis to protect solely the form of the scientific works extensively eases the settlement of many disputes. This clearly presented criterion effectively enables us to pin down if a scientific work was created breaching others’ copyrights or if it is an independent work stemming from the imagination and knowledge of the person which is claiming to be the author. The criterion of form guarantees the objectivity of the evaluation made, because it is certifiable. The unique form of expression of the author in the process of discovering the objective truth, allows us to determine the whole research process. While investigating the possible violation of the copyrights of another person the comparison of forms between different works represents for us an easier gotten proof. But that doesn´t mean that the content shouldn´t be protected either. The content deserves protection when it exhibits characteristics of individual creativity. This concept especially refers to the type of scientific works where it is difficult or almost impossible to set bounds between form and content. In this kind of cases it is of importance to perceive a scientific work as a harmonious whole. Copyright law protects the fusion between form and content and individual creativity as a scientific work. This statement doesn´t change the fact that the attainments in science are common goods and we all not only can use them but even have the obligation to do that

    Zależność pomiędzy gwarancją prawną wynagrodzenia autorskiego a innowacyjnością i kreatywnością społeczeństwa jest dzisiaj niepodważalna. Przekonanie to przyświeca od lat niemieckiemu ustawodawcy. Wyrazem tego jest seria zmian wprowadzonych w minionym czasie w Niemczech do prawa autorskiego. Ostatnia z nich weszła w życie niedawno, bo w marcu tego roku. Wprowadzone zmiany przedstawiają się w sposób następujący: § 32 d znowelizowanej ustawy o prawie autorskim wyposaża twórcę w prawo żądania udzielenia informacji oraz w prawo żądanie przedłożenia mu stosowanego sprawozdania na temat zakresu wykorzystania jego utworu oraz rozmiarów osiąganych z tego tytułu dochodów. Tym samym uprawnieniem dysponują artyści wykonawcy. Wspomniane uprawnienie przysługuje wówczas, gdy zawarta umowa miała charakter czynności odpłatnej. Bez znaczenia natomiast pozostaje charakter ustalonego umownie wynagrodzenia. Autor może żądać przekazania jedynie takich informacji, które „normalnie rzecz biorąc, niejako zwyczajowo”, mogą być udzielane w zakresie prowadzonej działalności gospodarczej. Z żądaniem tym nie może przy tym wystąpić twórca, którego wkład w stworzenie całości utworu był niewielki. Podniesienie przez twórcę omawianego roszczenia jest niemożliwe także wówczas, gdy z innych powodów jest nieuprawnione żądanie udzielenia informacji, np. jeśli przekazanie informacji twórcy narażałoby drugą stronę na niebezpieczeństwo naruszenia tajemnicy przedsiębiorstwa. Twórca może mianowicie być pozbawiony ww. uprawnienia jedynie poprzez postanowienia umów zbiorowych, a zatem umów, które nie są zawierane indywidualnie. Chodzi zatem o takie umowy, w których twórców reprezentuje organizacja zrzeszając twórców działających w określonej branży. Istotną zmianą, w stosunku do stanu sprzed nowelizacji, jest poszerzenie kręgu podmiotów zobowiązanych do udzielenia twórcy informacji o faktycznym zakresie korzystania z utworu oraz o dochodach osiąganych z tego tytułu. Jedną z przyczyn tego stanu rzeczy był fakt, że dokonane w tym trybie uzgodnienia miały charakter wyłącznie pewnych zaleceń, tzw. nie były wiążące dla partnerów zawartej w dalszym toku czynności, już indywidualnie, umowy. Nowelizacja z 20.12.2016 r. zachowuje wspomnianą metodę ustalania wynagrodzenia twórców, podejmuje jednak próbę usunięcia jej słabych stron. Przede wszystkim został znacznie skrócony czas przewidziany dla ich prowadzenia. Wprowadzono bowiem domniemanie pozwalające na przyjęcie, niejako a priori, że poszczególne związki są uprawnione do prowadzenia negocjacji w imieniu określonej grupy twórców. Domniemanie to znajduje zastosowanie wówczas, gdy wspomniany związek reprezentuje „istotną liczbę” twórców określonej kategorii dzieł z jednej strony oraz podmiotów z nich korzystających z drugiej. Pomimo wspominanego domniemania członkowie związku zachowują prawo do podjęcia w tym względzie odmiennej uchwały. Skrócony został również termin przewidziany do zakwestionowania uchwalonej propozycji wysokości wynagrodzeń. Obecnie wynosi on 6 tygodni25. Prawo autorskie wyposaża też obecnie twórców w roszczenie o zaniechanie na wypadek, gdyby druga strony umowy – podmiot bezpośrednio związany dokonanymi w ten sposób uzgodnieniami, naruszał dokonane ustalenia. Ostatnia nowelizacja wprowadza w § 40 a tzw. prawo drugiego korzystania. Jego sens przejawia się w tym, że po 10 latach od przekazania uprawnienia