KARTU KREDIT SYARIAH DAN PERILAKU KONSUMTIF MASYARAKAT
Islamic Credit Cards and Consumptive Behaviour of Society. The credit card as one means of payment utilising cards, is a payment system that is growing rapidly, brought about by the security and risk of carrying cash in large amounts, efficiency, speed and ease of transaction that is offered. Islamic banks are glancing consumer funding products as one of the products services to be offered. There is a very important limitation that must be realized for Islamic banks, namely the provisions of the shari’a principles regarding the provision of credit card and influence on consumer behaviour society, particularly the Muslim community. It is not impossible for the existence of Islamic credit cards that are presented for the ease of transacting to become a card for the ease of indebtedness and cause a consumptive/wasteful attitude that is definitely forbidden in Islamic economic concept.DOI: 10.15408/ajis.v14i2.128
PEMBELAJARANUSHUL FIKIH BERBASIS MASALAH
Learning Ushûl al-Fiqh Based on Problems. The goal of learning ushûl al-fiqhin order to apply the rules concerning useful arguments to obtain laws will appear successful if the model that is used triggers the student to think constructively and contextually by using participative learning principles in analyizing ushûl al-fiqhrules. The focus of problem that needs to be answered in this research is to see conceptually the effectiveness of learning ushûl al-fiqhbased on problems in reaching the applicable ushûl al-fiqhlearning goals. Based on conceptual-qualitative analysis results, I argue that model of problem-based learning with its various limitations can be used as an innovative model in learning ushûl al-fiqh.DOI: 10.15408/ajis.v14i2.128
REFORMULASI YURIDIS PENGATURAN PRODUK PANGAN HALAL BAGI KONSUMEN MUSLIM DI INDONESIA
Juridist Reformulation of Halâl Products for Muslim Consumers in Indonesia. This paper examines the certification of halâl products that are becoming a social problem in the community as well as a responsibility of the state on the basis of the same reasoning, the assurance of halâl products. Halâl certification aims to protect the public from unlawful products and risks to health that often occur with differences of interests, especially between producers and consumers. The main source of this article is data obtained from field research that is related to the community to halâl certification LPPOM-MUI in Central and South Sumatra Province. The data is read through constructivism paradigm from a socio-legal approach with a pointed analysis of the codification theory of Islamic law, legal sociology by the American lawyer and scholar Rescoe Pound and mashlahah mursalah theory.DOI: 10.15408/ajis.v14i1.124
LOYALITAS KAUM SUFI TERHADAP SYARIAT
Loyalty Sufis against Shari’ah. In the history of Islam, the Sufis always received criticism from some scholars that they ignore the laws of Sharia. Sufis are considered more priority the inner problem than Shari’a law. This paper proves that the criticism is not always true. The majority of the Sufis still loyal and running the Shari’a law. Even many Sufis who follow the habit of the Prophet until the small things that are not considered essential. Although a small group of Sufis who ignore the law, who are a small part of the malâmatiyyah, but this can not be generalized for all Sufis.DOI: 10.15408/ajis.v14i1.124

Corporate Social Responsibility (CSR) as an Implementation of Social Fiqh to Empower Society. Corporate Social Responsibility (CSR) is the responsibility of businesses in their undertakings. CSR in the perspective of social fiqh is no only position as an obligation of business that must be there as a part of social life. The government must support business in implementing CSR from voluntary to mandatory requirements so that the existence of CSR can be felt in reality by society. Optimisation of the CSR function in the supporting the success of development can be undertaken by synergising three potentials, namely tertiary education institutions who have the science, sufficient technology and human resources; government who has the space, society and development plans as well as businesses who possess CSR funding.DOI: 10.15408/ajis.v14i1.125
REKAYASA PENENTUAN JENIS KELAMIN DALAM KANDUNGAN MENURUT HUKUM ISLAM
Engineering the Determination of Sex in the Womb According to Islamic Law. Currently, modern science and technology have developed quickly and dynamically. One development in medical science is engineering of the foetus (genetics) which can bring about benefits and at the same time possibilities that can be harmful to human dignity. Under Islamic law, engineering studies of the foetus can be categorised as a part of issues of fikih al-nawâzil. The problems are in need of the ihtiyâth ijtihâdiyyahprocess or regularity of istishlâhiyyah. Therefore, when mashlahahdominates as the main principle in engineering of the foetus then it can be justified. But if undertaken solely as a limited exercise at the same time determining the sex of the foetus then it cannot be justified under Islamic law because the exercise intervenes in the area of God Almighty in the creation of life.DOI: 10.15408/ajis.v14i2.128
THE CONCEPT OF AMÂNAH IN INFORMED CONSENT
