Reconfiguração do consensualismo contratual: as ações tituladas nominativas e os limites à transmissão
No full textPartimos da evolução histórica do consensualismo contratual salientando os
principais carateres que, nos diversos momentos históricos, se foram evidenciando.
Numa segunda etapa exploramos os fundamentos dogmáticos do modelo de
transmissão contratual assumido pelo legislador e a sua viabilidade no sistema
jurídico global, em particular, no direito dos valores mobiliários. Constatamos a
crescente necessidade na prática mercantil e inevitabilidade no sistema jurídico
global da admissibilidade da existência de contratos de compra e venda de natureza
meramente obrigacional. Num terceiro momento desenvolvemos os principais
aspetos do regime jurídico aplicável às ações tituladas nominativas fora do mercado
regulado, em particular, os principais limites à transmissão, enquanto instrumentos/barreiras ao consensualismo contratual.We start from the historical evolution of contractual consensualism emphasizing the
main aspects that, in different historical moments, were showing up. In a second
stage we explore the dogmatic foundations of the transmission model contractual
assumed by the legislator and its viability in the global legal system, in particular, in
securities law. We note the growing need in commercial practice and inevitability in
the global legal system the admissibility of the existence of contracts of sale purely
obligatory. In the third stage we develop the main aspects of the legal regime
applicable to nominative titled actions outside the regulated market, in particular,
the main limits to the transmission, as instruments / barriers to contractual
consensualism

No full textEl present article busca plantejar una comparació preliminar entre la poesia d'António Franco Alexandre (Portugal, 1944) i la del poeta francès Francis Ponge (1899-1988). Estant ja establerta la presència tutelar d'algunes figures (Ovidi, Camões, Fernando Pessoa) en l'obra de Franco Alexandre, aquest article desitja impulsar un primer diàleg entre el poeta portuguès i l'autor de Le Parti Pris des Choses (1942). Privilegiant un punt de vista posthumanista centrat en els éssers no humans, tractarem de considerar les maneres en què la celebració de l'objecte, crucial per a la poètica de Ponge, resulta ser fructífera, amb l'esperança de llançar llum sobre la poesia de Franco Alexandre.This article aims to attempt a preliminary comparison between the poetry of António Franco Alexandre (Portugal, 1944) and of the French poet Francis Ponge (1899-1988). Having already established the tutelary presence of some literary figures (Ovid, Camões, Fernando Pessoa) in the work of Franco Alexandre, this article wishes to prompt a first dialogue between the Portuguese Poet and the author of Le Parti Pris des Choses (1942). Embracing a posthumanist standpoint centred on non-human beings, we will seek to consider the ways in which the celebration of the object, crucial to Ponge’s poetics, proves to be fruitful, and hopefully sheds light upon Franco Alexandre’s poetry.Este artículo pretende ensayar una primera aproximación entre la poesía de António Franco Alexandre (Portugal, 1944) y la poética del poeta francés Francis Ponge (1899-1988). Ya advertida, en la fortuna crítica alejandrina, la presencia tutelar de algunas figuras literarias (Ovidio, Camões, Fernando Pessoa) en la obra de Franco Alexandre, la obra en cuestión pretende iniciar un primer diálogo entre el poeta portugués y el autor de Le Parti Pris des Choses (1942). No full textEste é um trabalho sobre a poesia de António Franco Alexandre. A leitura aqui proposta
é focada em sua obra Aracne (2004) e tem como eixo fulcral de análise a ideia da
metamorfose. Articulando esta noção aos procedimentos criativos do autor, observamos
como são conjugados, ainda, erotismo e representação de forma a se construir uma ética
da poesia. Ao perpassar uma trilha literária que se desloca da narrativa mitológica,
homônima ao título estudado, até o livro-poema, esta dissertação tenciona, igualmente,
visitar tanto a tradição lírica portuguesa como nomes do cânone universal, notando as
suas repercussões em diferença no jogo intertextual promovido pela obra em questãoThis is an essay about the António Franco Alexandre’s poetry. The reading proposed
here is focused on his work Aracne (2004) and has as its analysis axis the idea of
metamorphosis. Articulating this notion to creative procedures of the author, we also
observe how eroticism and representation are combined in order to build an ethic of
poetry. Describing a literary path that goes from the homonym myth to the poem, this
dissertation equally intends to visit the Portuguese lyric tradition as much as the
universal canon, noting its impact on intertextual game promoted by the work in