do eksploatacji licencjobiorcy wyłącznemu, prawo to powraca do twórcy. W konsekwencji, twórca zyskuje na powrót możliwość dysponowania nim. Bezpośrednim powodem wprowadzenia ww. rozwiązania była praktyka znana pod nazwą „Total Bay Outs”- tzw. „sprzedaży” całkowitej, a dokładnie mówiąc na nabywaniu upoważnienie licencyjnych niejako na wszelki wypadek, w zamian za wynagrodzenie jednorazowe. Aby wydostać twórcę z tej, swojego rodzaju pułapki, zagwarantowano twórcy możliwości żądania powrotu prawa do korzystania ze stworzonego przez siebie utworu. Jeśli twórca wykona przysługujące uprawnienie, prawo eksploatacji majątkowej powraca do niego. Co istotne jednak, dotychczasowy licencjobiorca nie traci swoich uprawnień do korzystania z utworu. Przestaje on być jedynie licencjobiorcą wyłącznym. Inaczej mówiąc, licencja wyłączna ulegnie przekształceniu w licencję niewyłączną. Ustawa przewiduje również możliwość zrzeczenia się przez twórcę z tego uprawnienia. Nie może on tego jednak uczynić od razu, lecz dopiero po upływie pięciu lat od momentu zawarcia umowy.The reliance between legal guarantee of author renumeration, innovation and creativity of society is nowadays undeniable. This persuasion inspired German legislator for many years. It is conveyd by the series of modifications introduced in German Copyright Law. The latest laws have entered into force, in March 2017. The implemented changes can be presented in the following way: § 32 d of the amended copyright law enables the author to demand information and equips him with the right to be submitted appropriate report on the scope of the use of his piece of work and extent of attained profits from his work. Performers dispose of the same privilege. Discussed entitlement is granted when concluded contract is for pecuniary interest. However, the character of contractually set payment is of no significance. The author can only demand such information, which „normally, as it is customary ”, can be submitted on the scope of his business activity. This material cannot be demanded by one of the authors, whose contribution to the whole work was minor. Raising a claim by the author is also impossible, if such a claim is not eligible due to divers other reasons, as well as when the request for information is unauthorized. Such request is for example unauthorized when the transfer of material could possibly put the other side of the contract at risk of breaching business secrecy. The author can be exclusively stripped of his powers of entitlement only through collective agreements clauses, which are understood as contracts that are not individually concluded. Therefore this concerns contracts, in which authors are represented by an organization, which incorporates the authors operating in their concrete industry. A vital change in comparison with the state before amendment is broadening of group of entities obliged to provide the information requested by the author about the factual scope of use of his piece of work and extent of attained income from his work. This obligation burdens not only the entity with whom the author concluded a licence agreement but also subsequent licencees, i.e. further entities in the licence chain deriving their right from the author, but are not his contractual partners (§ 32 e). Aside from these two groups obliged to supply information, the responsibility has also been imposed on other different entities. These are namely third parties that participate differently in the economic process of work exportation and are not included in the group of licencees (§32 c I Nr 2 of the Copyright Law). § 32 of German Copyright Law equips the author with the right to apply to the court with the demand to change contractually agreed payment. In accordance with this provision, the author can demand to obtain „adequate” remuneration. The amendment of 20th December 2016 signalizes criteria helpful in determining that salary. These are „frequencies” and scope of use. The amendment of the Copyright Act of 200226 introduced an institution known as „collective regulation rates of renumeration for a certain group of authors”. In practice, these previously mentioned collective agreements had not gained popularity. One of the reasons for such behavior was the fact that arrangements made with this procedure were exhibiting the character of recommendations, i.e. they were not binding for partners, which later concluded contracts individually. The amendment of 20 December 2016 keeps this method of determining renumeration of authors, however, it does try to remove its disadvantages. First of all, the time to carry them out was drastically cut. A legal presumption, which allowed to accept a priori that particular associations are entitled to implement the negotiations on behalf of certain group of