John Stuart Mill e o princípio da liberdade : entre o bem-estar e o aperfeiçoamento
O ponto de partida desse trabalho é a investigação do significado do Princípio da Liberdade, mais conhecido como Princípio do Dano, na filosofia de John Stuart Mill. O princípio é anunciado pelo autor como o princípio fundamental que rege as relações – ao menos as coercitivas – entre sociedade e indivíduos, delimitando o campo de legitimidade e o de ilegitimidade das intervenções sociais sobre o espectro de ação e expressão dos indivíduos. Para interpretá-lo, analiso primeiramente os principais conceitos da sua teoria psicológica e do seu projeto de uma ciência etológica de investigação das principais causas da formação do caráter humano, além de dar especial atenção às suas considerações históricas e sociológicas sobre as causas e condições de estabilização e transformação dos estados sociais e aos seus diagnósticos sobre as tendências históricas de seu tempo. Em seguida trato de oferecer uma interpretação sobre a teoria da felicidade ou ‘arte da vida’ de Mill, que é a fundação de toda a sua filosofia prática, analisando o papel que cada uma das principais faculdades humanas (intelectuais, imaginativas e simpatéticas ou morais) cumpre no ideal ético do autor. Debruçome, ainda, sobre o campo da moralidade, explicando a relação entre moralidade, justiça e direitos morais. Ao final, concluo, a partir dos conceitos analisados nos capítulos anteriores, que o Princípio da Liberdade é justificado no esquema de Mill para proteger e promover dois tipos gerais de interesse da humanidade que, embora sejam complementares e estejam de certa forma amalgamados da perspectiva do ideal ético milliano, podem ser divididos entre (i) interesses de bem-estar e os (ii) interesses de aperfeiçoamento.The starting point of this work is the research of the meaning of the Liberty Principle, better known as the Harm Principle, in the philosophy of John Stuart Mill. The principle is announced by the author as the fundamental principle governing the relations – at least the coercive ones – between society and individuals, delimiting the field of legitimacy and that of illegitimacy of social interventions on the range of action and expression of individuals. To interpret it, I first analyze the main concepts of Mill’s psychology and his project of an 'ethological' science of investigation of the main causes of human character formation. I also pay special attention to his historical and sociological considerations on the causes and conditions of stabilization and transformation of social states and his picture of the historical tendencies of his time. Next I will try to offer an interpretation of Mill's theory of happiness or 'art of life', which is the foundation of all his practical philosophy, analyzing the role that each of the main human faculties (intellectual, imaginative and sympathetic or moral) plays in the author's ethical ideal. I also focus on the field of morality, explaining the relationship between morality, justice and moral rights. Finally, I conclude from the concepts analyzed in the previous chapters that the Liberty Principle is justified in Mill's scheme to protect and promote two general types of interests of humanity which, though complementary and certain somewhat merged from the perspective of the millian ethical ideal, can be divided between (i) welfare interests and (ii) improvement interests
Mais socialista do que eu? As semelhanças entre normatividades críticas para o socialismo de Rawls e Honneth
I wish to compare and approximate Axel Honneth's and John Rawls normative foundations for socialism. To do so, I take as my starting point some features of Honneth's theory developed in his writing on Socialism as well as the very contrasts he establishes with Rawls's project. I unfold the comparison on two fronts: the first, dealing with the normative content of their notions of freedom, and the second, dealing with what Honneth and other authors of the critical theory tradition call the social or immanent basis of theories. From the first comparison, I conclude that the contrast established by Honneth between his normative ideal of social freedom and the normative ideal of freedom found in Rawls's political philosophy does not find support in an accurate analysis of the Rawlsian proposal. that Rawls's philosophy can also provide a critical normativity for socialism. From the second comparison, I conclude, despite Honneth's criticism that there is a deficiency of ‘practical-political’ in Rawls's philosophy, that it is possible to find in Rawls's work the three elements that Honneth considers necessary for a critical theory that does not want to be only a ‘purely normative’ critique of society.Proponho comparar e aproximar as fundamentações normativas para o socialismo de Axel Honneth e John Rawls. Parto, para tanto, de alguns traços da teoria de Honneth desenvolvidos em seu escrito sobre socialismo e dos próprios contrastes estabelecidos por ele frente ao projeto de Rawls. Destrincho a comparação em duas frentes: a primeira, tratando do conteúdo normativo das noções de liberdade de ambos os autores, a segunda, tratando do que Honneth e outros autores da tradição da teoria crítica chamam de base social ou imanente das teorias. Da primeira, concluo que o contraste estabelecido por Honneth entre o seu ideal de liberdade social e o ideal de liberdade encontrado na filosofia política de Rawls não encontra respaldo em uma análise acurada da proposta rawlsiana, e que a filosofia de Rawls também pode fornecer uma normatividade crítica para o Socialismo. Da segunda, concluo, a despeito da crítica de Honneth de que haveria uma deficiência ‘prático-política’ na filosofia de Rawls, que é possível encontrar na obra deste, de uma forma mais ou menos similar àquela do autor alemão, os três elementos que Honneth julga serem necessários para uma teoria crítica que não queira ser apenas uma crítica ‘puramente normativa’ da sociedade

