This paper tries to trace and analyze the roots of?Islamic transnationalism? or ?transnational Islam? in Indonesia through the lens of the three theoretical frameworks that I borrowed from Mandaville as follows: (1) travelling theory; (2) hibridity theory, and; (3) diasphora theory. The paper focuses its analysis on an Islamic movement who carries the ideology of ?Islamic transnationalism? (khil? fah Isl?miyah), namely Hizbut Tahrir Indonesia (HTI). Before delving into the details of HTI?s ideological roots of transnational Islam, however, a conceptual definition of ?transnational Islam? will be elucidated in advance
Pemikiran Fiqih Moderat di Timur Tengah dan Relasinya dengan Gerakan Fiqih Formalis
Islamic thought has conventionally distinguished between what it calls the People of Hadith (ahlu al-had?s) and the People of Opinion (ahl ar-ra?y). These two segments have improved into a countless current of thought in the modern world, making it impossible to refer to a certain type of thinking as this or that. Nonetheless, the basic characters of the modern Muslim thinking are not quite distinctive from that of the classical-dualistic dichotomy. Hence, the clash of discourse that we witnessed recently in various Muslim worlds is reflective of the intellectual tension between the People of Hadith and the People of Opinion. The clash of discourse that we have just referred to even took the form of physical conflict such as that which happened in Egypt and Algeria. In these two Muslim countries the clash of discourse has turned into the clash of politics, where religious radicalism and absolutism are the dominant features. This paper seeks to provide a critique of this negative development, offering in the process a kind of discourse that can serve as an alternative, namely the discourse of a moderate Islam
Particular Sunnism Versi Hasyim Asyari tentang Ahl al-Sunnah wa al-Jamâah
This study focuses on Hasyim Asyaris religious thinking. It particularly examines three key issues, Hasyims responses to religious dynamics in the early twentieth century, the correlation between his ideas and the religious tradition or thinking of the ulama? in the medieval period, and the extent to which he presented the originality, trend, and uniqueness of his ideas on the discourse of Ahl al-Sunnah wa al-Jam??ah. Basing its analysis on the historical understanding of religion and philosophy, the study also makes use of hermeneutics, and seeks to grasp the deep meaning of the text by considering carefully its horizons. The findings of this study imply that Hasyim crafted a new concept of Sunnism, which can be particularly called ?particular Sunnism?. By this we mean a discursive understanding of the concept of Ahl al-Sunnah wa al-Jamâah according to the context of locality, the religious dynamics that shape it as well as the existing interpretation on it that has been taken by the likes of the modernists and traditionalists in Indonesia in the early twentieth century
Kontekstualisasi Pemahaman Ḥadîth dan Rekonstruksi Epistemologi Ikhtilâf dalam Fiqh al-Ḥadîth
Hadith, a prophetic saying has been a living tradition for the Muslims. In their plea to live a better live, Muslims would turn to either the Quran or the hadith. It has in other words served as a source for all aspects of the lives of Muslims. As an object of academic study, hadith has also been subjected into a serious investigation both to prove its authenticity in its narration and message, and to elaborate certain points of importance. Critical studies of hadith have been common in academic circles in the Muslim world and in the Western universities, one of which focuses on the contextual meaning of it. It is toward this end that this paper is aimed at. It is an attempt to make a contribution in the contextual analysis of hadith. By contextual analysis we mean a study that puts a lot of stressing on the meaning of a hadith by looking at the context from which it was said or reported. This way of studying hadith would help to understand it better in line with the dynamic nature of Islam. The paper argues that a hadith cannot be understood in isolation from its context. It also maintains that understanding its context would mean that one would be able to unveil and even reconstruct the hadith epistemology. Since the epistemology of a hadith lies in its meaning, the re-interpretation of a hadith according to its context would mean rediscovering the new dimension of the epistemology
Akar Sejarah Pemikiran al-Shāṭibī tentang Rukhsah
Al-Shatibi is known in the history of Islam as a prisoner in the theory of Syariah. He wrote al-Muwāfaqāt, his magnum opus. This paper deals with this historic figure by referring to his theory concerning rukhsah; an exemption given to Muslim in performing the rites for certain and acceptable reason. The paper will look at this concept by considering the background in which it is propounded. We believe that his theory is not conceptualized out of the blue. Two keywords will be used to embark on this task, namely 'adam al-ḥaraj and (taṭbīq). The former is about removing the difficulty from man, and the latter is about the application of the Syariah in the live of individual. By using the first concept, the paper will try to reconstruct the fact that in propounding his theory of rukhsan, al-Syatibi always keeps in mind the fact that Islam is revealed mainly to make life easy, and not vice versa. By using the second concept in the meantime, we try to show that the Syari'ah laws?rukhsah included?are revealed to apply (the application Syariah is not always in political context)
Syariah, Fiqih dan Sebuah Perspektif tentang Tarjih