authors, was introduced. This legal presumption is applicable if the association represents „substantial number” of authors of specific category of pieces of work on the one hand and entities making use of them on the other hand. Despite the above mentioned legal presumption, the association members keep the right to adopt different resolution in this regard. Prefigured term to questioning adopted proposition of height of salaries was also cut. It is currently six weeks27. The copyright law will equip the authors with claim for omission, in case if the other party – entity directly bound with arrangements, breaks previously made arrangements. The latest amendment introduced in § 40a is the so-called right of second use. Its significance is based on the fact that after 10 years from the moment of transferring entitlement to exploitation of work to the holder of an exclusive licence, the right returns to the author. As a consequence, the author again gains the possibility of disposing of this right. The reason for the introduction of the above mentioned solution was a practice known as „Total Bay Outs”- the so-called „sell” complete, which strictly speaking, relies on purchasing licence authorisation just in case for a one-time payment. In order to help the author to break free of this sort of trap, the possibility of demanding the return of the right to use his own piece of work was guaranteed. If the author executes his entitlement, the right of financial exploitation will return to him. What is essential though, the previous licencee is not losing his entitlement to use piece of work. He stops to be an only exclusive licencee. Differently speaking, the exclusive licence transforms into a non-exclusive licence. The law also provides for the possibility of waiving the entitlement by the author. He cannot proceed with that instantly though, but only after five years from the moment of signing a contract

    Einige überlegungen zu der zweiten gruppe navigantes in augustins dialog de beata vita

    At the beginning of the series of Augustine’s earliest extant literary works are the three philosophical dialogues Contra Academicos, De beata vita and De ordine, which were composed in the autumn of 386 during Augustine’s otium philosophandi in Cassiciacum. In the introductions of all three works, the marine metaphors are widely used. The author compares human life with a stormy sea and sees as the only salvation the port of philosophy. In beata v. 1. 2 Augutin compares the people to whom philosophy can accommodate with navigantes, which he groups in tria genera. Although the people who belong to the respective group are described in detail, the author does not mention names. This arouses research interest and justifies the attempt to propose a representing person for each group. The present work sets itself the goal by parallel reading of beata v. 1. 2, with some passages from Cicero’s Epistulae, Tusculanae disputationes and De officiis to make a new proposal. And this in addition to the currently existing assumption that Romanianus, to whom the dialogue Contra Academicos is dedicated, should be considered as a representative of the second group of seafarers. However, the author of the present work now ventures a completely new approach, in which Cicero can be accepted as a representative of this group

    Przedmiot badań: Zjawisko starzenia się społeczeństwa stawia prawników przed konieczno-ścią rozwiązania szeregu nowych, nieznanych dotąd problemów, jak chociażby te związane zza-stosowaniem nowych technik. Powszechne są też głosy opotrzebie stworzenia nowej filozofii uwzględniającej specyficzną sytuację osób cierpiących na chroniczne zaburzenia pamięci. Cho-robom takim jak Alzheimer towarzyszą bowiem trwałe zaburzenia procesu podejmowania decyzji i wyrażania woli. Prowadzi to często do postawienia pytania ofaktyczną zdolność do działań osób dotkniętych takim schorzeniem oraz okwestię ich reprezentacji oraz opieki nad nimi.Cel isposób prowadzonych badań: Potrzeba kompleksowego uregulowania sytuacji prawnej osób cierpiących na demencję staje się coraz pilniejsza, również wprawie polskim. Wtym wzglę-dzie przydatne okazać się może skorzystanie zdoświadczeń państw zachodnich, wtym wszcze-gólności zrozwiązań niemieckich. Prezentacja doświadczeń naszych sąsiadów może być dobrym punktem wyjścia dla rozważań na gruncie prawa polskiego.1Wnioski: Nauka niemiecka znajduje się dopiero na początku drogi zmierzającej do wypracowania koncepcji ochrony takich osób. Pierwszy krok został już uczyniony, jest nim przeniesienie pojęć używanych do tej pory wyłącznie wsferze medycyny na płaszczyznę prawa cywilnego. Wprawie niemieckim nie występuje obecnie możliwość całkowitego ubezwłasnowolnienia. Dopuszczalne jest jedynie ograniczenie, pod pewnymi warunkami, zdolności do