    This research is driven by the issue of widespread violations of intellectual property rights, which have occurred due to insufficient involvement of the Regional Government in intellectual property protection. Unfortunately, legislation concerning intellectual property remains incomplete, posing challenges for local governments in implementing effective protection measures. The objectives of this research are twofold: first, to analyze the role of the Regional Government in providing intellectual property protection; second, to formulate regional-level intellectual property regulations for greater coherence. This study employs a normative juridical approach with a statutory and conceptual framework. The research findings indicate the following: Firstly, despite having authority over intellectual property protection, the Regional Government faces challenges due to the partial nature of intellectual property laws and regulations—comprising at least six statutes. This complexity impedes the Regional Government's ability to comprehend, formulate, and enforce laws related to intellectual property. Therefore, harmonization is essential. Secondly, the harmonization of intellectual property regulations at the regional level involves the Regional Government conducting: a) an inventory of existing intellectual property laws and regulations; b) analysis, evaluation, and harmonization of their content, which will be incorporated into Regional Regulations on Intellectual Property Protection. These regulations must be grounded in a robust philosophical and sociological framework

    The Shift in the Legal Politics of Regulating the General Principles of Good Governance in Indonesian Legislation

    This article aims to analyze the shift in the form of legal politics in implementing the General Principles of Good Governance (AUPB) in Indonesia, including its legal consequences. With the explicit mention of AUPB in the new Law on Government Administration, this becomes an interesting topic from a legal and political perspective. Before the enactment of Law Number 30 of 2014 concerning Government Administration, the regulation of the General Principles of Good Governance (AUPB) was still abstract and unclear in its direction and implementation. This research is a normative juridical research using a statutory approach. The findings of this research reveal that the shift in the legal politics of AUPB in Indonesia through Law Number 30 of 2014 concerning Government Administration has shifted the format of legal politics in Indonesia. This shift has had a positive influence on the development of legal politics in Indonesia, including: a) making the status of principles into concrete legal norms; b) making it easier for the courts to adjudicate an action by administrative officials; c) facilitating control of administrative actions; d) simplifying public control; e) emphasizing the importance of supervision of official actions; f) guarantee civil rights; g) prevent government arbitrariness against civilian

    Transformation Model of Institutional Arrangements of Indigenous People To Become Customary Villages: Experiences From Indonesia

    Objective: this research is motivated by the problem of Law Number 6 of 2014 concerning Villages (Village Law), which forces indigenous people (MHA) to merge and refer to the nomenclature "Customary Village" if they want to be recognized by the state. It is feared that such an arrangement will fail to recognize MHA. This research aims first to analyze the transformation model of the institutional arrangements of the Baduy, Tengger, and Minangkabau indigenous peoples to become Customary Villages. Second, to analyze the Regional Government's policy strategy in creating an inclusive region for MHA.   Methods: the focus of this research will be studied using normative research methods and statutory and conceptual approaches.   Conclusions: this research concludes that first, the transformation model of the institutional arrangements of the Baduy, Tengger, and Nagari indigenous peoples to become Customary Villages varies in form due to having different philosophical, sociological, juridical, and political backgrounds. a) Baduy MHA is transformed into a hybrid form because it adopts the concept of a modern village and customary simultaneously; b) MHA Tengger is transforming into a modern village but is working again as a Customary Tourism Village. c) Minangkabau MHA has been fully transformed into a customary village. Second, the Regional Government's policy strategy in creating an inclusive region for MHA can be in the form of adjusting the needs and degree of recognition and protection desired by MHA.     This research has two problem formulations, First, how the Constitutional Court's construction in giving consideration to "open legal policy"; Second, what is the urgency of the Constitutional Court's reconstruction in giving consideration to"open legal policy"? This research uses a normative juridical study using the statutory and conceptual approach. The results of this study are: First, that is a lack of clarity and consistency from the Constitutional Court in determining benchmarks for open legal policy considerations. Second, there are new concept been proposed: a) applying the doctrine of "political question"; b) The Constitutional Court still tests a norm based on formal and substantial requirements. The advice given is that Constitutional Court should take a position in accordance with the reconstruction proposed in this study

    Sulit dipungkiri bahwa kontestasi antara peran negara dan kontribusi nilai hukum Islam menjadi diskursus yang selalu menarik. Terlebih dalam sistem ketatanegaraan Indonesia pasca reformasi, Mahkamah Konstitusi (MK) memiliki posisi penting sebagai “arbiter” antara Negara dan Hukum Islam. Penelitian ini memiliki rumusan yang menari, pertama, apa saja nilai hukum Islam dalam Negara berdasar Putusan MK?; kedua, bagaimana klasterisasi teori pemberlakuan nilai Hukum Islam dalam Negara berdasar Yurisprudensi Putusan MK? Penelitian ini merupakan penelitian hukum normatif. Hasil Penelitian menunjukkan bahwa, pertama, nilai hukum Islam dalam beberapa putusan MK yakni nilai kemaslahatan, nilai maqashid syari’yah (tujuan syariah), nilai sadd az-zari`ah (pencegahan) yang baik secara langsung maupun tidak langsung dirujuk oleh MK. Kedua, klasterisasi teori pemberlakuan nilai Hukum Islam dalam Negara berdasar Yurisprudensi Putusan MK yakni 5 putusan dari 7 putusan MK menggunakan teori eksistensi, 1 putusan MK secara subtansial  menggunakan teori eksistensi tetapi secara formal menggunakan teori receptie, sedangkan hanya 1 putusan MK yang menggunakan teori receptie secara murni sepanjang tahun 2007 hingga 2017

