    Efektivitas Penegakan Hukum pada Pembatasan Usia Nikah di Indonesia dalam Perspektif Aliran Filsafat Sociological Jurisprudence

    Underage marriages still occur frequently in Indonesia, although regulations governing the minimum age of marriage have been stipulated in Law Number 16 of 2019 concerning Amendments to Law Number 1 of 1974. This study aims to analyze the effectiveness of marriage age limit regulations from the perspective of legal philosophy which focuses on the theory of sociological jurisprudence which sees law as a reflection of social norms in society. Using qualitative research based on literature study, this study examines various aspects of the regulation, and analyzes the influence of social norms on its implementation. The results of the analysis show that this regulation has not been fully effective due to a mismatch between the written law and social values that still support early marriage. Structural and cultural factors also influence the implementation of this regulation. In the perspective of sociological jurisprudence, the law will succeed if it is in harmony with the social values that live in society and law as social engineering must be able to balance individual, social and public interests. For this reason, a more comprehensive approach is needed, including tightening the regulation of marriage age limits, education, and empowerment, so that the law is not only a formal rule, but also a catalyst for social change that is effective and widely accepted by the community. Pernikahan di bawah umur masih sering terjadi di Indonesia, meskipun regulasi yang mengatur batas usia minimal pernikahan telah ditetapkan dalam Undang-Undang Nomor 16 Tahun 2019 tentang Perubahan atas Undang-Undang Nomor 1 Tahun 1974. Penelitian ini bertujuan untuk menganalisis efektivitas regulasi batas usia pernikahan dari perspektif filsafat hukum yang berfokus pada teori aliran sociological jurisprudence yang melihat hukum sebagai cerminan dari norma-norma sosial dalam masyarakat. Dengan penelitian kualitatif yang berbasis studi pustaka, penelitian ini menelaah berbagai aspek dari regulasi tersebut, serta menganalisis pengaruh norma sosial terhadap penerapannya. Hasil analisis menunjukkan bahwa regulasi ini belum efektif sepenuhnya karena adanya ketidaksesuaian antara hukum tertulis dan nilai sosial yang masih mendukung pernikahan dini. Faktor struktural dan kultural juga turut memengaruhi implementasi aturan ini. Dalam perspektif sociological jurisprudence, hukum akan efektif jika selaras dengan nilai-nilai sosial yang hidup di masyarakat dan hukum sebagai social engineering harus mampu menyeimbangkan kepentingan individu, sosial, dan publik. Untuk itu, diperlukan pendekatan yang lebih komprehensif, termasuk memperketat regulasi batas usia pernikahan, edukasi, dan pemberdayaan, agar hukum tidak hanya sekadar aturan formal, tetapi juga menjadi katalisator perubahan sosial yang efektif dan diterima masyarakat secara luas

    This research aims to design an ideal Personal Data Protection Implementing Agency (LPPDP) model for Indonesia, by referring to the best practices of data protection agencies in other countries, particularly Singapore. Increasing digital activities and cyberattacks, especially in the government sector, have highlighted the urgency of personal data protection in Indonesia. Although the Law on Personal Data Protection has been passed, the absence of LPPDP as an independent oversight institution is an obstacle to data protection law enforcement and supervision. Through a normative and comparative legal approach, this research compares the design of LPPDP with the Personal Data Protection Commission (PDPC) and Smart Nation and Digital Government Group (SNDGG) in Singapore. The results show that LPPDP needs to be established as an independent institution with strong authority in law enforcement and comprehensive supervision. The PDPC and SNDGG models can be a reference in establishing an effective institution in Indonesia. Thus, the establishment of LPPDP is expected to improve personal data protection, provide legal certainty, and build public trust in data governance in Indonesia.Penelitian ini bertujuan untuk merancang model Lembaga Pelaksana Pelindungan Data Pribadi (LPPDP) yang ideal bagi Indonesia, dengan merujuk pada praktik terbaik lembaga perlindungan data di negara lain, khususnya Singapura. Meningkatnya aktivitas digital dan serangan siber, telah menyoroti urgensi perlindungan data pribadi di Indonesia. Meskipun Undang-Undang Pelindungan Data Pribadi telah disahkan, absennya LPPDP sebagai lembaga pengawas yang independen menjadi kendala dalam penegakan hukum dan pengawasan perlindungan data. Melalui penelitian hukum normatif dengan pendekatan komparatif dan peraturan perundang-undangan, penelitian ini membandingkan rancangan LPPDP dengan Personal Data Protection Commission (PDPC) dan Smart Nation and Digital Government Group (SNDGG) di Singapura. Hasil penelitian menunjukkan bahwa LPPDP perlu dibentuk sebagai lembaga independen dengan kewenangan yang kuat dalam penegakan hukum dan pengawasan menyeluruh. Model PDPC dan SNDGG dapat menjadi acuan dalam membentuk lembaga yang efektif di Indonesia. Dengan demikian, pembentukan LPPDP diharapkan dapat meningkatkan pelindungan data pribadi, memberikan kepastian hukum, dan membangun kepercayaan publik terhadap tata kelola data di Indonesia

