    Undoing Suicidism

    In Undoing Suicidism, Alexandre Baril argues that suicidal people are oppressed by what he calls structural suicidism, a hidden oppression that, until now, has been unnamed and under-theorized. Each year, suicidism and its preventionist script and strategies reproduce violence and cause additional harm and death among suicidal people through forms of criminalization, incarceration, discrimination, stigmatization, and pathologization. This is particularly true for marginalized groups experiencing multiple oppressions, including queer, trans, disabled, or Mad people. Undoing Suicidism questions the belief that the best way to help suicidal people is through the logic of prevention. Alexandre Baril presents the thought-provoking argument that supporting assisted suicide for suicidal people could better prevent unnecessary deaths. Offering a new queercrip model of (assisted) suicide, he invites us to imagine what could happen if we started thinking about (assisted) suicide from an anti-suicidist and intersectional framework. Baril provides a radical reconceptualization of (assisted) suicide and invaluable reflections for academics, activists, practitioners, and policymakers

    Forgotten Wishes: End of Life Documents for Trans People with Dementia at the Margins of Legal Change

    Researchers and community organizations have incited trans people to engage in end of life planning, including the preparation of legal documents to express their wishes regarding their gender identity (pronouns, appearance, etc.) in case of legal “incapacity” in the context of dementia. We contend that such end of life planning, and its associated documents, contain cisnormative and cognonormative presumptions, as they are based on a stable notion of gender identity that favors biographical continuity and they presume that the self pre-dementia is better equipped to make decisions than the self with dementia. We illustrate this argument using a hypothetical case study, elucidating the various forms of epistemic injustice that are shaped by and shape those presumptions. We conclude by offering reflections, based on an intersectional, trans-affirmative, crip-positive and age-positive approach, to encourage the agency of trans people living with dementia during their end of life

    This article is a presentation of Alexandre Kojève’s philosophy of law, exposed in his Esquisse d’une phénoménologie du droit (1981). Little attention has been paid to this work. So there is a gap that has to be filled with a critical reflection of its strengths. Among them, undoubtedly, we count the fact that Kojève is introducing a conception of international justice that casts a singular light on current debates about cosmopolitanism and globalization. According to this author, citizenship is the key element of the process of global expansion of the juridical sphere. In sum, Kojève’s philosophy is useful to reflect upon the contrast between the juridical and the political, which is the basis for all philosophy of law, in order to achieve world peace and international justice.Este artículo es una presentación de la filosofía del derecho de Alexandre Kojève contenida en su Esquisse d’une phénoménologie du droit (1981). La poca atención que dicha obra ha recibido es un vacío que debiera llenarse con una reflexión crítica de sus puntos fuertes. Entre ellos destaca una concepción de la justicia internacional que proyecta una luz muy singular sobre los actuales debates en torno a la globalización y el cosmopolitismo. A ojos de este autor, la ciudadanía es el elemento clave para aquilatar la expansión global de lo jurídico. En suma, Kojève aparece como un valioso referente en la labor de pensar la contraposición entre lo jurídico y lo político que está en la base de toda filosofía del derecho, con la aspiración al logro de la justicia internacional y la paz mundial en el horizonte

    Partimos da evolução histórica do consensualismo contratual salientando os principais carateres que, nos diversos momentos históricos, se foram evidenciando. Numa segunda etapa exploramos os fundamentos dogmáticos do modelo de transmissão contratual assumido pelo legislador e a sua viabilidade no sistema jurídico global, em particular, no direito dos valores mobiliários. Constatamos a crescente necessidade na prática mercantil e inevitabilidade no sistema jurídico global da admissibilidade da existência de contratos de compra e venda de natureza meramente obrigacional. Num terceiro momento desenvolvemos os principais aspetos do regime jurídico aplicável às ações tituladas nominativas fora do mercado regulado, em particular, os principais limites à transmissão, enquanto instrumentos/barreiras ao consensualismo contratual.We start from the historical evolution of contractual consensualism emphasizing the main aspects that, in different historical moments, were showing up. In a second stage we explore the dogmatic foundations of the transmission model contractual assumed by the legislator and its viability in the global legal system, in particular, in securities law. We note the growing need in commercial practice and inevitability in the global legal system the admissibility of the existence of contracts of sale purely obligatory. In the third stage we develop the main aspects of the legal regime applicable to nominative titled actions outside the regulated market, in particular, the main limits to the transmission, as instruments / barriers to contractual consensualism