    Penelitian ini didasarkan atas fenomena menurunnya partisipasi masyarakat dalam proses pemilihan umum (pemilu) di Indonesia. Penelitian ini memiliki rumusan masalah, pertama, apa urgensi hak memilih dalam prespektif kaidah mashlahah mursalah di Indonesia?; kedua.  bagaimana konsep rekonstruksi hak memilih dalam prespektif kaidah mashlahah mursalah di Indonesia?. Penelitian merupakan penelitian hukum normatif dengan menggunakan 3 (tiga) model pendekatan yang terdiri atas pendekatan undang-undang (statute approach), pendekatan konseptual (conceptual approach) dan pendekatan kasus. Hasil dari penelitian ini menyatakan bahwa urgensi rekonstruksi hak memilih yaitu: pertama, guna meraih manfaat (jalbul mashalahah) bahwa wakil rakyat yang dipilih di parlemen adalah benar-benar hasil aspirasi rakyat. Kedua, mencegah madharat (dar-ul mafsadah) menurunnya partisipasi rakyat dalam penyelenggaraan negara yang dikhawatirkan merusak negara. Konsep rekonstruksi hak memilih dengan menjadikan makna “hak memilih” dalam konstitusi diartikan dengan “negara memberikan aksesibilitas yang layak dalam pemilu” dan mengatur kewajiban memilih dalam pemilu dan pemilihan presiden (pilpres). Sanksi dapat diberikan kepada pelanggar berupa denda proporsional yaitu disesuaikan dengan konsep pajak bagi warga negara yang tidak memilih. Hasil denda dapat dialokasikan untuk operasional pemilu. Saran yang dapat diberikan kepada DPR dan presiden adalah untuk merevisi peraturan perundang-undangan yang berkaitan dengan hak memilih dengan merekonstruksi makna “hak memilih” dalam konstitusi diartikan dengan “negara memberikan aksesibilitas yang layak dalam pemilu” dan mengatur kewajiban memilih dalam Pemilu dan Pilpres

Rumusan masalah penelitian ini pertama, Bagaimana penyelesaian sengketa perbuatan melawan hukum penguasa oleh peradilan administrasi di Indonesia?, kedua, Bagaimana problematik dan rekonstruksi penyelesaian sengketa perbuatan melawan hukum penguasa dalam Peraturan Mahkamah Agung Nomor 2 Tahun 2019 oleh peradilan administrasi di Indonesia?, hasil dari penelitian ini yaitu: pertama, penyelesaian sengketa perbuatan melawan hukum oleh penguasa diatur dalam Undang-Undang Nomor 30 Tahun 2014, Surat Edaran MA RI No. 4 Tahun, serta Perma 2/2019.     Barriers to Local Government Legal Policy in Fulfilling Social Security for Vulnerable Workers

    This study examines, first, the barriers of the position of the Regional Government and the character of vulnerable workers in social security for vulnerable workers. Second, to formulate legal policies that can be taken by the Regional Government in providing social security for vulnerable workers. The study uses a normative legal method and a 2 (two) model approaches consisting of a statutory approach and a conceptual approach. The results of the study conclude, first, the position of the Regional Government in social security for vulnerable workers is still regulated abstractly and partially. However, in general, based on the analysis of several regulations above, the Regional Government has the authority to organize social security for vulnerable workers. The criteria for vulnerable workers are economically and socially vulnerable, vulnerable in terms of work risks and vulnerable to job loss. The Regional Government needs to provide social security for vulnerable workers because they have double vulnerabilities. Second, the regional legal policies that can be taken in providing social security for vulnerable workers are: a) harmonizing laws and regulations both vertically and horizontally; b) determining the form of the legal policy basis and the content of the material in providing social security for vulnerable workers; c) determining the criteria for vulnerable workers and participation in employment social security; d) measuring the amount of financing needed

    The Relativity in the Absolute Authority of the Central Government in Religious Affairs

    The legal policy of the regional government, post-political reform, puts religious affairs under the absolute administrative authority of the central government. However, the development of society requires religious affairs to also be taken care of by the regional government. We argued that there is relativity in the absolute administrative affairs of the central government authority in the scope of religion. This research aimed to analyze and identify the form of relativity in the absolute administration of the central government in religious affairs. Second, the advantages and disadvantages of the absence of certainty related to the absolute administration of the central government in religious affairs were discussed. The method used in the study was legal doctrinal research with statutory and conceptual approaches. The results of the study concluded that the implementation of absolute government administration in the field of religion turned out to be relative, with the involvement of the regional government in managing and regulating religious affairs. This occurs in the affairs of Islamic boarding schools, hajj and umrah, zakat, and the maintenance of religious harmony. Second, there are advantages and disadvantages to the involvement of regional governments in carrying out religious affairs. Among the advantages, namely the financial burden and the activities of the central government in the administration of religious affairs can be assisted by the regional government budget. The weakness was in the regulation and implementation of the absolute government administration in religious affairs by regional governments due to a lack of understanding of the development of government affairs.
