Rereading Christiaan Snouck Hurgronje: His Islam, Marriage and Indo-European Descents in the Early Twentieth-Century Priangan

This study focuses on a controversial issue about Christiaan Snouck Hurgronje’s family that was left in the Dutch East Indies in the early twentieth century. The issue sparked a debate among scholars in the 1980s. The debate was concerned with the Dutch government's denial of Hurgronje’s marriage to an Indigenous woman as it was intended to maintain his good reputation. As a matter of fact, the colonial government forbids the marriage of European people with Indigenous women because it would tarnish their status and make it difficult in their careers. This study is meant as a follow-up of van Koningsveld's findings about Hurgronje’s wife and children in Priangan. Here the writer uses a historical analysis of the letters written by Hasan Mustapa to Hurgronje (Cod. Or. 8952). He argues that Hurgronje's history needs to be read in his position as a colonial official who may be worried about rules set by the colonial government. This study shows that Hurgronje cannot be considered completely irresponsible to his Indo-European family in the Dutch East Indies. In fact, he continued to monitor the condition of his family through regular correspondence with Hasan Mustapa, his close friend in the Dutch East Indies. This study is important in a sense that it is expected to be able to rectify the confusion over the issue of Hurgronje's morality towards his family. It offers another perspective of the history of colonialism dealing with interracial relation between Indigenous women, and their offspring, and European men amid the rise of the issue of Nyai and concubinage in the Dutch East Indies

Maqāṣid Al-Shariah in the Contemporary Islamic Legal Discourse: Perspective of Jasser Auda

Nowadays, Muslims are facing various contemporary problems related to the discourse of fiqh or Islamic law. In this case, the old tradition of Islamic jurisprudence is no longer sufficient to answer those problems due to the changes in the context of space, time, culture, and contemporary sciences. Any effort to renew the aspect of methodology must be done in the field of uṣul al-fiqh not only in Islamic jurisprudence. This is the reason that methodological reconstruction is needed in order to make it is able to accommodate the various problems that are disturbing Muslims today. One of Muslim scholars who tried to reconstruct at the level of the methodology of maqāṣid al-shariah is Jasser Auda. For the purpose of reconstructing maqāṣid al-shariah fundamentally, Auda uses a philosophical approach that is multidisciplinary as well as open with various other relevant disciplines as a methodological framework for reforming the study of uṣul al-fiqh and Islamic law. Applying philosophical and historical approach this study found that Auda reconstructs maqāṣid al-shariah by offering six features: cognitive nature, wholeness, openness, interrelated hierarchy, multidimensionality, and purposefulness. Furthermore, Auda gives contribution to the development of Islamic law and human rights. This paper will explore reconstruction as well as the contribution of maqāṣid al-shariah promoted by Auda through the approach of the philosophy of the system

Quranic Forensic on Begging: Formulating Policies and Action Plans to Handle Street Beggars

Begging behavior is a serious issue and happens on a wide scale, especially in urban areas. In Islamic normative point of view, the Quran has a distinctive perspective towards beggars. In Sura al-Mā‘ūn [107]: 3, Allah swt. encourages Moslem people to pay attention to poor beggars. In contrast, in other verses, al-Jāthiyah [45]: 7, al-Quran criticizes people who are lying for the sake of other’s mercy with a mode and guise of a falsehood. In fact, the begging behavior nowadays is not only caused by the economic problem, but beggars even make it as a preferable profession. The biggest problem in handling the beggar issues is the difficulty to differentiate between the genuine and the professional beggar. If we examine thoroughly using an analysis of the Quran verses, there is a distinctive characteristic of those beggars. These at least can be identified through the micro-expression, sound pressure, and eye tracking. The analysis of the human’s track and physical fact through al-Quran here is what the authors intend as Quran forensic. Based on the distinguishing indicators from the analysis of the Quran forensic, this article found a new model for solving beggar problems with a multidisciplinary approach

The Linguistic Modeling of Variation in Islam: Constructing Saussure’s Concepts of Langue and Parole to Religious Studies

Islam has some basic set of shared symbols, beliefs, and rituals that are found in the Quran and Hadith. These form the foundations of universal Islam. But even with the “universal” foundations of Islam we find considerable debate and disagreement. Dealing with the diversity in Islam, we will develop our model, especially through the more complete linguistic analogies. The core of our model borrows Saussure’s concepts of langue (language as a system) and parole (speech acts) and applied it to religion. The transcendent form of a religion, which is parallel to langue, is an ideal form in the minds and hearts of believers. The expressed form, which is analogous to parole, includes interpretations, discourse, debates, rituals, and daily life of believers. The aim of this paper is more to elucidate an analytical model than to make declarative statements about the nature of religion. We argue that a fuller linguistic analogy moves us further in our understanding of this relationship. The results of the analysis show that linguistic modeling of variation in Islam applied through several ways, there are: (1) dialects and local religious practice (2) the transcendent and the expressed as parallels to Saussure’s langue and parole (3) linguistic analogies (4) myth, doctrine, and grammar (4) syntax, Islam and ritual and (5) creoles and pidgins

Factors Influencing Non-Performing Financing (NPF) at Sharia Banking

The risk of financing is the risk caused by the failure of the customers to fulfill their obligations. Non-performing financing (NPF) is a representation of financing risk that is channeled and has a direct impact on bank profitability. The value of NPF tends to increase annually with a value that is already close to the maximum limit set by Bank Indonesia of 5 percent. This condition is able to lead to the inefficiency of the banking system and in the long run, will have an impact on the sustainability of the bank. Therefore, the analysis of NPF factors should be conducted as a preventive measure and a risks controller of business activities. This research analyzes the factors influencing NPF at sharia banking (BUS) using a quarterly data from first quarter of 2012 until third quarter 2016. The method used in this research is panel data analysis. The result of analysis shows that the factors influencing NPF negatively and significantly are ratio of revenue sharing financing (RR), Return on Assets (ROA), inflation, Capital Adequacy Ratio (CAR) and Bank size while Gross Domestic Product (GDP) and Operating Cost to Operating Income (BOPO) have a significant positive effect
