This book examines, from a contemporary research perspective, various dimensions and questions of auditing and sustainability assurance, which also relate to issues of management and corporate governance. These three perspectives – sustainability, management and corporate governance – run through the entire work and serve as its thematic focus areas. The book consists of 15 peer-reviewed research articles. This multidisciplinary yet practical volume covers perspectives from business economics, administrative sciences, and law. The articles are divided into two sections: auditing and sustainability. The first section takes a broad look at the different dimensions of assurance and their development costs, especially from the perspective of management and corporate governance. The focus is on good governance and its components. In the second section, the focus is on sustainability reporting, and various issues related to the management and assurance of sustainability information are examined
Työnantajan työturvallisuusvastuun rajoittuminen ja sen käytännön merkitys
Työsuojelu liittyy vahvasti ihmisten terveyteen ja turvallisuuteen, ja se koskettaa kaikkia työelämässä mukana olevia. Työsuojelun käsite on nykyään laaja, ja se sisältää tapaturmien torjunnan ja työntekijöiden suojelun lisäksi ajatuksia muun muassa työympäristön jatkuvasta kehittämisestä. Työsuojelun taustalla voidaan nähdä vaikuttavan myös yrityksen toiminnan taloudellisuuden ja kannattavuuden näkökulmat. Näillä yritystaloudellisilla näkökulmilla on merkittävä asema kannustimena kohti työelämän ja työolojen kehittämistä.
Yrityksen kannattavuudesta vastaavat suurelta osin työnantaja ja sen edustajina toimivat esimiehet. Samat tahot ovat päävastuussa myös työsuojelulainsäädännön noudattamisesta työnantajan toiminnassa. Kysymys siitä, kuka vastaa työturvallisuudesta, on kuitenkin monitahoinen ja tapauskohtainen. Vastuun kohdentumista arvioitaessa merkitystä on erityisesti eri tahojen asemilla ja toimivaltuuksilla. Vastuuseen voidaan asettaa jokainen, joka on laiminlyönyt muun muassa työturvallisuuslaissa (738/2002) asetettuja velvollisuuksiaan.
Tietyillä perusteilla työnantajan vastuuta voidaan myös vähentää ja rajoittaa. Tässä pro gradu -tutkielmassa on ennen kaikkea kyse juuri vastuun kohdentumis-, rajoittumis- ja laajuuskysymysten selvittämisestä. Tutkielman päätutkimuskysymykseen, millainen on vastuun rajoittumisen käytännön merkitys, pyritään vastaamaan tutkielman alun teoriaosaa seuraavassa tutkimusosassa. Rajoittumisen ilmenemistä käytännössä selvitetään oikeuskäytännöstä tehdyllä tutkimuksella. Tutkimuksen aineisto koostuu korkeimman oikeuden ja Suomen hovioikeuksien ratkaisukäytännön työturvallisuusrikostapauksista, joissa sovellettavaksi tulee uusi työturvallisuuslaki. Tapausten tilastoinnin pohjalta laskettujen prosenttiosuuksien ja todennäköisyyksien pohjalta tehdään johtopäätöksiä siitä, millainen painoarvo työnantajan vastuulla lopulta on.
Tutkielmassa tehdystä tutkimuksesta selviää, että viisi kuudesta työturvallisuusrikostapauksesta johtaa työnantajan vastuun toteamiseen ja vastuuseen asettamiseen. Aineistosta laskettu todennäköisyys sille, että työnantajan työturvallisuusvastuuta rajoitetaan, on 0,241. Todennäköisyys sille, että työnantajan vastuu rajoittuu kokonaan, eli että hän vapautuu työturvallisuusrikossyytteestä, on 0,130. Työnantajan työturvallisuusvastuu näyttäisi siis tutkimuksenkin perusteella olevan laaja ja rajoittuvan käytännössä melko harvoin.
Tutkielman lopussa esitelty teoreettinen malli työturvallisuuden huomioimisen neljästä tasosta on syntynyt yhdistämällä toisaalta oikeuskäytännön pohjalta esiinnousseita vinkkejä siihen, miten työpaikan työturvallisuudesta tulisi huolehtia, ja toisaalta esimiestyötä käsittelevän kirjallisuuden esittelemiä tapoja siihen, miten työturvallisuutta tulisi johtaa. Mallin neljä tasoa työturvallisuuden huomioimiseksi ovat lakia noudattamaan pyrkivä taso, ohjeistava ja tarkkaileva taso, huolehtiva ja hyvinvointiin panostava taso sekä keskustelun ja yhteiseksi kokemisen taso.
