    Rekonstruksi Fiqh Jinayah terhadap Perda Syariat Islam

    This paper poses a question whether Syari?ah can be adopted as a regional/provincial law in Indonesia or not? The question has many sides. First, the many provinces in Indonesia have different religious and cultural setting, making them varied in their reception not only to Syari?ah but also to Islam itself. Even the province where Muslims are majority, Syari?ah is not always ready to apply. Second, the formalization of Syari?ah has provoked an uneasy response from many non-Muslims and also from many Muslims who are not happy with the formalization of Syari?ah. Third, the provincial law has thus far been good in some provinces, giving no chance for the Syari?ah law to interfere. It is these problems that this paper is concerned with. Some aspects of the Syari?ah criminal law that many have attempted to be formalized will be discussed here such as the law of fornication, of drugs and beer, of prostitution, and of religious transgression

    Many contemporary Muslim scholars argue that Islamic jurisprudence (fiqh) is not ready to face the demands of the modern era. Modernity is so powerful that it weakens the foundation of fiqh on the one hand, and opens up new opportunities that cannot be reached by fiqh on the other. The method that fiqh has introduced is in itself incapable of adapting to new situation and also incapable of addressing new issues such as the issue of human right, constitusionalism, and the like. It is in this context that contemporary Muslim scholars speak out for reform in the methodology of fiqh as well the application of this methodology in addressing new issues. This paper is concerned with discussing this problem by referring to the thought of some leading authority in this regard such as Abdullahi Ahmed an-Naim, Aboe el-Fadl, and Nasr Hamid Abū Zayd. The paper argues that for these scholars, fiqh has lost its role and power in the modern society because of its discriminative trait. Fiqh must therefore deal with this negative image if it is to restore its influence in the modern civilization

    Three decades ago, philosophy as an object of investigation was still unlawful religiously among the santris and even among some Muslim university students in Indonesia. That is no longer the case now. Following the coming of some open-minded religious discourses in the country especially that which was brought about by a well-known scholar named Harun Nasution, the study of philosophy became lawful and even promising. This paper speaks about this phenomenon by looking at the evolution of the study of philosophy ?especially the philosophy of science- in the academic study in Indonesia. Within the framework of evolution theory, the paper also tries to discuss how the study of this science evolves from a sheer Western-based study to include the Qur?anic perspective of it. This paper itself is a study of the Qur?anic perspective concerning the philosophy of science. And by doing that, it tries to show that this kind of study has become a trend in academic circle in Indonesia

    In Arabic Satan means an enemy, one who is distant, misled, burnt, disowned from the grace of God and displaced from His mercy. He is so distant that he cannot any longer hear and know the truth. He is so arrogant that he became the victim of his own attitude. In the Qur?an the word Satan is always mentioned in its concrete from (ma?rifah) which means that the existence and threat of the Satan is true and real. This also means that Satan is created solely to mischief man on his earthly life and mislead him from the grace of God. Different views however have been expressed to the extent that the creation of the Satan may also be understood as an indication of God?s mercy upon His creation especially human being. If it is not because of Satan, human being would not be able to distinguish between good and vice. And it is exactly because of Satan that human being ?upon his success to avoid his deceive- may be raised to the higher status as human being. This paper is concerned with this controversy and with the logical implication that emerges thereof. It is ultimately about tracing the Qur?anic and prophetic notion of what Satan is, and what it means to be human

The former is about religion as a given system of belief, while the latter is about religious way of life. While touching briefly on the former, the paper will focus a great deal on the latter. It will focus as such on the ?constructed Islam? by the Javanese Muslim santris. Employing the social constructive theory, the paper assumes that these santris are active agents in building their own religiosity through what may be called a dialectical moment. Hence, the paper refuses the commonly believed understanding that social facts are completely outside individual awareness in the process of religious construction. By this, the paper attempts to show that Javanese Islam?sociologically speaking?is none other than the product of santri?s cultural and social upbringing

    This study discusses the concept of multiculturalism according to the santris and its relation to their religiosity. Santris are those who study at the pesantren, the indigenous form of education in Indonesia. The paper offers a descriptive elaboration of what these santris think of multiculturalism and how they relate it to their belief and religious tradition. It argues that multiculturalism has been the very character of the pesantren in which santris of various cultural background stay to study. How thismulticulturalism works and how it influences the santris in the way they look at the idea of nation-hood is the question that needs to be explored. And this paper aims at doing just that. Nation-hood is just another form of multiculturalism. While the santris are used to a life of a multicultural nature, the question of how they adapt to the national culture on the one hand, and how religion shapes the way they behave on the other becomes of particular interest. This paper will show that religion and nationalism are two sides of the same coin?as it were?in the life of the santris

    This paper focuses on the notion of endowment and its role in the building and development of pesantren in Indonesia. It is interested particularly in investigating the economically independent nature of pesantren through the scheme of endowment. It also traces the history of pesantren to show that it has been independent all along. Its independence, the paper argues expands not only in economic terms but also in academic, theological as well as intellectual realm. Even against the onslaught of modernity, pesantren has been independent in the sense that it has not fallen prey to the negative impacts of modernity, if any. This paper discusses this as well as the strategy of pesantren in dealing with modernity particularly by referring to the experience of two great pesantrens, namely Tebuireng and Gontor. The paper keeps in mind that it is the values of the two pesantrens that kept them intact from the influence of modernity. It investigates therefore the nature and kind of these values as well the extent to which the two pesantrens are attached to them. One of the values that the paper is interested in is the notion of charity (sadaqah), the some-what equivalent word for endowment (waqf)

    This paper is interested in exploring the most recent current of thought belonging to the younger generation of Indonesian intelligentsia. This current of thought is known by many as post-traditionalism. While discussing some of its most notable traits, this paper tries to show that the school of thought ?while being intellectual and discursive- is also concerned with the state of education in the country. The paper argues first and foremost that the advent of this school was due to the poor quality of religious discourse in the country. By means of critical approach and ?leftist? epistemology, this group tries to subvert the existing discourses, which it considers irrelevant. Since these irrelevant doctrines were encapsulated in the educational institutions, the practical and strategic way to dismantle these doctrines is by deconstructing their educational system on the one hand, and by reconstructing the new one; the one that reflects the universal and humanitarian values of Islam such tolerance and understanding

On that basis, this paper argues that the spirit of entrepreneurship that one has within him/her is the result of his/her faith ?and also understanding- of his/her religion. The paper holds that it is religion that drives one to be an entrepreneur. The Islamic world-view concerning the dynamics of life for instance, has been the major source of inspiration for many youngsters to do business. This paper therefore deals with some Islamic teachings concerning life such as worldly well-being, free will and the value of work before God. The paper however also discovers that although Islam has a lot to say concerning business, only few Muslims made use of its teaching do develop what can be called Islamic entrepreneurship.?

    This paper examines the notion of state and leadership according to the contemporary Islamic thought. To be more precise, the paper asks whether it is possible for a non-Muslim to be the president of the majority Muslim country. To answer this, the paper will dwell into the problem of citizenship both in classical and modern Islamic thought by taking into account the political and social situation that shapes this thought. The paper maintains that many Muslims?both in the past and at the present?fail to offer a proper discourse on statehood and leadership in Islamic perspective. The mainstream discourse on this issue?the paper argues?is that which keeps in a good balance the notion of religiosity and citizenship. The rightwing Muslims will provide a textual understanding of the problem, while the left-wing will otherwise offer a secular interpretation of it. This paper will try to keep the two in a balance, and present a fair understanding of what the Qur'an and the Sunnah say about the problem at hand
