Get PDFapplication/pdf中国政府は2013年に旅遊法を制定し、「零負団費」に象徴される悪質なパッケージツアーを規制するための条項を設けた。その結果、「零負団費」については立法上の対策が講じられているが、残された課題も少なくない。例えば、航空券とホテルを組み合わせた旅遊商品は、そのサービス内容如何によって旅遊者の権利利益を損なう危険性を孕んでいる。また、旅遊者が契約した業者が無登録旅行社であれば、契約自体が無効になる可能性もある。さらに、包価旅遊契約の解除によって代金が返還される場合、代金から差し引かれる「必要な費用」の範囲は必ずしも明確でない。「転団」には、現行の法律法規の枠内で解決できない問題がある。最近では制度上の弱点を狙って、旅遊法の厳しい規制を回避するパッケージツアーが登場し、周辺諸国を巻き込んで様々な影響を与えている。中国では早くも旅遊法改正の必要性が指摘されており、周辺諸国にとっても、中国の法整備の状況を注目しながら、消費者の権利利益の保護とツーリズム秩序の安定に資する政策の実施が求められている。departmental bulletin pape