Paratypes: same data as holotype, 1♁ (MPEG 37769, PBI _ OON 45144); Jun. 19/ Aug. 11–13, 2003, 1♁ (MPEG 10911 PBI _ OON 45821); 1♁ (MPEG 10912, PBI _ OON 45898). Etymology. The specific name is a patronym in honor of Alexandre Ereba, a five-year-old boy from the tribe Ogoni, living in Port Harcourt’s waterfront, southeeastern Nigeria, who was named Alexandre in honor of the third author. Diagnosis. Males of this species are similar to those of H. fannesi sp. nov. and H. periclitata sp. nov., by the endite’s P1 longitudinally oriented, posteriorly directed, reaching the anterior margin of sternum (Figs 17F, 19F, 21F) but differ by the tip of endite’s P1 twisted lateraly (Fig. 20C) (folded ventrally in H. fannesi sp. nov., Fig. 18C; not twisted or folded in H. periclitata sp. nov., Fig. 23B). Additionally, they can be recognized by the presence of a sternal postero-median concavity (Fig. 20A) (absent in H. fannesi sp. nov. and H. periclitata sp. nov.) and by the large, squared process of the prosoma pedicelar region (Figs 19D, 20B, G) (absent or semicircular in all other species of the genus). Description. Male (PBI_OON 45144). Total length 1.64. CEPHALOTHORAX: Carapace pale orange, with Coxapopha -like pattern, pars cephalica with two posterior humps in lateral view, surface of elevated portion of pars cephalica smooth, sides finely reticulate, fovea present (Figs 19B–C). Eyes ALE oval, PME circular, PLE oval; posterior eye row recurved from above, straight from front; ALE separated by more than their diameter, ALE-PLE separated by less than ALE radius, PME touching, PLE-PME separated by less than PME radius (Fig. 19E). Sternum wider than long, pale orange, with radial furrows between coxae I–II, II–III, III–IV, furrow wrinkled, surface smooth, without pits, microsculpture everywhere but front, median concavity present (Figs 19D, 20B). Mouthparts: Chelicerae distal region abruptly narrowed (Figs 20A,D). Labium anterior margin anteriorly projecting at middle (Fig. 20C). Endites with a median projection (mp), a P1 and a P2; mp very short, with wide base and narrow tip, directed anteriorly; P1 long, directed posteriorly, reaching the anterior third of the sternum. P2 very short, situated anteriorly to P1 (Fig. 20C). ABDOMEN: dorsum soft portions white. Book lung covers small, very narrow. Dorsal scutum pale orange, covering full length of abdomen, no soft tissue visible dorsally. Epigastric scutum not protruding. Postepigastric scutum pale orange, long, almost rectangular, covering nearly full length of abdominal length (Figs 19B,G, 20E). LEGS: yellow. GENITALIA: Epigastric region with sperm pore situated at level of posterior spiracles. Palp proximal segments yellow; embolus tip flattened, not bent upwards; conductor present, as longer as embolus, with abruptly narrowed tip (Figs 19G–I, 20F,H–K). Female. Unknown. It is a fact that BAs have an important role in business internationalization; therefore the author saw the lack of study on this phenomenon as a gap, an opportunity to understand and share a Portuguese case in a valuable sector
The impact of channel conflict on channel efficiency : the case of Portuguese water heaters producers and distributors
Get PDFThe focus of this paper is to examine the relationship between channel conflict and channel efficiency. For that purpose, this paper compares the early distribution literature and the industrial network approach. The research strategy adopted is action research, including participant observation by the author. In addition, direct intervention was taken from the parties involved (producer, wholesalers and retailers) in order to present some facts and considerations to the phenomena under study. This paper endeavors to provide a contribution to the theory of channel distribution, as it presents an attempt to investigate channel conflict theories applied to the distribution channel of water producers. It attempts to offer a contribution to the study of channel efficiency, as it delivers, based on the literature review, some ideas to a producer that has to manage, on a daily basis, the efficiency of its channel distribution

Fairness considerations are found to play an important role not only in bargaining situations but also in competitive markets. At the same time, the impact of fairness varies with the institutional setting. Finally, investigation into the variation of trust accross the Dutch population suggests that age and education affect a basic trust propensity.

of mass manufacturing and the commercialization of the earliest protectable applied art –
printed textiles. This paper humbly attempts to explore the history of both and the undeniable
impact on the current state of copyright law that it has had. Furthermore, the author suggests
how the individual creator or organization can strategically protect itself within the
framework of existing policy, as well as the importance of increasing ones own education on
the subject of maintaining and exploiting ones own intellectual property.
Here it is theorized, that much of the cause of both infringement and missed opportunities for
fear of infringement, has to do with a general misunderstanding of intellectual property law
within the creative professional community. It is felt that by advancing education of the topic
specific to its industry needs, those who are designing or creating said products would be
more proactive in prevention