The Concept of Amânah in Informed Consent. The Appeal Decision of the Supreme Court of the Republic of Indonesia Number 365K/Pid/2012 granted the appeal request of Public Prosecutor of Manado State Public Prosecutor’s Office. The Supreme Court annulled the Manado State Court Decision that imposed 10 (ten) months criminal imprisonment to each defendant. The Indonesian Doctors Association argued that the contract between doctor and patient is a contract of process, not a contract of result. At the very least, this Appeal Decision provided an opportunity for legal experts to test and evaluate the concept of informed consent both philosophically and juridically. This paper argues that informed consent should be built on the framework of amânah which is an important concept in Islamic law.DOI: 10.15408/ajis.v14i1.124
PENETAPAN CUCU SEBAGAI ANAK ANGKAT DAN IMPLIKASINYA TERHADAP MASALAH WARIS
Determination of Grandson as Adopted Child and its Implications for Inheritance. An application for adoption by an Indonesian Muslim citizen of a Indonesian Muslim child was submitted to the religious court. In the determination the court found a situation where an adopted child was the biological grandchild of the applicant. The method used in this study was normative legal research. The data was analyzed with qualitative methods and explained descriptively. Research results conclude that the grandchild who was the adopted child became an heir through the washiyyah wâjibah to receive at most one third of the inheritance. If the adopted child (grandchild) serves as a substitute heir, then he is not entitled to the last will and testament unless the other heirs agree.DOI: 10.15408/ajis.v14i1.124
Kesaksian Wanita dalam Pandangan Ulama Tafsir
Abstract: Women’s Testimony in View of ‘Ulamâ’ of Tafsîr. Within Islamic law, the testimony of women is controversial. There are those who distinguish between female witnesses and males in matters such as debts, but there also those who equate the two. The difference appears to have resulted from the difference in points of view. Actually when differentiated between al-ishhâd (out of court testimony) and al-shahâdah (testimony) as evidence brought before a judge in court, does not need to distinguish between the testimonies of women and men. Shahâdah in court is determined by the judges, as drawn out by the Prophet and accepting the testimony of a woman in the case of rape. Similarly, the Prophet accepted the testimony of a woman in the case of ‘Uqbah ibn al-Harîth who married Umm Yahyâ bint Abî Lahab.Keywords: al-ishhâd, al-shahâdah, shâhidayn, debtsAbstrak: Kesaksian Wanita dalam Pandangan Ulama Tafsir. Dalam hukum Islam, terjadi kontroversi tentang kesaksian perempuan. Ada yang membedakan antara saksi perempuan dengan laki-laki seperti dalam masalah utang- piutang, tapi ada juga yang menyamakan antara keduanya. Perbedaan tersebut tampaknya diakibatkan oleh perbedaan sudut pandang. Sebenarnya bila dibedakan antara al-ishhâd (memberi kesaksian di luar pengadilan) dan al-shahâdah (persaksian) sebagai alat bukti di depan hakim di pengadilan, tidak perlu membedakan antara kesaksian perempuan dan laki-laki. Shahâdah di pengadilan ditentukan oleh keyakinan hakim, sebagaimana dicontohkan oleh Nabi dengan menerima kesaksian seorang perempuan dalam kasus pemerkosaan. Begitu juga Nabi menerima kesaksian seorang perempuan dalam kasus ‘Uqbah ibn al-Harîth yang mengawini Umm Yahyâ bint Abî Lahab.Kata Kunci: al-ishhâd, al-shahâdah, shâhidayn, utang-piutang.DOI: 10.15408/ajis.v13i2.94
Islamic Finance and Takāful in Contemporary Social and Economic Development
Abstrak: Keuangan Islam dan Takāful dalam Pembangunan Sosial dan Ekonomi Kontemporer. Artikel ini menegaskan bahwa meskipun keuangan Syariah memiliki kekurangan, namun telah berhasil dalam pembangunan sosial dan ekonomi dibandingkan dengan instrumen tradisi yang lain, seperti wakaf dan zakat. Dengan perubahan situasi ekonomi dan hubungan sosial, keuangan Syariah, dan takāful diharapkan akan menjadi instrumen pelengkap yang penting dalam pembangunan sosial dan ekonomi masyarakat Islam. Untuk mendukung kesimpulan tersebut artikel ini akan menyajikan argumen-argumen dan kritik-kritik terhadap perbankan Syariah modern pada aspek di atas di samping memberikan justifikasi dan penjelasan sebagai jawaban atas kritikan tersebut.Kata Kunci: keuangan Islam, takāful, pembangunan Islam, ekonomi Islam, perbankan Islam, muamalah IslamAbstract: Islamic Finance and Takāful in Contemporary Social and Economic Development. This article argues that Islamic finance although with its limitations has relatively been successful in the contemporary social and contemporary development compared to other traditional instruments such as waqf and zakāh. With the changing economic climate and social relations, Islamic finance and takāful is expected to be an important complementary instruments of Islamic social and economic development. To support such a conclusion the article revisits some of the arguments and critics on modern Islamic finance in respect of the above issues and offers justification and explanation as a response to those critics.Keywords: Islamic finance, takāful, Islamic development, Islamic economics, Islamic banking, Islamic mu’âmala
