Otoritas hadis sirah sebagai referensi yuridis-dogmatis dalam Islam
Muslims researchers make separation between legal traditions (ah}adith al-ah}kam) documented in theliterature traditions; and historical traditions (ah}ad ith al-sira) are summarized in the literature of classicalIslamic historiography. But it turns out in a number of Sirah literature, there are some traditions ofAhk} am found. In contras, in the h}adith literatures, there are also found historical tradition. From here,it can be stated that the tradition has three dimensions at once; historical dimension, categorized ashadith Sirah; juridical dimension, identified as hadith Ahk} am; and historical and juridical dimension aswell. For this latter form, the hadith can be flexible and conditional, in the sense that when it is containedin the literature historiography, categorized as h}adith Sirah, and vice versa, as contained in the Hadithliterature in the form of juridical -dogmatic,- it is categorized as a hadith al-Ah}kam. Therefore, thehadith sira patterned in two functions; justification prophetic treatise (dala’ il Nabawiyya); and juridical -dogmatic arguments (dala’il diniyyah). These two functions are the implications of the concept ofimitation of the Prophet as an integral whole, because its realization as a model of humanity , philosophicallycould not limited by space and time. Implementasi prinsip akuntabilitas dalam manajemen wakaf produktif: studi kasus rumah sakit Islam kota Magelang
This study describes the implementation of the principle of accountability in the management ofproductive waqf in the form of Islamic Hospital in Magelang City. The results showed that IslamicHospital is a core business managed by waqf institutions and has experienced significant developmentswith a marked number of users is increasing. The principle of accountability on the Rumah Sakit Islam(Islamic Hospital) Kota Magelang implemented by the Board of Supervisors to supervise routinelybased on a report prepared by the Director of RSI. Implementation of this principle on endowmentsinstitutions is expected to increase the confidence of stakeholders. For the future, supervision throughan external audit needs to be programmed to improve accountability and public trust
Telaah kritis model screening saham syariah menuju pasar tunggal ASEAN
Shariah stocks is one of the financial sectors that experienced with most significant growth in recentyears. the most important issue in Shariah stock is Stock screening mechanism. The aim of this study isto examine the screening models of Shariah stocks in ASEAN countries. This study is very crucialespecially in the era of ASEAN economic community (AEC). In addition, this study aims to examinesome of the factors that contribute to the differences in screening models applied in five ASEANcountries. By using descriptive method and literature studies approach, this study found a few things.Firstly, there are various models of Shariah stock screening in Indonesia, Malaysia, Singapore, Thailandand Philippines. In this context, the model screening in ASEAN countries have two tendencies, namely;for the country in the majority of the population is Muslim whereby there are many Sharia expert, thenthey will use the specific screening model and applied only in the country, while for the country that themajority is not Muslim, then they will tend to use models of screening that has been used globally forexample DJIM, FTSE, etc. This second pattern has been applied by Singapore, Thailand and Philippines.Secondly, differences in shariah screening models influenced by several factors, namely; differencesin social structure of a country where the Islamic stock market is located; the difference in the financialindustry that exist in the country will affect on the difference of screening models; and differences sectembraced by most scholars in a country is one of the fundamental factors in determining stock screeningmodel of sharia in 5 ASEAN Countries

The research is designed qualitatively, focusing on the aspects that become the background (motives) tothe decision of choosing misyarmarriage among career women in Surabaya. Reseach results show: First,the model of misyar marriage is to give a solution to busy women who have no time to think aboutmarriage. In the midst of their busy life, these women can enjoy marriage, because in this marriagehusband and wife do not have to live in the same house. Therefore, the wife can do her normal activitieslike before she is married, so can the husband. Secondly, it can be inferred from the practice of misyarmarrigein Surabaya in the perpective of Dramaturgy theory that the average actors of misyarmarriage are middleto-upper class women, both n terms of education economy. They are smart and active in simultaneouslyplaying two roles. On the one hand, ther are just single women at home, but married womenwhen staying in a hotel or motel. The problem that frequently appears in Islamic economic contract is the debate on its normative legaland philosophical basis. This article will explain that many contracts in Islamic economic law are basedon the philosophy of law. The philosophy of Islamic economic law is based on triangle concept, i.e.philosophy of God, human being, and nature. It is characterized by God-oriented (rabbani) and humanity-oriented (insani) economy. Its God-oriented character preceives Allah (God) as the center ofhuman awareness in performing economic activities and it reflects in economic behavior considering thenature of human being and promoting the values of goodness, justice, and mutual relationship

The development of Islam in Indonesia has been integrated within social, legal, politics, and economicvalues, which is framed in any social changes. This study will be focused on the relationship betweennational political configuration and the regulation of sharia economic compilation. Based on thisassumption, I would like to propose the question, is it existence resulted by the Muslim aspiration andIslamic political party supports or more influenced by global economic changes? This study is part ofpolitical law as well as sharia economic of political law. The institutionalization of sharia economic lawis a necessity because of several reasons: First, the highly awareness of muslim to implement shariavalues in a life that are popular and socialized; Second, the growth of sharia financial institutions, bothsharia banking and non-banking institutions, and Third, the existence of sharia regional provisions(Perda Syariah).There is highly significant correlation at national and international political changestowards sharia economic law institutionalized as well as the existence of Islamic political parties orpolitical parties based on Muslims. Finnaly, the institutionalization of sharia economic law can not beseparated from the existence of Indonesia Muamalat Bank (BMI) in 1991 that regulated under the Lawof Banking Number 7 of 1992 and the Goverment Regulation Number 72 of 1992. These regulationsare introducing the principle of profit and loss-sharing in sharia bank. In refomulation period, theGoverment has amanded that Law Number 21 of 2008. Because of these regulations, sharia bank ismore improve and implements many principles such as Sharia Insurance, Rahn, Mutual Funds, CapitalMarkets, Financial Corporates based on sharia principles, etc