czynności prawnych wustalo-nym przez sąd opiekuńczy zakresie. Podopieczny zachowuje prawo do dokonywania czynności prawnych, sąd może jednak uzależnić skuteczność tej czynności od zgody opiekuna. Sam fakt ustanowienia opieki dla osoby chorej nie przesądza jeszcze oograniczeniu tejże zdolności. Wpra-wie niemieckim nie jest nigdy możliwe pozbawienie osoby chorej zdolności do dokonywania rozporządzeń na wypadek śmierci. Osoba dotknięta demencją zachowuje zwykle pełną zdolność do dokonywania czynności prawnych. Jak się wydaje, przyjęta wniemieckim systemie koncepcja naturalnej zdolności do czynności prawnych, zwana też zdolnością do działań, wpełni pozwala zabezpieczyć osobę cierpiącą na demencję przed negatywnymi konsekwencjami działań podej-mowanych przez nią wstanie wyłączenia lub znacznego ograniczenia swobody wkształtowaniu swojej woli. Jeśli bowiem zaburzenia pamięci miały wpływ na ukształtowanie woli, dokonana czynność będzie uznana za nieważną. Mankamentem takiego rozwiązania jest niewątpliwie to, że ocena ważności czynności prawnej może być dokonana wyłącznie ex post. Takie podejście jest efektem przekonania, że chory na demencję zachowuje prawo do samostanowienia osobie, wtym także do zawarcia małżeństwa. Ważną rolę wprocesie ochrony interesów osób zdysfunkcją pa-mięci spełnia możliwość udzielenia przez nie same, wcześniej, gdy są one jeszcze zdrowe, pełno-mocnictwa do sprawowania nad nimi opieki na wypadek choroby oraz wprowadzone niedawno do niem. k.c. przepisy otzw. „testamencie pacjenta”, które umożliwiają każdej pełnoletniej osobie wyrażenie woli postępowania znią na wypadek, gdyby wyrażenie takiej woli wprzyszłości zpo-wodu choroby nie było już możliwe albo znacznie utrudnione.Background: The ageing of the population presents society with ever new challenges. Technical so-lutions, such as chip monitoring for dementia sufferers, are becoming increasingly important. These phenomena make it necessary for lawyers to solve anumber of new, hitherto unknown problems.Research purpose and methods: The need for comprehensive regulation of the legal situation of people suffering from dementia is becoming more and more urgent, also in Polish law. In this respect, it may be useful to draw on the experience of Western countries, in particular, German solutions. The presentation of the experiences of our neighbours may be agood starting point for considerations under Polish law.Conclusions: In German legal doctrine, there is ageneral consensus on the need to create anew philosophy that takes into account the specific situation of people suffering from chronic memory disorders and of the members of their families, who often take on the burden of care. Diseases such as Alzheimer’s, for example, are accompanied by chronic dysfunctions in the process of decision-making and the expression of will. These dysfunctions often lead to questions about the actual legal capacity of people affected by such acondition, especially the issue of their representation and care. There is no total legal incapacity, but only apossibility of excluding the ability to act within the scope and appointment of aguardian appointed by the guardianship court. However, it is not possible to deprive such aperson of his or her ability to make dispositions by will. Consequently, in German law, the person affected by dementia and for whom the guardianship court appoints aguardian, will have the guardian as arepresentative in the fields of the guardianship. However, even in these fields the guardianship, as such, does not lead to legal incapacity. The guardianship court can only impose an additional consent requirement. On the other hand, legal incapacity, as such, is irrespective of guardianship. The concept of natural legal (in-)capacity adopted in the German system seems to fully protect the person suffering from dementia from the negative consequences of measures taken by him or her in astate of exclusion or significant restrictions on the freedom to formulate his will. If memory disorders have an impact on the shaping of will, the action performed will be considered invalid. The disadvantage of this solution is undoubtedly that the evaluation of the validity of an action can only be performed ex post. The solutions adopted are an expression of the conviction that dementia patients retain the right to self-determination. Therefore, marriages and divorces are possible. Advance directives play an important role in the process of protecting patients’ interests, by which aperson can give prior provisions on therapy and treatment and precautional authorizations, by which aperson can confer forehandedly authority to somebody else

