    مستخلص البحث ينص القانون رقم 16 لسنة 2019 بشأن التعديلات على القانون رقم 1 لسنة 1974 بشأن الزواج على أن الحد الأدنى لسن الزواج هو 19 عامًا للرجال والنساء. تم تمرير هذه اللائحة على أمل الحد من ارتفاع معدل زواج الأطفال. لكن الحقيقة هي أن زواج الأطفال قد ازداد بعد المصادقة على هذه القاعدة. أحدها ما حدث في محكمة الدينية تانجونج باتي. يُشار إلى ذلك من خلال الزيادة في حالات الإعفاء من الزواج في نهاية عام 2019. و العوامل الكامنة وراء طلب الإعفاء من الزواج هي العلاقة الوثيقة جدًا بين طفل مقدم الطلب و زوجته. هذا البحث هو بحث تجريبي / ميداني مع طرق بحث نوعية أجريت في محكمة الدينية تانجونج باتي. بيانات العينة لهذه الدراسة هي تحديد حالات الإعفاء من الزواج التي يتم فحصها بعد التغييرات في أحكام الحد الأدنى لسن الزواج في عام 2019. و تركز بيانات العينة على 3 تحديد للإعفاء من الزواج على أساس أن العلاقة متقاربة للغاية في غضون شهرين و 3 أشهر و 6 سنوات. استخدمت تقنيات جمع البيانات في هذه البحث مقابلات مع قضاة محكمة الدينية تانجونج باتي. بناءً على نتائج المقابلات مع قضاة محكمة الدينية تانجونج باتي، يتضح أن حالات الإعفاء من الزواج التي قدمها مقدم الطلب هي في المتوسط حالات لا يمكن للوالدين التعامل معها بعد الآن. أحد الأسباب هو العلاقة الوثيقة بين طفل مقدم الطلب و شريكه بحيث لا يمكن فصلهما مرة أخرى. جادل القضاة في محكمة الدينية تانجونج باتي بأن معنى العلاقة الوثيقة جدًا هو العلاقة التي أدت إلى انتهاكات للدين والأعراف السائدة في المجتمع. عند التعامل مع حالات الإعفاء من الزواج على أساس أن العلاقة كانت وثيقة للغاية، نظر القضاة في عدة عوامل بما في ذلك الاستعداد العقلي و الجسدي و التوجيه من الوالدين. السماح بالإعفاء من الزواج هو محاولة لمنع المزيد من الضرر في العديد من جوانب الحياة. يتماشى هذا مع مفهوم المقاصد الشريعة، و هو الغرض من تطبيق الشريعة الإسلامية التي تتضمن خمسة جوانب رئيسية للصيانة. تشمل الجوانب الخمسة الرئيسية صيانة الدين و الروح و النسب و العقل و الممتلكات. بناءً على مفهوم المقاصد الشريعة، فإن الإعفاء من الزواج يمكن أن يحفظ الدين و الروح و النسب و الملكية من المضارات أو الأخطار. الأكبر ABSTRACT Law No. 16 of 2019 on Amendments to Law No. 1 of 1974 on Marriage states that the marriage age limit is 19 years for men and women. The regulation was approved in hopes of suppressing the high rate of child marriage. However, in fact child marriage is increasing after the ratification of the regulation. One of them as happened in the Tanjung Pati Religious Court. This is marked by an increase in marital dispensations at the end of 2019. The factors behind the application for marital dispensation are the relationship that is too close between the applicant's child and the partner. This research was empirical research / field with qualitative research methods conducted in the Tanjung Pati Religious Court. The sample data in this study was the determination of marital dispensation cases that were examined after the provisions changing of the marriage age limit in 2019. The sample data focused on 3 marital dispensation determinations, arguing that the relationship was too close within 2 months, 3 months, and 6 years. The data collection techniques in this study used interviews with the judges of the Tanjung Pati Religious Court. Based on the results of interviews with the Judges of the Tanjung Pati Religious Court described that most of the marital dispensation cases filed by the applicant were cases that cannot be handled by parents anymore. One of them was because the relationship that too close between the applicant's child and the partner, so that it can not be separated anymore. The Judges of the Tanjung Pati Religious Court argued that the meaning of the too close relationship, namely the relationship that leads to breaking of religion and norms that apply in society. In dealing with marital dispensation cases on the grounds that the relationship was too close, the judges looked at several factors including mental, physical, and Parental guidance. giving marital dispensation permits is one of the efforts to prevent greater harm in some aspects of life. This is in line with the concept of syariah maqashid which is the purpose of islamic law which has five main aspects of maintenance. The five main aspects include the maintenance of religion, soul, descendants, mind, and wealth. Based on the concept of syariah maqashid, the giving of marital dispensation can preserve religion, soul, descendants, mind, and wealth from mudharat or greater danger. ABSTRAK Undang-Undang Nomor 16 Tahun 2019 tentang Perubahan atas Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan menyatakan bahwa batas usia perkawinan yaitu 19 tahun bagi laki-laki dan perempuan. Peraturan tersebut disahkan dengan harapan dapat menekan tingginya angka perkawinan anak. Namun, pada faktanya perkawinan anak semakin meningkat setelah pengesahan aturan tersebut. Salah satunya seperti yang terjadi di Pengadilan Agama Tanjung Pati. Hal ini ditandai dengan meningkatnya perkara dispensasi kawin pada akhir tahun 2019. Adapun faktor yang melatar belakangi permohonan dispensasi kawin yaitu hubungan yang terlalu dekat antara anak pemohon dengan pasangannya. Penelitian ini merupakan penelitian empiris/lapangan dengan metode penelitian kualitatif yang dilakukan di Pengadilan Agama Tanjung Pati. Adapun data sampel penelitian ini berupa penetapan perkara dispensasi kawin yang diperiksa setelah perubahan ketentuan batas usia perkawinan di tahun 2019. Data sampel tersebut difokuskan kepada 3 penetapan dispensasi kawin dengan alasan hubungan terlalu dekat dalam jarak waktu 2 bulan, 3 bulan, dan 6 tahun. Teknik pengumpulan data dalam penelitian ini menggunakan wawancara terhadap para hakim Pengadilan Agama Tanjung Pati. Berdasarkan hasil wawancara dengan Para Hakim Pengadilan Agama Tanjung Pati menggambarkan bahwa rata-rata perkara dispensasi kawin yang diajukan oleh pemohon merupakan kasus-kasus yang tidak dapat ditangani oleh orang tua lagi. Salah satunya disebabkan karena hubungan yang terlalu dekat antara anak pemohon dengan pasangannya sehingga tidak bisa dipisahkan lagi. Para Hakim Pengadilan Agama Tanjung Pati berpendapat bahwa makna dari hubungan terlalu dekat yaitu hubungan yang mengarah kepada hal-hal pelanggaran agama maupun norma yang berlaku di masyarakat. Dalam menangani perkara dispensasi kawin dengan alasan hubungan terlalu dekat, para hakim melihat beberapa faktor yang meliputi kesiapan mental, fisik, dan bimbingan dari orang tua. Pemberian izin dispensasi kawin merupakan salah satu upaya mencegah kemudharatan yang lebih besar dalam beberapa aspek kehidupan. Hal ini sejalan dengan konsep maqashid syariah yang merupakan tujuan diberlakukannya hukum Islam yang memiliki lima aspek pemeliharaan utama. Lima aspek utama tersebut meliputi pemeliharaan agama, jiwa, keturunan, akal, dan harta. Berdasarkan konsep maqashid syariah, pemberian dispensasi kawin dapat memelihara agama, jiwa, keturunan, akal, dan harta dari mudharat atau bahaya yang lebih besar

