Compensações punitivas por violações de direitos fundamentais dos preso: reflexões sobre o futuro da ADPF 347 no STF
In Brazil, there is an underdevelopment of the theoretical category of punitive compensation, which seeks the recognition that violations of fundamental rights of prisoners should produce compensatory effects on the sentence to be served. In light of our constitutional system and decisions from the Inter-American Court of Human Rights, the article argues that the Brazilian Federal Supreme Court (STF) should, in the judgment of the merits of Claim of Non-Compliance with a Fundamental Precept (ADPF) 347, affirm the right to punitive compensation for the violation of prisoners' rights resulting from prison overcrowding. This solution will, at the same time, quickly and effectively repair the violation of prisoners' rights and reduce the high degree of prison overcrowding that has characterized the Brazilian prison system for decades.No Brasil, há um subdesenvolvimento teórico da categoria da compensação punitiva, que pretende o reconhecimento de que violações de direitos fundamentais dos presos devem produzir efeitos compensatórios na pena a ser cumprida. À luz do nosso sistema constitucional e de decisões da Corte Interamericana de Direitos Humanos, o artigo defende que o STF deve, no julgamento do mérito da ADPF 347, afirmar o direito à compensação punitiva pela violação dos direitos dos presos decorrentes da superlotação carcerária. Limites constitucionais à liberdade de expressão: uma revisitação crítica ao clear and present danger test
This article revisits the jurisprudential trajectory of freedom of speech within United States constitutional law, with particular emphasis on the development, distortions, and legacy of the clear and present danger test. The analysis begins with the recognition that American free speech doctrine—often invoked in Brazil as a model of absolute protection—has, in reality, evolved through historical episodes of repression, institutional tension, and normative recalibration in response to perceived threats to democratic order. Accordingly, the article traces the test’s doctrinal evolution from the foundational opinions of Justices Holmes and Brandeis, through its authoritarian distortion in Dennis v. United States, to its doctrinal realignment in Brandenburg v. Ohio, where the criteria of intent, likelihood, and imminence of unlawful action were firmly established. Drawing on scholars such as Cass Sunstein, the article questions whether the imminence requirement remains adequate in addressing contemporary threats—such as large-scale disinformation campaigns and diffuse processes of institutional degradation. It argues that, in exceptional contexts involving serious risks to democratic governance, a narrowly tailored and well-justified relaxation of the imminence prong may be warranted, so long as the other elements of the test remain strictly satisfied. Anchored in Brazil’s recent political experience—particularly during the Bolsonaro administration—the article contends that, in the face of tangible threats to the integrity of electoral processes and democratic stability, a targeted and proportionate departure from the strict imminence requirement proved not only legitimate but necessary to safeguard constitutional order.Este artículo revisita la trayectoria jurisprudencial de la libertad de expresión en el derecho constitucional de los Estados Unidos, con especial atención a la construcción, inflexiones y legados del clear and present danger test. El análisis parte del reconocimiento de que la doctrina estadounidense – frecuentemente invocada en Brasil como paradigma de protección irrestricta al discurso – ha estado, en realidad, marcada por contextos históricos de represión, tensiones institucionales y ajustes normativos frente a riesgos para el orden democrático. En este sentido, se examina el desarrollo progresivo del test desde los votos de Holmes y Brandeis, su distorsión en la sentencia del caso Dennis v. United States y, finalmente, su reformulación en el precedente Brandenburg v. Ohio, en el cual se establecieron los criterios de intencionalidad, probabilidad e inminencia de la acción ilegal. A partir de autores como Cass Sunstein, el artículo cuestiona la suficiencia del criterio de “inminencia” frente a amenazas contemporáneas – como las campañas masivas de desinformación y los procesos difusos de corrosión institucional – y propone que, en contextos excepcionales de grave riesgo para la democracia, sea posible una flexibilización controlada y justificada de dicho elemento, siempre que se respeten los demás requisitos del test. Con base en la experiencia reciente de Brasil, especialmente durante el gobierno de Bolsonaro, se argumenta que, frente a una situación de amenaza concreta a la integridad del proceso electoral y a la estabilidad del régimen democrático, la flexibilización puntual del requisito de inminencia resultó no solo legítima, sino necesaria para la protección del orden constitucional.Este artigo revisita a trajetória jurisprudencial da liberdade de expressão no direito constitucional dos Estados Unidos, com foco na construção, inflexões e legados do clear and present danger test. A análise parte da constatação de que a doutrina estadunidense, muitas vezes invocada no Brasil como paradigma de proteção irrestrita ao discurso, foi, em verdade, marcada por contextos históricos de repressão, tensões institucionais e ajustes normativos diante de riscos à ordem democrática. Desse modo, examinar-se-á o desenvolvimento progressivo do teste desde os votos de Holmes e Brandeis, sua distorção no julgamento do caso Dennis v. United States, e, por fim, a sua reformulação no precedente Brandenburg v. Ohio, no qual se fixaram os critérios da intencionalidade, probabilidade e iminência de ação ilegal. A partir de autores como Cass Sunstein, o artigo problematiza a suficiência do critério da “iminência” diante de ameaças contemporâneas – como campanhas massivas de desinformação e processos difusos de corrosão institucional – e propõe que, em contextos excepcionais de grave risco à democracia, possa haver flexibilização controlada e justificada desse elemento, desde que observados os demais requisitos do teste. O CONTROLE DE CONVENCIONALIDADE NA JURISPRUDÊNCIA DA CORTE INTERAMERICANA DE DIREITOS HUMANOS E SEUS INFLUXOS NO SUPREMO TRIBUNAL FEDERAL
