Peluang dan Tantangan Formulasi Metode Studi Islam
In speaking of Islamic studies, we need to remember two things. First is the approach by which we elaborate certain point from certain perspective. In Islamic studies—like in any other studies—approaches vary. Different approaches would bring different conclusions. However, as long as an approach is academically sound and acceptable and meets all standards required, any conclusion resulted thereon is deemed correct and justifiable. Hence, no single conclusion is considered right while the other is wrong. Islamic studies should therefore acknowledge that academic truth is not singular but plural on the ground that there are many approaches toward many conclusions. It is this notion that we want to discuss here. We are interested in exploring the notion of intellectual truth. We hold that differences in opinion should be accepted as natural. Second is, that there is no fundamental differences in the basic value of sciences of any kinds. In other words, what is popularly known as Western science and Islamic science does not in principle differ. Science is science. There cannot be a dichotomy between Islamic or non-Islamic science. Dichotomy in science is not acceptable. Science belongs to all culture, tradition and religion. It does not know particularity. It is universal. Teori al-Maslahah dan Aplikasinya dalam Norma Kriminalisasi Undang-Undang Antikorupsi
Abstract: The Theory of al-Maslahah and its Application in Criminalization Norms of the Law on Anti-Corruption. This study demonstrates that the theory of al-maslahah has been applied in criminalization norms of the law on corruption eradication, namely in the criminalization norms of corruption related to a country’s finances or economy and the criminalization norms of corruption related to bribery. It can be concluded that the existence of such relevance carries the implication that the norms of Islamic criminal law have undergone a transformation or objectification through the application of al-maslahah into an arrangement of national criminal laws, which are represented by anti-corruption criminal law. The existence of such relevance also carries an implication that the anti-corruption criminal law has undergone Islamization through the application of al-maslahah, especially within the criminalization norms that are contained in it. In other words, the criminal law on anti-corruption in Indonesia is Islamic or has validity shar‘î, because it pervades the norms of Islamic criminal law through the application of the theory of al-maslahah.Keywords: al-maslahah, criminalization, corruption, ta‘zîrAbstrak: Teori al-Maslahah dan Aplikasinya dalam Norma Kriminalisasi Undang-Undang Antikorupsi. Studi ini membuktikan bahwa teori al-maslahah telah teraplikasikan dalam norma kriminalisasi undang-undang pemberantasan tindak pidana korupsi, yakni dalam norma kriminalisasi korupsi terkait keuangan atau perekonomian negara dan norma kriminalisasi korupsi terkait suap-menyuap. Dapat disimpulkan pula bahwa adanya relevansi yang demikian membawa implikasi bahwa norma hukum pidana Islam telah mengalami transformasi atau objektivikasi melalui aplikasi al-maslahah ke dalam tatanan hukum pidana nasional, yang direpresentasikan hukum pidana antikorupsi. Adanya relevansi yang demikian juga membawa implikasi bahwa hukum pidana antikorupsi telah mengalami islamisasi melalui aplikasi al-maslahah, terutama dalam norma-norma kriminalisasi yang dikandungnya. FIQIH BISYARAH DI PONDOK PESANTREN TERPADU AL-KAMAL BLITAR
The dynamics of development in the teaching of Islam, by the changes that exist in society. Likewise in terms of receiving rewards in conveying religious teachings in the community. The purpose of this study was to find out the practice of Ujrah ala Thaat by the clerics (asatidh) of Madrasah Diniyah Pondok Pesantren Al-Kamal?, to find out the legal nature of Ujrah by Ustadh Madrasah Diniyah PP al-Kamal?, to find out the impact of taking Ujrah (rewards) by Madrasah Diniyah clerics on Learning Activities at Al-Kamal Islamic Boarding School? This research method is a type of field research (field research) with a qualitative approach and also library research, literature. This research was conducted at Pesantren al-Kamal, with data collection by interviewing several Madrasah Diniyah teachers. Research Results: The practice of bisyarah in Madrasah Diniyah al-Kamal Blitar is the reward received by asatidh who has given up the benefits (services) of teaching Islamic religious knowledge at a voluntary rate. Bishara law or ujrah accepted by Asatidh Madrasah Diniyah al-Kamal Blitar is permissible or lawful, considering that it has fulfilled the concept of ijarah in fiqh review. The legal basis is that nothing is clearly prohibited in the Nash Al-Qur'an and Hadith. Whereas in Madrasah Diniyah ujrah or bisyarah is done voluntarily, the absence of bisyarah is used as the main goal in the implementation of Islamic religious teaching in Madrasah Diniyah. The impact of Ujrah (reward) for the asatid of Madrasah Diniyah al-Kamal is as an encouragement, fostering a happy attitude (bisyarah) for teachers, so that in carrying out teaching activities in an orderly, diligent, and orderly manner. KONSEPTUALISASI TEORI MASLAHAH
Abstract: Conceptualization of Benefits Theory. The foundation of Islamic shariah is represented by benefits which aim to the importance of people as human being, both for benefit in life and after life. Islamic shariah upholds justice principals, affections and benefits. Every law which against those principals is not considered as a part of Islamic shariah; even though many people are searching its rationalization to include it as Islamic law. The greatness and the nobleness of Islamic shariah are implemented through the compatibility of those shariah laws into human real life due to benefits theory human possesses. Fondasi bangunan Syariah Islam itu direpresentasikan oleh maslahah yang ditujukan bagi kepentingan hidup manusia sebagai hamba Allah, baik menyangkut kehidupan duniawinya maupun kehidupan ukhrawi-nya. Syariah Islam itu menjunjung tinggi prinsip-prinsip keadilan (‘adâlah), kasih sayang (rahmah), dan maslahah,. Setiap aturan hukum yang menyimpang dari prinsip-prinsip tersebut pada hakikatnya bukanlah bagian dari Syariah Islam, meskipun dicari rasionalisasi (ta‘wîl) untuk menjadikannya sebagai bagian dari Syariah Islam. Keagungan dan keluhuran Syariah Islam termanifestasikan pada kompatibilitas hukum-hukum Syariah dengan perkembangan kehidupan manusia lantaran ruh maslahah yang menggerakkannya. PENEGAKAN HUKUM TERHADAP PENYALAHGUNA NARKOTIKA DALAM KERANGKA REHABILITASI
Penegakan hukum terhadap seorang pecandu narkotika harus sesuai
dengan aturan hukum yang ada dan harus memperhatikan hak-hak asasi dari si
pecandu seperti yang telah diatur dalam Undang-undang Dasar Negara Republik
Indonesia tahun 1945 mengatur mengenai hak asasi manusia, salah satunya adalah
hak seseorang tas pengakuan, jaminan, perlindungan dan kepastian hukum yang
adil serta perlakuan yang sama dihadapan hukum, karena seorang pecandu
narkotika juga merupakan warga negara indonesia yang harus dilindungi hakhaknya.
Pidana penjara bagi penyalahguna narkotika terbukti tidak dapat
menurunkan jumlah penyalahguna narkotika, dengan dipenjarannya pengguna
narkotika tidak akan menyelesaikan masalah bahkan mungkin akan menimbulkan
masalah yang lain, penegak hukum dan pembentuk undang-undang seharusnya
membedakan antara pengedar dan pengguna serta harus ada perubahan paradigma
di dalam masyarakat terhadap seorang pengguna narkotika.
Permasalahan yang telah dirumuskan di atas akan dijawab atau dipecahkan
dengan menggunakan metode pendekatan yuridis normatif. Metode penelitian
hukum normatif diartikan sebagai sebuah metode penelitian atas aturan-aturan
perundangan baik ditinjau dari sudut hirarki peraturan perundang-undangan,
maupun hubungan harmoni perundang-undangan. Spesifikasi dalam penelitian ini
menggunakan metode deskriptif analisis.
Rehabilitasi dianggap lebih dapat membantu para korban penyalahgunaan
narkotika daripada penjatuhan pidana penjara atau pidana kurungan.
Menempatkan Pemakai Narkotika kedalam Panti Terapi dan Rehabilitasi yang
menyatakan bahwa mereka sebagai tahanan kasus narkotika sesungguhnya orang
yang sakit sehingga tindakan rehabilitasi hendaknya lebih tepat dijatuhkan dan
pemidanaan penjara yang tidak mendukung dikhawatirkan malah mengakibatkan
efek yang tidak baik terhadap mereka karena dapat semakin memperburuk
kesehatan serta kondisi kejiwaan para penyalah guna narkotika tersebut.
Penegakan hukum terhadap kasus pidana narkotika telah dilakukan secara
maksimal oleh aparat penegak hukum dan telah banyak yang mendapat kekuatan
hukum tetap (putusan) di pengadilan. Adanya penegakan hukum ini diharapkan
dapat menjadi pencegah maraknya kasus narkoba, tetapi hal yang terjadi malah
sebaliknya kasus narkoba menjadi semakin meningkat menjangkit jutaan orang
Indonesia. Penanganan kasus penyalahgunaan narkoba di Indonesia kebanyakan
diberikan sanksi pidana ataupun denda, namun di sisi.