In search of peace: Ahmadi women’s experiences in conflict transformation
In the last few years, religious conflicts involving a minority Muslim group, Ahmadiyya, have risendramatically in Indonesia; the most recent being the attack on the Ahmadiyya community in CikeusikBanten, West Java, where three Ahmadis were killed and the sealing of Al Mishbah Mosque by localgovernment of Bekasi West Java. Understanding the context of violent conflict and the ways individualAhmadi women take agency to challenge such oppression is an important first step in creating a moreequitable and peaceful Indonesia. To examine the experience of Ahmadi women exercising their agencyin conflict transformation, this qualitative research was conducted in four areas of Indonesia: Bogor,Kuningan, Yogyakarta and Lombok, by gathering data from the narratives of Ahmadi women whoactively participate in Lajnah Imaillah, an Ahmadiyya’s women’s organization. This research highlightsthree stages of conflict transformation that the women employed: 1) asking for government help; 2)taking physical action to defend their rights; and 3) defining themselves as Indonesian citizens who havethe same rights as others. Through these actions, they show their ability to help others, transformingthe conflict by forming better relationships and understanding with other Indonesian citizens
Rekonstruksi konsep fakir dan miskin sebagai mustahik zakat
Among as}naf are entitled to receive zakat is faqir and miskin, but both groups are often interpretedoverlap.This article aims to reconstruct the concept of faqir and miskin with perspective of the Qur’an.This is because that, in addition to the Qur’an is believed by Muslims as the main source of law, also theconcept of faqir and miskin as well as ‘illat that causes both as mustahik zakat will make the distributionof zakat in accordance with its objectives. The study of the verses of the Qur’an about the faqir andmiskin, results the conclusions: First, faqir is who are deterred from livelihoold as work reason or udhur.The work reason is due to religious activity or work shar’i as da’wah and jihad. While the udhur reasoncaused by kauni destiny like a disability, palsied, and old. Thus, ‘illat for faqr groups derived from God’sglory and the exam so that they get the respect, zakat and other compensation. The glory reason comingfrom the work shar’iyyah, while the test reason comes from udhur kauniyyah. While the miskin are literallymeans sakana; silent and not moving, that miskin terms describe the result of a weak state of a personbecause he chose sakana lifestyle (silent, static, not developing skills in his life). As a result he becamepoor and do not have anything whatsoever to fulfill their needs
Studi tentang implementasi komunikasi politik hukum Partai Keadilan Sejahtera (PKS) kabupaten Gowa
The main point of this research is that why the implementation of political communication of PartaiKeadilan Sejahtera (PKS) is so important in Gowa regency. The goals of this research are to know PKS’sexistence in extending political communication particularly for people in Gowa regency. The field researchis the method used in this research which is specifically qualitative-naturalistic-inquiry. The approachmethod used is sociology-historic-politic. The source of this research is all managers and membersof Judgement Council Region of PKS in Gowa regency. The method for collecting data is observation,interview, dan documentation. The data validity in this research are done by credibility data checkupwith persistent observation, triangulation, member check, and referential adequacy check. Theoutcome of this research points out that PKS’s existence is displayed by its Perspectives, Missions, andobjectives of PKS establishment. There are three factors influenced to vote or not to vote in NationalElection. At first is a party identity. Secondly is the capability of party in marketing campaign issue. Thelast is a candidate’s performance. The communication ethic that is built by PKS in Gowa regency is thatthe communication ethic together with the internal elite party which is based on basic consideration andstatute of PKS. Meanwhile, PKS’s relation with people and components are established by eithereconomic development or religion experience through Tarbiyah
Konstruksi citra partai Islam pada pemilu 2014 pendekatan fikih-siyasah
The research of the Image Construction of Islamic Political Party at 2014 Election in Indonesia aimed at knowing the image construction of Islamic political party, especially at Republika and Sindo newspaper.The thoeries used in this research are fikih siyasat (the characteristic of muslim leader), social construction of mass media and hierarchy of influence by using discourse analysis as an analytical technique. The method of the research is qualitative. And the Informans as research subject are the jurnalist, redaction and management representative of both newspaper.The founds of research showed that the news characteristic of both newspaper were almost same. From the social cognition there werea difference. Republika strived to counter every news related to the image of Islamic political party and Sindo did not. From the social context, the background of this news was 2014 Election. And from hierarchy of influence perspective, the impact of media organization level was strong as shown in the power of the owner like Hary Tanoe in Sindo as a chairman of MNC Group. So, Sindo never produced news that contradicted to Hary or Hanura Party. The impact of ideological level also strong as we can seein the news of Republika which not only related to the profit, but also the benefit of Islamic Party.keyword: Construction; Image; Islamic party; Hierarchy of influence; Discourse analysi