The present paper analyzes the convencionality control exercised by the IACHR, addressing its genesis and historical evolution, as well as the internal reflexes of the jurisprudence of this Court, especially as to the degree and the parameters of its binding effects in relation to national judges under the interpretation of the Brazilian’s Supreme Court. So far, the Brazilian’s Supreme Court have not studied the subject, despite the IACHR's understanding that its pronouncements have expansive and binding effects on all States Parties to the American Convention on Human Rights, even if they have not taken part in the case. The establishment of minimum parameters regarding the degree of internal binding to the IACHR's precedents, as already done by the Colombian Constitutional Court, for example, is necessary to (a) provide national judges and other domestic legal operators with a clear direction to follow, (b) promote legal certainty, avoiding casuism in the selection of international precedents to be followed or not by national jurisprudence; (c) indicate to the IACHR itself the reasons for whether or not it’s precedent has been applied in each case, allowing the Court to consider such grounds in future judgments, to eventually change its jurisprudence or to strengthen its arguments.O objeto do presente artigo consiste em analisar o controle de convencionalidade exercido pela CIDH, abordando sua gênese e evolução histórica, bem como os reflexos internos da jurisprudência dessa Corte, especialmente quanto ao grau e aos parâmetros de vinculação de seus precedentes em relação aos juízes nacionais à luz do entendimento do Supremo Tribunal Federal. Não há, até o momento, na jurisprudência do STF, debates acerca do tema, a despeito do entendimento da CIDH no sentido de que seus pronunciamentos possuem efeitos expansivos e vinculantes para todos os Estados-partes da Convenção Americana de Direitos Humanos, ainda que não tenham figurado no processo. O estabelecimento de parâmetros mínimos acerca do grau de vinculação interna aos precedentes da CIDH, a exemplo do que já realizado pela Corte Constitucional colombiana, é necessário para (a) assegurar aos juízes nacionais e demais operadores jurídicos internos um norte claro a ser seguido, (b) promover a segurança jurídica, evitando casuísmos na seleção dos precedentes internacionais a serem seguidos ou não pela jurisprudência nacional; (c) indicar para a própria CIDH as razões pela aplicação ou não, em cada caso, de determinado precedente, permitindo que a Corte leve em consideração tais fundamentos em futuros julgamentos, para eventualmente alterar sua jurisprudência ou robustecer sua argumentação
Presunção de inocência e a doutrina da prova além da dúvida razoável na jurisdição constitucional
Em razão da centralidade do princípio da presunção de inocência nos sistemas constitucionais democráticos, diversos tribunais constitucionais têm buscado, nos mais diversos quadrantes e a partir do recurso a diferentes metodologias, desenvolver parâmetros que tornem eficaz a dimensão do princípio ligada à exigência de que a condenação criminal esteja fundada em certo nível de certeza probatória. Para que o princípio da presunção de inocência desempenhe sua função de garantia, alguns tribunais constitucionais desenvolveram o standard da prova “para além da dúvida razoável”. A jurisprudência constitucional estrangeira deu passos significativos na superação do uso meramente retórico da categoria da prova “para além da dúvida razoável”, atribuindo-lhe significado normativo mais denso e operativo. Alguns tribunais constitucionais – e.g. Tribunal Constitucional da Espanha e Corte Constitucional da Colômbia – têm procurado tutelar essa dimensão do princípio da presunção de inocência por meio da exigência, por um lado, de comprovação da culpa para além de qualquer dúvida razoável e, por outro, da obrigatoriedade de valoração integral do conjunto probatório e de motivação lógica e racional acerca desses elementos probatórios

The growing influence of the jurisprudence of the International Courts of Human Rights in the major national legal debates is a phenomenon present in most of contemporary constitutional democracies. In Brazil, it became more visible in recent years. In this context, the present paper analyzes the precedents of the Brazilian’s Supreme Court which expressly refered the Inter-American Court of Human Rights’s (IACHR) decisions, in order to verify whether the court is actually (a) binding on the decisions taken by IACHR; (b) performing a mere duty of deference or (c) using the precedents as an argumentative reinforcement of the Justice`s own positions.O alargamento da esfera de influência da jurisprudência das Cortes Internacionais de Direitos Humanos nos grandes debates jurídicos nacionais é um fenômeno que se reproduz nas democracias constitucionais contemporâneas, e que no Brasil começa se tornar mais visível nos últimos anos. Going Beyond Counting First Authors in Author Co-citation Analysis
The present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation
counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings
are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that
only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into
account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed
Variations on the Author
“Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship
Appropriate Similarity Measures for Author Cocitation Analysis
We provide a number of new insights into the methodological discussion about author cocitation analysis. We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature. Dispelling the Myths Behind First-author Citation Counts
We conducted a full-scale evaluative citation analysis study of scholars in the XML research field to explore just how different from each other author rankings resulting from different citation counting methods actually are, and to demonstrate the capability of emerging data and tools on the Web in supporting more realistic citation counting methods. Our results contest some common arguments for the continued
use of first-author citation counts in the evaluation of scholars, such as high correlations between author rankings by first-author citation counts and other citation
counting methods, and high costs of using more realistic citation counting methods that are not well-supported by the ISI databases.
