TINJAUAN HUKUM ISLAM TERHADAP AKAD RAHN PADA PEGADAIAN SYARIAH DI INDONESIA
No full textAbstrakPenelitian ini membahas tentang bagaimana akad rahn pada pegadaian syariah di Indonesia karena sangat banyak pendapat orang yang berkata bahwa pegadaian syariah itu sama saja dengan pegadaian konvensional dalam hal penerapan akad gadai emas dari situlah penulis melakukan penelitian mengenai hal tersebut. Pokok permasalahan skripsi ini yaitu bagaimana tinjauan hukum Islam terhadap akad rahn pada pegadaian syariah di Indonesia. Adapun sub bab masalah yang akan dikaji, yakni: 1) Bagaimana akad rahn di pegadaian syariah di Indonesia? 2) Bagaimana konsep akad rahn dalam Islam? Dalam menyelesaikan permasalahan tersebut dan analisis yang bersifat kajian kepustakaan, dengan menempatkan pendekatan normatif syar’i yaitu dimana dengan mengarah kepada pendekatan al-Qur’an dan hadits dan sumber Islam lainnya. Pada penerapan akad rahn di pegadaian syariah masih ada beberapa hal yang perlu diperhatikan, mulai dari denda keterlambatan, penggabungan 2 akad yang bertentangan dengan hadis Rasulullah saw. dan biaya ongkos penyimpanan pada pegadaian syariah.Kata Kunci : Hukum Islam, Pegadaian Syariah, Rahn AbstractThis research discusses how the rahn contract is at sharia pawnshops in Indonesia because there are so many people's opinions who say that Sharia pawnshops are the same as conventional pawnshops in terms of applying the gold pawn contract, that's where the author conducted research on this matter. The main problem of this thesis is how to review Islamic law on rahn contracts at sharia pawnshops in Indonesia. The sub-chapters of the problems that will be studied are: 1.) How is the rahn contract in sharia pawnshops in Indonesia? 2.) What is the concept of rahn contract in Islam? By placing a syar'i normative approach, namely where by leading to the approach of the Qur'an and hadith and other Islamic sources. In the implementation of the rahn contract at the sharia pawnshop, there are still several things that need to be considered, ranging from late fees, merging 2 contracts that contradict the hadith of the Prophet Muhammad and the cost of storage fees at sharia pawnshops.Keywords: Islamic Law, Rahn, Sharia Pawnsho

No full textThe dissertation dating back to 1934 on the Darmstadt Circle explores the phenomenon of the sentimental attitude in the 18th century. The author, Lilli Bechmann-Rahn, was the last Jewish woman to be awarded a doctoral degree at Erlangen University under National Socialism. According to national socialist racial policy she was stripped of her doctoral title few years later. This publication contains a reprint of the original thesis, a historical appreciation of Lilli Bechmann-Rahn, an acknowledgement of the scientific value of her dissertation, and biographical information.Die Dissertation aus dem Jahr 1934 über den Darmstädter Freundeskreis behandelt das Phänomen der Empfindsamkeit im 18. Jahrhundert. Die Autorin, Lilli Bechmann-Rahn, war die letzte Jüdin in der nationalsozialistischen Zeit, die an der Universität Erlangen promovierte. Im Zuge der nationalsozialistischen Rassenpolitik wurde ihr wenige Jahre darauf die Doktorwürde aberkannt. No full textProduk gadai emas syariah merupakan salah satu layanan perbankan syariah yang menggabungkan kebutuhan pembiayaan cepat dengan prinsip-prinsip hukum Islam, melalui akad Rahn dan Qardh. Produk ini memberikan alternatif pembiayaan yang aman, halal, dan bebas bunga bagi masyarakat yang membutuhkan dana mendesak, sekaligus menjamin keamanan penyimpanan aset emas. Keberhasilan implementasi produk ini sangat dipengaruhi oleh pemahaman nasabah terhadap akad, kualitas pelayanan petugas, transparansi biaya, serta prosedur penyimpanan yang dilakukan oleh pihak bank.
