PERTANGGUNGJAWABAN DIREKSI TERHADAP KEKAYAAN NEGARA YANG DIPISAHKAN DAN DITEMPATKAN PADA BADAN USAHA MILIK NEGARA DITINJAU DARI ASPEK HUKUM PERUSAHAAN
Badan Usaha Milik Negara (selanjutnya disingkat BUMN) merupakan
badan usaha yang memiliki banyak tujuan dalam pendiriannya. Tujuan
sebagaimana dimaksud dapat dilihat dalam ketentuan Undang-Undang No. 19
Tahun 2003 tentang Badan Usaha Milik Negara (selanjutnya dinsingkat UU
BUMN) Pasal 2 ayat (1) undang-undang ini menyebutkan bahwa:
“Maksud dan tujuan pendirian BUMN adalah :
a. Memberikan sumbangan bagi perkembangan perekonomian nasional pada
umumnya dan penerimaan negara pada khususnya;
b. Mengejar keuntungan;
c. Menyelenggarakan kemanfaatan umum berupa penyediaan barang dan/atau
jasa yang bermutu tinggi dan memadai bagi pemenuhan hajat hidup orang
banyak;
d. Menjadi perintis kegiatan-kegiatan usaha yang belum dapat dilaksanakan
oleh sektor swasta dan koperasi;
e. Turut aktif memberikan bimbingan dan bantuan kepada pengusaha
golongan ekonomi lemah, koperasi, dan masyarakat”
Sebagai badan usaha dalam pendirian dan pelaksanaan kegiatan BUMN
juga dibutuhkan modal yang tidak sedikit. Sebagai badan usaha yang dimiliki oleh
negara, modal pendirian dan penataan usaha BUMN sudah selayaknya berasal
dari kekayaan negara itu sendiri. Berkaitan dengan hal ini, maka ketentuan Pasal 4
Undang-Undang No. 19 Tahun 2003 tentang Badan Usaha Milik Negara
(selanjutnya disingkat dengan UU BUMN)telah mengakomodirnya

Berdasarkan uraian di atas, tidak heran pada saat ini muncul keinginan untuk
menciptakan sebuah formula tentang pengaturan terbaik dalam proses pengisian jabatan
Kepala Daerah. Pembatasan campur tangan pemerintah di daerah, kordinasi antar susunan
pemerintahan dan antar pemerintah daerah, efisiensi dana dalam proses pengisian sampai
kepada pertimbangan sosiologis masyarakat daerah adalah pertimbangan - pertimbangan
yang tidak boleh diabaikan dalam penyusuanan formula tersebut. Lebih jauh dari itu adalah
bagaimana supaya pemerintahan di daerah dapat berjalan dengan baik, demokratis dan dapat
meningkatkan kesejahteraan rakyat di daerah. Oleh karena itu juga maka Penulis bermaksud
untuk menganalisa semua permasalah di atas dan akan menuangkannya kedalam bentuk
skripsi dengan judul “PENGATURAN PENGISIAN JABATAN KEPALA DAERAH BERDASARKAN UNDANG-UNDANG DASAR NEGARA REPUBLIK INDONESIA TAHUN 1945”
Unilateral Termination of Employment by Employers Due to Urgent Violations Under Government Regulation No. 35 of 2021
Pasal ini dilatarbelakangi oleh ketentuan pemutusan hubungan kerja secara sepihak oleh pemberi kerja sebagaimana diatur dalam Peraturan Pemerintah Nomor 35 Tahun 2021 tentang Kontrak Kerja Waktu Tetap, Alih Daya, Jam Kerja, Waktu Istirahat, dan Pemutusan Hubungan Kerja. Berdasarkan ketentuan tersebut, pekerja/buruh tidak mempunyai kesempatan untuk membela diri apabila dituduh melakukan tindak pidana yang menjadi alasan pemutusan hubungan kerja karena alasan mendesak. Tujuan dari penelitian ini adalah untuk memahami pemutusan hubungan kerja (PHK) karena alasan mendesak menurut sistem hukum Indonesia dan proses penyelesaian pemutusan hubungan kerja berdasarkan alasan mendesak tersebut. Penelitian ini menggunakan pendekatan yuridis normatif dengan menggunakan data sekunder sebagai sumber utamanya. Penelitian ini merupakan penelitian deskriptif-analitis yang menggunakan pendekatan perundang-undangan. Temuan menunjukkan bahwa ketentuan pemutusan hubungan kerja karena alasan mendesak bertentangan dengan asas praduga tak bersalah. Konflik ini membuat para pekerja yang terkena pemutusan hubungan kerja secara sepihak kehilangan kesempatan untuk membela diri. Selain itu, Peraturan Pemerintah Nomor 35 Tahun 2021 tidak mengatur rehabilitasi pekerja yang diberhentikan jika kemudian muncul bukti yang menunjukkan bahwa mereka tidak bersalah..
