No full textDuring 1950s in Italy wild boar (Sus scrofa) was close to extinction. Then, several introduction, re-introduction and restocking operations have been legally carried out by local administrations, or illegally by hunters for hunting purpose, so as to make the management of this species particularly problematic and needing a careful and farsighted approach. In order to limit the increasing damage to crops and biocenosis, containment plans have been carried out, even in hunting-free areas, through selective cull and capture with steady or movable cage. The destination of captured animals is the critical point of this kind of management, not only for the effectiveness of this practice but above all for animal welfare. Often these animals are destinated to game farms, private hunting areas or hunting dogs training areas. Moreover, transport of live wild boars to slaughterhouses does not respect animal welfare standards and is in contrast with European legislation for animal welfare during transport and animal management in slaughterhouse. Considering the current practices, the authors outline the current legislative framework on the subject and propose indications to include the activities of wild boar containment within the commercial chain of wild game meat.Moreover, the transport of alive wild boars to slaughterhouses is in contrast with European Regulation admitting this transport only for listed farmed animals. Considering the above-mentioned practices, the Authors outline the current legislative framework on the subject, and in the context of the activities of containment of wild boars, ask for an immediate suppression of the animals directly on the capture location, avoiding any subsequent handling and transport

No full textWith the application of Legislative Decree no. 193/2007, Italy has partially solved the administrative problems about the application of the EU Regulations on food safety, even if the European provisions had to be directly applied from 1st January 2006. The European Commission was pursuing a legal action against Italy for failing to comply properly with their obligations under EU law. These decisions covering many sectors aim to ensure proper application of EU law for the benefit of citizens and businesses. For this reason the European Union was starting a proceeding for Italy for missing the application of the Directive 2004/41/EC, which repealed all the directives in conflict with the EU regulations, despite our legal system provides for the indirect repeal of laws in time. In particular, Authors analyze the issue related to the legal authorizations for food industries.

Get PDFIn 2002 a new path and evolution about the European Food Legislation started. As a matter of fact, the European Regulation n.178/2002/CE establishes rules, procedures and a pioneering approach regarding food safety. That is automatically introduced and applied in each EU State. Anyway, the European Legislation must \u27cross\u27 with national provisions, contained in Penal Code, concerning the protection of human health and of trade. In this paper the Authors outline the "food rules" contained in the Italian Penal Code and analyze the \u27parallel convergences\u27 with the EU Rules subjected to direct application, such as the EU Regulations.