Penelitian ini bertujuan untuk mengetahui implementasi akad Rahn dan Qardh dalam transaksi gadai emas syariah di PT Bank Syariah Indonesia KC Tangerang Ciputat, mengidentifikasi tantangan yang dihadapi dalam penerapannya, serta menganalisis dampaknya terhadap tingkat kepuasan nasabah.
Metode penelitian yang digunakan adalah kualitatif deskriptif dengan pendekatan studi kasus. Data dikumpulkan melalui wawancara mendalam kepada enam orang nasabah, terdiri dari tiga pengguna akad Rahn dan tiga pengguna akad Qardh, dengan latar belakang pemahaman yang berbeda. Analisis dilakukan secara tematik dengan mengacu pada teori akad rahn dan qardh, prinsip perbankan syariah, serta fatwa DSN-MUI yang relevan.
Hasil penelitian menunjukkan bahwa implementasi kedua akad di BSI KC Tangerang Ciputat telah sesuai dengan prinsip syariah. Proses layanan berlangsung cepat, sederhana, dan transparan dalam penentuan biaya ujrah maupun biaya pemeliharaan. Nasabah merasa aman dengan prosedur penyimpanan emas, adanya bukti resmi, dan perlindungan asuransi. Tantangan yang dihadapi meliputi rendahnya literasi keuangan syariah, keterbatasan sarana edukasi, kebutuhan inovasi digital, serta persepsi awal terkait keamanan penyimpanan emas. Dampak penerapan akad Rahn dan Qardh terhadap kepuasan nasabah sangat positif, ditunjukkan oleh seluruh responden yang menyatakan puas dan bersedia menggunakan kembali layanan ini.
Kesimpulannya, penerapan akad Rahn dan Qardh pada produk gadai emas syariah di BSI KC Tangerang Ciputat tidak hanya sesuai dengan prinsip syariah, tetapi juga mampu memberikan layanan yang efektif, efisien, dan memuaskan. Perbaikan pada aspek edukasi dan pengembangan inovasi layanan diharapkan dapat semakin mengoptimalkan pemanfaatan produk ini di masa mendatang

No full textBackground: Multiple sclerosis (MS) is an inflammatory and degenerative disease of the central nervous system with an increasing worldwide prevalence. Since 1993, more than 15 disease-modifying immunotherapies (DMTs) have been licenced and have shown moderate efficacy in clinical trials. Based on the heterogeneity of the disease and the partial effectiveness of therapies, a personalised medicine approach would be valuable taking individual prognosis and suitability of a chosen therapy into account to gain the best possible treatment effect.
The primary objective of this review is to assess the differential treatment effects of all approved DMTs in subgroups of adults with clinically isolated syndrome or relapsing forms of MS. We will analyse possible treatment effect modifiers (TEM) defined by baseline demographic characteristics (gender, age), and diagnostic (i.e. MRI measures) and clinical (i.e. relapses, disability level) measures of MS disease activity. /
Methods: We will include all published and accessible unpublished primary and secondary analyses of randomised controlled trials (RCTs) with a follow-up of at least 12 months investigating the efficacy of at least one approved DMT, with placebo or other approved DMTs as control intervention(s) in subgroups of trial participants. As the primary outcome, we will address disability as defined by the Expanded Disability Status Scale or multiple sclerosis functional composite scores followed by relapse frequency, quality of life measures, and side effects. MRI data will be analysed as secondary outcomes.
MEDLINE, EMBASE, CINAHL, LILACS, CENTRAL and major trial registers will be searched for suitable studies. Titles and abstracts and full texts will be screened by two persons independently using Covidence. The risk of bias will be analysed based on the Cochrane “Risk of Bias 2” tool, and the certainty of evidence will be assessed using GRADE.
Treatment effects will be reported as rate ratio or odds ratio. Primary analyses will follow the intention-to-treat principle. Meta-analyses will be carried out using random-effects models. /
Discussion: Given that individual patient data from clinical studies are often not available, the review will allow to analyse the evidence on TEM in MS immunotherapy and thus support clinical decision making in individual cases. /
