Lo sviluppo del marchio del patrimonio europeo*
No full textCultural heritage is a topic with many dimensions, often complementary to each other. Even within the European Union, the topic is developed from different perspectives, partly because the European Union’s involvement in the field of culture has developed gradually over the years and with different actions. After briefly outlining some of the different European initiatives, this paper aims to provide an analysis of one of the measures adopted by the European Union: The European Heritage Label. This is a rather recent initiative that shows how the member States are fully aware of the potential but also of the limitations there are in managing heritage at the European level; for this specific reason, in the Decision by which the European Heritage Label was adopted, there is an explicit reference to the 1972 UNESCO World Heritage Convention, a crucial tool in this field. Starting from a more general approach inherent to the label, the selected sites in Italy will then be analysed specifically. Through the study of these heritages, it is possible to have a tangible and practical approach to what is considered cultural heritage within the European Union, which therefore deserves to be protected and disseminated
Il traffico illecito dei beni culturali: l’evoluzione dei rimedi internazionali
No full textNel presente lavoro verrà affrontata la tematica del traffico illecito dei beni culturali. Tematica che si è sviluppata nel corso degli anni a causa del progressivo aumento delle situazioni problematiche che coinvolgevano, e tuttora coinvolgono, diversi Paesi, seppur con ruoli differenti. Senza dubbio numerosi passi avanti sono stati fatti, grazie alla sempre maggiore collaborazione dei vari Stati, con l’adozione delle diverse convenzioni. Tuttavia, si è ancora lontani dalla predisposizione di una disciplina che sia in grado di contemplare le molteplici criticità legate al tema e che sia anche armoniosa.
In questa analisi si prende avvio da una trattazione generale di due fondamentali convenzioni in materia di patrimonio culturale: la Convenzione concernente le misure da adottare per interdire e impedire l’illecita importazione, esportazione e trasferimento di proprietà di beni culturali del 1970 e la successiva Convenzione UNIDROIT su beni culturali rubati o illecitamente esportati del 1995. Nel lavoro saranno messe in luce le peculiarità di ciascuna delle due discipline e saranno evidenziati anche eventuali aspetti critici o in comune tra i due testi.
Proprio nello stesso periodo in cui venivano adottate le convenzioni sopracitate, infatti, la Comunità economica europea prima, e l’Unione europea poi, introducevano importanti strumenti per adeguare il proprio diritto ad esse e più in generale per contrastare questi traffici illeciti. Infine, un paragrafo è stato dedicato all’analisi di quattro accordi riguardanti nello specifico il nostro Paese. Si tratta di rilevanti provvedimenti bilaterali adottati nel corso degli anni con gli Stati Uniti, la Repubblica Popolare Cinese (RPC), con la Repubblica Federale Svizzera (RFS) e con gli Emirati Arabi Uniti (EAU)

The European Approach to Culture: the European Heritage Label

L’autogoverno dei beni comuni: l’uso civico
No full textNel contributo si svolgono brevi considerazioni sui possibili rapporti tra la nozione di bene comune (urbano) e quella di usi civici. In primo luogo, si tratteggiano i caratteri delle situazioni giuridiche soggettive imputate a una collettività territoriale: non solo gli usi civici (ossia le proprietà collettive o demaniali), ma anche gli altri diritti reali; si precisano poi le differenze che sussistono tra essi e i c.d. diritti d’uso su beni pubblici. Si esaminano poi le più recenti evoluzioni normative e giurisprudenziali in materia di usi civici . Dato che queste premesse dovrebbero dimostrare che nel diritto vigente i beni comuni urbani non sono (né possono essere) oggetto di diritti collettivi in senso tecnico, si tratteggiano i possibili contenuti di una legge che renda pienamente utilizzabile la categoria dei diritti collettivi per alcuni beni comuni. Si evidenzia poi come la nozione di uso pubblico possa essere utile in questo ambito, specie alla luce dell’idea “forte” di autonomia locale per come è stata disegnata dalla riforma costituzionale del 2001 (ma non sempre rispettata dal legislatore e dagli stessi amministratori). La conclusione è che il tema dei beni comuni urbani non chiama in causa tanto “un altro modo di possedere” quanto “un altro modo di amministrare”

Going Beyond Counting First Authors in Author Co-citation Analysis

counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings
are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that
only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into
account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed
Variations on the Author
Full text link“Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship
