Rule 9011 of the Federal Rule of Bankruptcy Procedure

Rule 9011(b) of the Federal Rules of Bankruptcy Procedure, the bankruptcy counterpart to Rule 11 of the Federal Rules of Civil Procedure (“Rule 11”), provides, that in presenting a pleading to the court, an attorney or unrepresented party is certifying that to the best of the person’s knowledge, information, and belief, formed after an inquiry reasonable under the circumstances, that: (1) it is not being presented for any improper purpose, such as to harass or to cause unnecessary delay or needless increase in the cost of litigation; (2) the claims, defenses, and other legal contentions therein are warranted by existing law or by a nonfrivolous argument for the extension, modification, or reversal of existing law or the establishment of new law; (3) the allegations and other factual contentions have evidentiary support or, if specifically so identified, are likely to have evidentiary support after a reasonable opportunity for further investigation or discovery; and (4) the denials of factual contentions are warranted on the evidence or, if specifically so identified, are reasonably based on a lack of information or belief. Rule 9011(c) further provides that, if after notice and a reasonable opportunity to respond, the court determines that Rule 9011(b) has been violated, the court may, subject to certain stated conditions, impose an appropriate sanction upon the attorney, law firm, or party that has violated Rule 9011(b) or is responsible for the violation.
This Article discusses the requirements of Rule 9011 and the sanctions that may be imposed against a party that fails to satisfy those requirements. Section I of this Article discusses the first prong of Rule 9011, which prohibits the filing of a bankruptcy documents for an improper purpose. Section II discusses the second prong of Rule 9011, which forbids the filing of a bankruptcy petition that is not warranted in law. Section III explains the third prong of Rule 9011, which requires an attorney to conduct a reasonable inquiry before submitting a bankruptcy petition. Section IV explains the fourth prong, which requires an attorney to conduct a reasonable inquiry before submitting his defenses and denials. Section V discusses the sanctions a court may impose if an attorney fails to comply with Rule 9011. Section VI illustrates the procedural requirements of Rule 9011, particularly, the safe harbor provision. Lastly, Section VII considers the implications of Rule 9011

Going Beyond Counting First Authors in Author Co-citation Analysis
The present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation
counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings
are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that
only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into
account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Analisis Ergonomi Postur Kerja Pekerja Pandai Besi Berdasarkan SNI 9011:2021 di Dusun Talwa Kabupaten Sumbawa
The work of traditional blacksmiths in Talwa, Sumbawa Regency, is still done manually with awkward work postures, excessive use of energy, heat exposure, and vibration, thus risking musculoskeletal disorders (MSDs). This condition shows that there is a gap in research related to the application of ergonomics in the traditional small industry sector. This study aims to analyze the level of ergonomic risk in blacksmith workers using the Skeletal Muscle Disorder (GOTRAK) assessment and the SNI 9011:2021 ergonomic potential hazard checklist, and develop recommendations for improvement. The method used was descriptive quantitative on five workers, with data collection through the GOTRAK questionnaire and SNI 9011:2021 checklist. The results show high risk (score >8) in the shoulders, upper and lower back, arms, and hands, and moderate risk (score 6-7) in the neck, elbows, hips, thighs, knees, calves, and feet. Ergonomic potential hazard scores ranged from 9 to 21, with the main exposures from bending postures, wrist bending, power grip >5 kg, vibration without dampening, high temperature, and static standing. Variations on the Author
“Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship
Appropriate Similarity Measures for Author Cocitation Analysis
We provide a number of new insights into the methodological discussion about author cocitation analysis. We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature. Dispelling the Myths Behind First-author Citation Counts
We conducted a full-scale evaluative citation analysis study of scholars in the XML research field to explore just how different from each other author rankings resulting from different citation counting methods actually are, and to demonstrate the capability of emerging data and tools on the Web in supporting more realistic citation counting methods. Our results contest some common arguments for the continued
use of first-author citation counts in the evaluation of scholars, such as high correlations between author rankings by first-author citation counts and other citation
counting methods, and high costs of using more realistic citation counting methods that are not well-supported by the ISI databases.
