    La dialettica tra legalità e tipicità penale, che da sempre accompagna la (ri)definizione dei confini tra obblighi positivi e obblighi di incriminazione nel sistema penale multilivello, sembra trovare, anche nel contrasto alla violenza di genere e domestica, un approccio decisamente orientato alla riproposizione di schemi caratterizzati da affievolimento di garanzie. Il diritto penale, qui, del “nemico violento”, continuando a non perdere, infatti, il suo carattere costantemente simbolico ed ineffettivo, impone alla politica criminale “reticolare” di razionalizzare l’esistente nella ricerca di una risposta di sistema. Essa, accanto ad un diritto penale capace di prendere coscienza di norme incriminatrici in funzione di “spia” di personalità difettose, deve saper trovare, anche nel rigoroso ossequio di una prevenzione integratrice, le ragioni per cui giungere alla inversione della normale successione di pena e misura di sicurezza, e tutto ciò tanto nell’ambito di un binomio sanzionatorio unico integrato quanto, in via complementare, nella ricerca di qualcosa di meglio del diritto penale

    The purpose of this contribution is to analyze, using the feminist method in international law, migrations as a consequence of climate change or other phenomena characterized by the progressive deterioration of the environment (slow violence). The contribution, after explaining the notions of “climate violence” and “gendered migrations”, will start by the pivotal analysis of the issue provided by some international bodies, then explain what an ecofemi- nist method in international law, also theoretically, means. It will then apply an already developed argument called “gender-sensitive protection par rico- chet” to cases of migration as a consequence of climate change or slow vio- lence, through an innovative reading of the Teitiota case, decided by the United Nations Human Rights Committee on October 24, 2019

    Le evoluzioni che hanno caratterizzato l’era post-Lisbona hanno interessato anche l’interpretazione e l’applicazione giurisprudenziale della regola del ne bis in idem, ossia il «diritto di non essere giudicato o punito due volte per lo stesso reato», sancito dall’articolo 50 della Carta dei diritti fondamentali dell’Unione europea. L’analisi che segue mira ad evidenziare come l’assenza di una totale convergenza tra l’orientamento della Corte di giustizia e quello della Corte EDU in tema di ne bis in idem produrrà l’inevitabile effetto di disorientare la giurisprudenza interna, incapace di pervenire a soluzioni univoche nell’accertamento dei criteri di applicazione della garanzia di cui all’articolo 50 della Carta. Sicché, nel tentativo di facilitare il giudice nazionale in ordine alla valutazione della operatività del principio del ne bis in idem, la Corte dell’Unione lascerà, di fatto, uno spazio di manovra solo “apparente” al giudice di merito

    The dramatic nature of international events concerning the protection of the individual’s fundamental human rights, and specifically the protection of migrant women’s right to health, stimulates some reflections on the possible protection of this right in the domestic and international legal sphere. It notes in this context the duality of health as a public good, on the one hand, within the framework of both domestic and international law, and, on the other, as an individual right, in relation to and potentially in conflict with other disciplines, e.g. freedom of movement, or freedom of trade and investment. The regulatory framework is somewhat fragmented also because ever since the need to protect the right to health emerged, the complexity of the interaction of the public sphere with the nature of an individual right has become evident; while it is clear that the needs underlying the collective dimension can also compress individual expectations, the prevalence of the public sphere connotation remains, according to which the State is the natural environment within which to benefit from the right to health

    Going Beyond Counting First Authors in Author Co-citation Analysis

    The present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed

    “Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship

    Appropriate Similarity Measures for Author Cocitation Analysis

    We provide a number of new insights into the methodological discussion about author cocitation analysis. We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature.