    The objective of this paper is to analyse Aleksander Świętochowski’s debut novella series O życie [Oh Life], with particular emphasis on the opening novella. The reflections focus on Damian Capenko, a novella showcasing its relationship with the worldview of the second half of the 19th century and tendentious literature. The author proposes an interpretation of the work in the light of Dumania pesymisty [Musings of a Pessimist], an earlier series of texts by Świętochowski, one of the most outstanding creators of Positivist literature in Poland. As a result of the analyses, the relationship between the texts and the initial ideas of the Polish Positivism programme is explained, along with the apparent artistic inconsistency of the series. Celem artykułu jest analiza debiutanckiego cyklu nowelistycznego O życie Aleksandra Świętochowskiego, ze szczególnym uwzględnieniem utworu otwierającego tom. Rozważania koncentrują się na opowiadaniu Damian Capenko, ukazując jego związek ze światopoglądem drugiej połowy XIX wieku, literaturą tendencyjną. Autor proponuje interpretację utworu w świetle Dumań pesymisty, wcześniejszego cyklu wypowiedzi publicystycznych Świętochowskiego, jednego z najwybitniejszych twórców literatury pozytywizmu w Polsce. Despite great progress in the diagnosis and treatment of hypertension, it is still a huge medical-socio-economic problem. Increasing the emphasis on patient education can significantly affect self-control, adaptation to recommendations and, consequently, in the future perspective will reduce the mortality rate among patients with this disease. The aim of this work is to draw attention to the still present problems of patients with hypertension by presenting the currently valid definition, epidemiology, etiology of the disease, complications and methods of treatment.     Nuove acquisizioni sullo Specchio di Illuminazione della Beata Illuminata Bembo

    The discovery of some fifteenth-century manuscripts of the Specchio di Illuminazione of Beata Bembo in the so-called “Archivio della Beata Cate­rina”, kept in the Archbishop’s General Archive of Bologna, has opened up new and completely unexpected perspectives on the hagiography of St. Cathe­rine of Vigri, revealing a multiform and complex evolution of this work. Two new editions have emerged, different from the one known so far: one shorter and widely epitomized, the second longer, with significant inserts, concen­trated mainly in chapters VI-IX. Based on some significant clues, the author hypothesizes that this drafting chronologically precedes that of the so-called “autograph” and that it has been the subject of a series of second thoughts and complaints by the author herself or her circle. Some 16th century codices have also emerged, witnesses of the drafting known so far, but not without interest. Very recent paleographic studies had questioned the real autography of the edi­ted manuscript. A first examination of the new acquisitions seems to confirm that they do not derive from the “autograph”, presenting several lessons and disjunctive errors.La scoperta di alcuni manoscritti del XV secolo dello Specchio di Illuminazionedella Beata Bembo nel cosiddetto “Archivio della Beata Caterina”,custodito presso l’Archivio generale arcivescovile di Bologna, ha spalancatonuove prospettive, del tutto inattese, sull’agiografia di santa Caterina de’Vigri, rivelando un’evoluzione multiforme e complessa di quest’opera. Sono emerse due nuove redazioni, diverse da quella finora nota: l’una più breve e ampiamente epitomata, la seconda più lunga, con significativi inserti, concentrati soprattutto nei capitoli VI-IX. Sulla base di alcuni indizi significativi, l’autore ipotizza che questa redazione preceda cronologicamente quella del cosiddetto “autografo” e che sia stata oggetto di una serie di ripensamentie di censure da parte dell’autrice stessa o della sua cerchia. Sonoemersi anche alcuni codici del XVI secolo, testimoni della redazione finoranota, ma non privi di interesse. Recentissimi studi paleografici avevano messo in discussione la reale autografia del manoscritto edito. Un primo esame delle nuove acquisizioni sembra confermare che esse non derivino dall’“autografo”, presentando diverse lezioni ed errori disgiuntivi

    A review of Radosław Rychcik's Grażyny (Ludwik Solski Theater in Tarnów, premiere: 23.05.2015) presented during the 2nd New Theater Festival in Rzeszów (23-30.10.2015). Beata Kustra interprets the performance mainly through the lens of Maria Janion's book Women and the Spirit of Otherness, quoted at the beginning of the performance. The author attempts to show that Rychcik adopts Janion's perspective, showing Grażyna to be a woman who adopted the male social role and who can become a heroine only posthumously - when her heroic deed becomes a myth. Kustra points out many motifs and devices used by the director and comes to the conclusion that some served only to make the performance more attractive