    L’auteur analyse un axe identitaire sous-théorisé dans les approches féministes intersectionnelles francophones, soit l’identité de genre (cis/trans), pour favoriser les solidarités entre féministes et transactivistes. Son propos s’articule autour de la question suivante : quelles sont les différentes définitions féministes du sexe/genre et quelles implications politiques ont-elles pour penser les réalités trans? Pour y répondre, l’auteur propose une typologie de quatre paradigmes d’interprétation du sexe/genre. Après avoir présenté leurs caractéristiques, il montre leur influence sur les stratégies politiques mises en avant par les féministes qui s’en réclament. Puis il procède à une analyse des conséquences de l’adoption de ces paradigmes sur les alliances entre féministes et transactivistes. Si la thèse défendue est que le paradigme du constructivisme social subversif offre une conceptualisation plus positive des transidentités, l’auteur soutient cependant que les autres paradigmes ne peuvent être rejetés sans s’interroger préalablement sur leurs mobilisations, leurs transformations et leurs métissages par les militantes et les militants sur le terrain.The author examines an under-theorized identity axis in Francophone intersectional feminist approaches, gender identity (cis/trans), to promote solidarity between feminists and transactivists. His argument focuses on the following question : what are the different feminist definitions of sex/gender and their political implications on the conceptualization of trans realities? The author proposes a typology of four interpretive paradigms of sex/gender to answer this question. After presenting their characteristics, he shows their influence on political strategies favoured by feminists who subscribe to them. He then analyzes the consequences of adopting these paradigms on alliances between feminists and transactivists. While he defends the thesis that the paradigm of subversive social constructivism offers a more positive conceptualization of transidentities, he also argues that other paradigms cannot be disregarded without first questioning their mobilization, transformation, and hybridization by activists in the field.En este artículo se analiza un eje identidario sub-teorizado en los enfoques feministas interseccionales francófonos; es decir, la identidad de género (cis/trans), para favorecer la solidaridad entre las feministas y transactivistas. Gira en torno a la pregunta siguiente : ¿cuáles son las diferentes definiciones feministas del sexo/género y cuáles son las políticas que tienen para pensar las realidades trans? En respuesta, propongo una tipología de cuatro paradigmas interpretativos de sexo/género. Tras la presentación de sus características, voy a mostrar su influencia en las estrategias políticas formuladas por las feministas que la reclaman. Luego, voy a proceder a un análisis de las consecuencias de la adopción de estos paradigmas en las alianzas entre feministas y transactivistas.     El Libro de Alexandre es un texto de s. XIII, que se escribió en la España medieval. En este escrito, el autor pretende demostrar que, en el Alexandre, algunas de las situaciones que se ponen a prueba son aceptadas, pero eso no significa que el macedonio gane la prueba. El articulo esta dividido en tres apartados. En el primero, el autor da cuenta de la historia textual de la obra y también dedica ciertas líneas al Estado de la cuestión del texto; mientras que, en la segunda parte, nos guía a conceptos etimológicos de los términos prueba, evidencia y demás. En el tercer apartado se centra en algunas pruebas expuestas en el Libro de Alexandre.The Libro de Alexandre is a literary work, written during the medieval Spain. In this paper, the author tries to demonstrate that, carefully reading the L.A, some of the situations that are set as proves are accepted, but it does not mean that Alexander can be a victor. This paper is divided in three sections: firstly, the author tells the textual history of the L.A and, then, tries to update the State of art: on the other hand, in the second part, the author offers meanings about terms as: prueba and evidencia.