This paper takes into account the very fact that Syariah has been a subject of controversy over centuries. Its interpretation in the form of fiqh (Islamic jurisprudence) is a strong indication that Syariah is not immune from personal subjectivization. Fiqh is quite personal whereby a jurist would read the message of Syariah and attempt to give his personal and subjective interpretation of it. Nonetheless, the paper is also of the argument that this controversy is in itself a source of the dynamics of Syariah. It is due to this controversy?otherwise known as the legal dispute- that fiqh is capable of being developed overtimes. Some substances of fiqh are responses to the opposing views on some issues. Not less important than this is to delve into the factors that triggered such controversy and dispute. The paper speaks of three factors, namely the nature of subject matter, the way the jurists interpret it, and the social circumstances that surround the jurists and help shape their way of thinking. The first is epistemological, the second methodological, whereas the third to sociological. The three factors are inter-related and form as it were the comprehensive legal products that the Muslims currently inherited. The Tarjih in the meantime is a form of a legal product, which serves both as a social and intellectual modality for the Muslims in their daily lives
Menguak Islam Eksklusif yang Toleran
This paper speaks of something unusual. Exlusive Islam has been commonly branded as untolerant, while the inclusive Islam has been identified as tolerant. This paper tries to prove the reverse that the exclusive Islam can be tolerant too. It addresses first the problem of religion-based conflict in Indonesia arguing it is this problem that provoked the birth of such liberal font of Islam called Jaringan Islam Liberal (JIL). Born to propagate the polite Islam, the movement turned out to be just another defect within the Muslim society. The fact is that, majority of Muslims in the country are not happy with it. The reaction of Muslims varied, and culminated in the issuance of the Indonesian Council of Ulama (Majelis Ulama Indonesia/ MUI) that such notion as religious pluralism that the movement is busy campaigning for is forbidden religiously. This paper is an attempt to reconstruct the pluralistic discourse in a way that would not iritate the conservative segment of Muslim society. It also tries to understand why majority of Muslims in this country rejected the idea of religious pluralism propounded by the liberals
Uṣûl al-Fiqh antara Ahl al-Ḥadîth dan Ahl al-Ray
If there is any notion in which Islam is seriously concerned with more than anything else, it is the notion of freedom of expression. No doubt, Islam has recognized this and has even institutionalized it in the form of what popularly known as ijtihad. Rational exercise is the main trait of this institution, in which a mujtahid would employ a certain method to come up with whatever result he/she has discovered on certain legal issues. In the meantime, the science in which ijtihad is commonly used is called the science of Uṣûl al-Fiqh. This science also provides the guidelines on how intellectual exercise should be carried out. This paper is interested in exploring further this notion of ijtihad within the framework of evolutionist thinking. It assumes that the product of ijtihad, commonly called fiqh, has evolved from being an individual opinion, to become a collective discourse then to a religious dogma. Hence, the paper argues that while ijtihad is a precious gift, it is wrongly misappropriated by certain religious authorities to produce dogmas that can jeopardize the opposing views
Ekonomi Sharah dan Ketidakadilan Kapitalisme Global
This paper understands that the Sharah Economics is a serious contender for the modern global capitalistic economic system. Capitalism has been responsible for the collapse of not only the global economic system but also the moral deterioration of human being. Injustice is the main mark of capitalism. Hence, in a capitalistic society, no law of the game is upheld economically speaking. The strong and the rich rule. The weak is always a victim. This is the main concern of this paper, vis-?-vis which it introduces the Sharah perspective as providing a good alternative. The paper first speaks of the sources of this ?Islamic? system -namely the Quran, the Sunna, Ijma and Qiyas- and then delves into its heart, namely justice. The study holds that the main imprint ot Syari? ah economic system is justice. Being divinely revealed, this system is always in line with the very nature of man as a social being whose responsibility it is to do something beneficial for his fellow human being. Man is not created solely to accumulate wealth, but to serve God, his religion, his community by using wealth among others. Hence, wealth is not the goal, but the means. The goal that every man wants to acquire is happiness. Shariah Economics?the paper argues- is ordained to provide a practical guideline toward happiness
Islam Mataraman dan Orientasi Politiknya dalam Sejarah Pemilu di Indonesia
This paper deals with a cultural fraction of the Javanese Muslim called Islam Mataraman. Historically Islam Mataraman originated from the Islam that flourished during the era of the Mataram Kingdom in an inland Javanese island. This paper tries to explore the unique characters of this group of the Javanese Muslims that distinguish them from others culturally and politically. It maintains that Islam Mataraman is not only about culture, politics or belief, but also about the integration between them all. Integration is the key word in this paper. The paper also tries to show that in integration process, religion is not always the key player. In fact we are not interested in discussing the winner and the looser in this process. We are rather interested in showing that the integration is unique and complicated process, and that Islam in this part of Java is a perfect model of how religion, culture and politics can converge without there being a sense of domination or marginalization. To carry out its task, the paper will consult not only the local authoritative scholars in this field, but also the international experts so as to have a balanced view of the problem. At the end, we will also try to discuss how this integration imply on the political attitudes of the Muslim Mataraman