    This article aims to analyze the considerations of judges who grant requests for interfaith marriages. This type of research is normative legal research in the form of case studies with a content analysis approach. The cases analyzed in this study are case numbers 916/Pdt.P.2022/PN.Sby and 508/Pdt.P/2022/PN.JKT.SEL. The results of the study found that the judge's argument in granting interfaith marriages was that there were different forms of legalization of interfaith marriages. The Surabaya District Court judge legalized a valid interfaith marriage contract. Meanwhile, the judge at the South Jakarta District Court legalized interfaith marriage contracts. However, the South Jakarta District Religious Court did not grant marriage registration rights to applicants at the Population and Civil Registry Service Office

The Talu Religious Court, part of the Padang High Religious Court, employs Jurimetrics due to disputes over divorce-related issues. Through normative legal research and content analysis, it's evident that Jurimetrics-influenced decisions notably enhance wives' rights compared to non-Jurimetrics rulings. These decisions prioritize fairness by considering factors like minimum wage, husband's income, and marriage duration. Notably, the application of Jurimetrics in divorce proceedings consistently leads to more equitable and just outcomes for wives, presenting a systematic and fair approach rooted in principles of fairness and justice. Overall, employing Jurimetrics significantly bolsters the protection of post-divorce wives' rights, providing a methodological framework founded on fairness and equity within divorce adjudications

    Between Flogging and Imprisonment: The Disparity Effect of the Sharia Court's Decision on the Supremacy of the Qanun Jinayat of Aceh

    This research aims to map the same cases with different sentencing decisions, determine the causes for the disparities in penalties in those decisions, and elaborate on the reasons for judges in making decisions. Qanun Jinayat of Aceh has designated flogging as the primary punishment for qanun violators. Nonetheless, many Sharia Court judges sentence offenders of sexual crimes to prison. This is empirical legal research with a normative juridical approach and a Sharia approach. Data were collected through interviews and the examination of decision documents. Those data were analyzed using data reduction, data display, and data verification. This research found that the same cases with different decisions include cases of rape, sexual harassment, and accusations of adultery. More prison sentences are imposed by Sharia Court judges in these cases than flogging and fines. The fundamental reason for these differences in decisions is due to the qanun's punishment choices, which are tinted by judges' perspectives in assessing Sharia-based qanun rules. Another factor for this disparity is the community's insistence that cases of rape and sexual harassment be punished by imprisonment or the authority to be remanded to the District Court. Some people argue that flogging has not deterred the perpetrators because, if the judge decides on this sentence, it may be carried out in a short time. Then, the perpetrator immediately returns to society and has an opportunity to repeat his crimes, while the victim is still in a traumatized state