Esse trabalho tem como objetivo (a) expor a concepção da punição como censura proporcional à gravidade do crime, de Andrew Von Hirsch, dando-se ênfase aos princípios derivados de sua teoria que devem orientar a imposição de sanções criminais; (b) investigar qual o papel normativo da censura ou reprovação no sistema de penas brasileiro e em que medida tal função – e razão de punir – institui a exigência da proporcionalidade entre a gravidade dos crimes e a severidade das sanções, em termos ordinais e cardinais; (c) interrogar de que forma os princípios da proporcionalidade ordinal (relativa) e da proporcionalidade cardinal (não-relativa) são infringidos nas penas cumpridas em circunstâncias degradantes e de superlotação carcerária, e se eles podem oferecer razões para a adoção de determinada solução reparatória dos danos sofridos pelos apenados – a remição de dias da pena
Martin Luther King Jr. e a desobediência civil como um apelo às emoções políticas do público
O presente trabalho busca tratar do tema da desobediência civil, defendendo uma interpretação, baseada principalmente em uma análise das contribuições filosóficas de Martin Luther King Jr, segundo a qual essa forma de reivindicação política tem como uma de suas características distintivas, quiçá a sua característica central, a reparação de injustiças por meio do suscitamento de certos sentimentos políticos (ou morais) no público a que se endereça, forjando nele uma transformação ou um despertar emocional. Primeiramente, resumo brevemente o desenvolvimento inicial do conceito e da prática da desobediência civil no século XX por Mohandas K. Gandhi e Martin Luther King Jr. Depois, esboço uma comparação entre alguns elementos da abordagem de John Rawls e de King, destacando a ênfase emotiva dada pelo segundo autor na sua defesa dos princípios que devem guiar a desobediência civil. Por fim, à luz dessa interpretação, e para dar maior claridade às consequências da sugerida mudança de foco na compreensão do conceito, faço apontamentos sobre algumas críticas recentes endereçadas por Robin Celikates à desobediência civil liberal de John Rawls.This work aims to write about civil disobedience, defending an interpretation, based chiefly on an analysis of Martin Luther King Jr’s philosophical contributions, whereby this form of political claim has as one of its distinctive features, perhaps its core feature, the repair of injustices through evoking certain political (or moral) emotions in the target public, raising in him an emotional transformation or awakening. First, I resume the early evolution of civil disobedience concept and practice carried out by Mohandas K. Gandhi and Martin Luther King Jr in the XX century. Secondly, I sketch an comparison between some elements of John Rawls’ approach and King’s, detaching the emotional emphasis given by the latter in his defence of the principles which ought to guide civil disobedience. Last, following this interpretation, and to give more clarity for the consequences arising from the suggested focus shift on the understanding of the concept, I make appointments towards some recent critics adressed by Robin Celikates against John Rawls’ liberal civil disobedience
Going Beyond Counting First Authors in Author Co-citation Analysis
The present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation
counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings
are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that
only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into
account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed
Variations on the Author
“Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship
Appropriate Similarity Measures for Author Cocitation Analysis
We provide a number of new insights into the methodological discussion about author cocitation analysis. We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature. Dispelling the Myths Behind First-author Citation Counts
We conducted a full-scale evaluative citation analysis study of scholars in the XML research field to explore just how different from each other author rankings resulting from different citation counting methods actually are, and to demonstrate the capability of emerging data and tools on the Web in supporting more realistic citation counting methods. Our results contest some common arguments for the continued
use of first-author citation counts in the evaluation of scholars, such as high correlations between author rankings by first-author citation counts and other citation
counting methods, and high costs of using more realistic citation counting methods that are not well-supported by the ISI databases.