    Implikasi Klausula Eksonerasi terhadap Perlindungan Konsumen dalam Kontrak Financial Technology Peer-to-Peer Lending

    This article discusses the impact of the implementation of exoneration clauses in fintech P2P lending service contracts on the imbalance of risk between lenders and service providers. Fintech P2P lending has grown rapidly in Indonesia, but standard clauses, especially those containing exoneration clauses, can create a risk imbalance. The Consumer Protection Act and OJK regulations prohibit unfair standard clauses. This article identifies that standard clauses in service agreements often place an unequal burden of risk, particularly related to credit and default risks, which the lender entirely bears. The principle of consensualism, which emphasizes the agreement between parties, becomes irrelevant when there is an imbalance of positions. Legal protection for lenders is considered weak, and penalties are more administrative. The article concludes that regulatory adjustments and an emphasis on consumer protection principles are needed to achieve a fairer risk balance in the fintech P2P lending industry. Artikel ini membahas klausula eksonerasi dalam  fintech peer to peer (P2P) lending di Indonesia, dengan fokus pada dampaknya terhadap hak dan perlindungan konsumen serta langkah-langkah untuk meningkatkan perlindungan hukum. P2P lending, sebagai salah satu bentuk layanan fintech yang semakin populer, menawarkan akses pembiayaan yang mudah bagi masyarakat, namun sering kali mencantumkan klausula eksonerasi yang mengalihkan tanggung jawab risiko gagal bayar kepada konsumen, sehingga menimbulkan ketidakseimbangan hak antara konsumen dan penyedia layanan. Penelitian ini bertujuan menganalisis karakteristik dan penerapan klausula eksonerasi dalam kontrak P2P lending, dampaknya terhadap hak dan keamanan konsumen, serta upaya peningkatan perlindungan hukum bagi konsumen. Penelitian ini merupakan studi pustaka yang menggunakan metode kualitatif dengan pendekatan yuridis normatif dan pendekatan perundang-undangan yang dilakukan untuk menelaah aturan yang berlaku, seperti Undang-Undang Perlindungan Konsumen dan peraturan OJK terkait layanan fintech. Hasil penelitian menunjukkan bahwa klausula eksonerasi dalam kontrak P2P lending cenderung melemahkan posisi hukum konsumen, meningkatkan risiko finansial, dan mengurangi kepercayaan terhadap industri fintech. Maka, direkomendasikan adanya pembaruan regulasi, pengawasan intensif, dan edukasi hukum bagi konsumen sebagai langkah-langkah untuk memperkuat perlindungan konsumen dalam kontrak digital fintech

    Going Beyond Counting First Authors in Author Co-citation Analysis

    The present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed.     “Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship

    Appropriate Similarity Measures for Author Cocitation Analysis

    We provide a number of new insights into the methodological discussion about author cocitation analysis. We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature.     Dispelling the Myths Behind First-author Citation Counts

    We conducted a full-scale evaluative citation analysis study of scholars in the XML research field to explore just how different from each other author rankings resulting from different citation counting methods actually are, and to demonstrate the capability of emerging data and tools on the Web in supporting more realistic citation counting methods. Our results contest some common arguments for the continued use of first-author citation counts in the evaluation of scholars, such as high correlations between author rankings by first-author citation counts and other citation counting methods, and high costs of using more realistic citation counting methods that are not well-supported by the ISI databases. It is argued that increasingly available digital full text research papers make it possible for citation analysis studies to go beyond what the ISI databases have directly supported and to employ more sophisticated methods

    We have done our best to complete the author checklist relating to the use of animals in the hut study. Note that the objective for the hut study was to evaluate the IRS treatment applications for residual efficacy against Anopheles mosquitoes, including the local An. coluzzii mosquito population. Cows were only used to attract mosquitoes into the huts and no tests were carried out directly on the cows. The author checklist is intended for use with studies where experiments are carried out on animals, which is why we have had such difficulty in completing this for the hut study, as many of the questions do not relate to how the cows were used
