Full text linkMuslim community is very much dependant upon classic fiqh books, so that they are fiqh-minded. They assume that the product of fiqh in classic books is identical with Divine law. It is this phenomenon of sacralization that that makes Islamic law stagnant in Muslim counties.This problem must be overcome by inserting the understanding that Islamic law in its normative level should be present as a solution to actual social problems. In this regard, the methodology of classic Islamic legal theory (ushûl fiqh) and fiqh should be considered as a historical response towards their contemporary situations

Full text linkAbstract:. The scholars of jurisprudence differed in addressing the problems facing the Qibla/ Kaaba. Imam Shafi'i and most of his followers require the Muslims to go to 'ain al-Ka'bah. Medium Jumhur Ulama other than Shafi'iyah for Muslims whose region is far from the Ka'bah is quite facing to jihat al-Ka'bah. While Indonesian Muslims are required to face 'ain al-Ka'bah in performing worship prayer ie to the northwest according to the position of each place, although facing to the West exactly the shalat is still valid. However, if facing to 'ain al-Ka'bah its validity will be more perfect. For that reason for the area of Indonesia mosque kiblatnya less accurate directions to be rearranged shafnya and not have to dismantle the building.Abstrak: Para Ulama berbeda pendapat dalam menyikapi masalah menghadap ke kiblat/Ka?bah. Imam Syafi?i dan sebagian besar pengikutnya mengharuskan kepada umat Islam untuk menghadap ke „ain al-Ka?bah. Sedang Jumhur Ulama selain Syafi?iyah bagi umat Islam yang kawasannya jauh dari Ka?bah cukup menghadap ke jihat al-Ka?bah. Sedangkan umat Islam Indonesia diharuskan untuk menghadap ke „ain al-Ka?bah dalam melakukan ibadah shalat yaitu ke barat laut sesuai posisi tempat masing-masing, walaupun menghadap ke arah Barat persis shalatnya tetap sah. Akan tetapi apabila menghadap ke „ain al-Ka?bah keabsahannya akan lebih sempurna. Untuk itu bagi kawasan Indonesia yang masjid arah kiblatnya kurang akurat supaya ditata ulang shafnya dan tidak harus membongkar bangunannya

Ijma ', qiyas, Istihsan, maslahah al-mursalah, and' urf is a method or means in producing law as a product of Islamic legal thought. The five principles that enable Islamic law to develop in keeping with the times, namely; first; principle of ijma '. Second, the principle of qiyas. Third; maslahah al-mursalah. Full text linkAbstract: This paper will discuss the mechanism of murabahah agreement and application in Islamic banking, and compare murabahah finance with fixed interest to banks in several key areas. Islamic banks have used murabahah agreements in financing activities through merchandise and expanded their network of uses. Murabahah finance and higher credit prices therein clearly indicate that there is a time value in financing based on murabahah, which leads though not directly to the acceptance of the time value of money.Abstrak: Tulisan ini akan membahas mekanisme perjanjian murabahah dan penerapan dalam perbankan Islam, dan membandingkan keuangan murabahah dengan bunga tetap pada perbankan dalam beberapa bidang utama. From both laws, the government through the Public Service Agency implements good governance in order to improve the performance and service of the community. This paper aims to examine the effect of internal audit for good governance either partially or simultaneously. Internal audits have a positive and significant impact on good governance both partially and simultaneously, indicating that both internal audits can improve the creation of good governanceAbstrak: Undang-Undang 17 Tahun 2003 dan Undang-Undang 1 Tahun 2004 memicu pembaharuan manajemen keuangan negara. Dari kedua undang-undang tersebut, pemerintah melalui Badan Layanan Umum menerapkan good governance dalam rangka meningkatkan kinerja dan pelayanan masyarakat. Tulisan ini bertujuan untuk menguji pengaruh audit internal untuk tata pemerintahan yang baik baik secara parsial maupun secara simultan. The command of worship in the Qur'an has two forms, namely by using the word worship with the form fi'il amr and sometimes also use the word nusuk, both of which have the meaning of demands to carry out a command. Implementing the worship ceremony is a necessity for every creature, for as a weak creature, who at all times needs protection, mercy and compassion from the Creator then to obtain all that must be through obedience and steadfast exercise (worship).
Abstrak: Tulisan ini akan mencoba membahas beberapa ayat yang berkaitan masalah ibadah. Perintah ibadah dalam Al-Qur?an memiliki dua bentuk, yaitu dengan memakai kata ibadah dengan bentuk fi?ilamr dan kadang juga memakai kata nusuk, yang keduanya memiliki makna tuntutan untuk melaksanakan sebuah perintah. Full text linkAbstract: This paper is intended to reveal how the mechanism and implementation of bride and groom courses in the Office of Religious Affairs (KUA) Kecamatan Duampanua Pinrang District and the factors inhibiting and supporting the implementation of bride and groom courses in the Office of Religious Affairs (KUA) Duampanua District Pinrang District and how the bride's understanding of the the concept of sakinah family. The effectiveness of the bride and groom course has not been fully run in the community with various inhibiting factors, so the bride and groom have not fully understood the material about the concept of sakinah family that has been poured into the bride's course process.Abstrak: Tulisan ini dimaksudkan untuk mengungkap, bagaimana mekanisme dan pelaksanaan kursus calon pengantin di Kantor Urusan Agama (KUA) Kecamatan Duampanua Kabupaten Pinrang dan faktor penghambat dan pendukung terlaksananya kursus calon pengantin di Kantor Urusan Agama (KUA) Kecamatan Duampanua Kabupaten Pinrang serta bagaimana pemahaman calon pengantin terhadap konsep keluarga sakinah.