 
Sanksi Pidana Bagi Pelaku Poligami dalam Kitab Undang-Undang Hukum Pidana (KUHP) Dalam Perspektif Hukum Islam dan Sistem Hukum Nasional
Polygamy marriages have been going on for a long time for some people in Indonesia. The practice of polygamy is usually also motivated by several factors such as household harmony, absence of offspring, biological reasons and so on. However, with the enactment of the Criminal Code through the concordance principle which has led to legal unification hitherto, the practice of polygamy which is carried out outside the provisions of the legislation is determined to be a crime that is threatened with a criminal sanction. In its continuation, this creates a lot of controversy to Indonesian people because polygamy is basically a sharia and something that has been going on for a long time in some Indonesian people. Therefore, criminal sanctions according to Article 279 of the Criminal Code paragraph (1) and (2) to polygamy actors need to be reviewed because it is not in line with the source of material law in Indonesia, namely Pancasila and protection of human rights in practicing religion in accordance with religion and belief. . Presidential Nomination in the Indonesian Legal System
The background to writing this article was oligarchic practices in the Presidential Election process of the Republic of Indonesia. This writing aims to determine the causes of oligarchic practices and the importance of restructuring the presidential nomination process in the General Election in Indonesia. This research uses normative juridical research by testing positive legal norms with various theories and provisions for drafting laws. From this research, it is known that the practice of orligarchy occurs because the requirement for presidential nominations must be through a political party, while the internal processes of political parties are often not transparent because decisions are often made only by elite groups or the general chairman. This is not in accordance with the spirit of deliberation and popular sovereignty as stated in the 4th Principle of Pancasila and UUD NRI 1945. Therefore, the provisions of Article 222 of Law No.7/2017 which contain provisions for presidential nomination must be made more stringent by including provisions for the nomination process that more transparent through opportunities for access and evaluation of the community as voters
PIDANA MATI BAGI PELAKU TINDAK PIDANA KORUPSI MENURUT SISTEM HUKUM DI INDONESIA
The development of Corruption Crimes has a widespread adverse impact on the lives of Indonesian people life. To stop this, it is needed to be taken a variety of extraordinary efforts including by implementing capital punishment for perpetrators, especially related to criminal acts of corruption that concern to many people that occur when the country is in danger. Even so, not all people agree with the application of capital punishment because it is considered to be conflict with Human Rights, the Constitution of the Republic Indonesia and Pancasila. To analyze these legal issues, various efforts can be taken such as seeing the meaning of the nature of human rights in the perspective of national and international law, interpreting legal norms using appropriate interpretation methods and seeing the existence of capital punishment in the perspective of religious law and customary law. Writing in this study uses a normative juridical approach with the type of data in the form of secondary data which comes from primary legal material and secondary legal material. Kedudukan Kejaksaan dan Pengisian Jabatan Jaksa Agung dalam Sistem Ketatanegaraan Indonesia
The Attorney General's Office of the Republic of Indonesia is a government institution that exercises state power in the field of prosecution and other powers based on law. Attorney General who is the leader and highest person in charge of the prosecutor's office who leads, controls the implementation of the duties and authorities of the prosecutor's office. As a law enforcement agency under the executive power and the position of Attorney General who is appointed, dismissed, and accountable to the President, this state institution is not independent in exercising its authority. This research uses normative legal research. The source of the data used in this thesis is collection through literature research, namely by examining secondary data in the form of books, laws and regulations, papers related to this writing. The results of this study conclude that the public prosecutor's office is in the executive realm to make this institution easy for executive power to intervene. Based on this research, the Attorney General's Office exercises authority related to judicial power, but this institution enters the executive realm and filling the position of Attorney General is the President's prerogative. Therefore, the authors recommend changes to the position of the Attorney General's Office and filling the position of Attorney General with changes to the constitution or changes to the prosecutor's law. This is to create an independent prosecutor's office in exercising its authority free from influence and interference from any power. The responsibility given by the state to the occurrence of forest and land fires so far has not been considered optimal. Whereas the state has responsibilities towards its citizens, one of which is in ensuring the rights of citizens to get a clean and healthy environment. The liability referred to arises from the legal relations between the countries as mentioned in the fourth alinia of the Preamble of the 1945 Constitution through the phrase "protecting the entire Indonesian nation and the whole of Indonesian blood". Whereas in the Islamic perspective it also regulates that the purpose of the state is to create benefit for its citizens. Therefore, various losses to citizens due to forest and land fires should have been the responsibility of the state.
