El contenido y la modificación del acuerdo de trabajo a distancia a la espera de la negociación colectiva
En marzo de 2020 muchas empresas se vieron en la tesitura de cerrar sus negocios u optar por enviar a su personal a prestar el trabajo en sus
domicilios. Esta situación ha acelerado la promulgación de una normativa que, aunque no garantiza una mayor implantación del trabajo a distancia, sí que, al menos, resuelve alguna de las cuestiones ante las que el art. 13 del Estatuto de los Trabajadores hasta ese momento se mostraba insuficiente.Este comentario analiza el contenido mínimo del acuerdo de trabajo a distancia, regulado en el art. 7 de la Ley 10/2021, de 9 de julio, de trabajo a distancia, obligatorio para las partes, y que, pese a su carácter de mínimos, recoge la mayoría de las condiciones de esta forma de trabajar. Junto a ello, también se aborda su modificación y, en ambos casos, cuál es la problemática que la regulación legal
plantea en la práctica, así como la respuesta ofrecida hasta el momento por los convenios colectivos, para concluir apuntando un diagnóstico de inseguridad jurídica que la ley no solventa y que la negociación colectiva aún no está en condiciones de responder.In March 2020, many companies found themselves in the position

situation has accelerated the promulgation of a regulation that, although it does
not guarantee a greater implementation of remote working, at least, resolves
some of the issues that art. 13 of the Workers’ Statute has so far been
insufficient.This comment analyzes the minimum content of the remote work
agreement, regulated in art. 7 of Law 10/2021, of 9 July, on remote work, which
is obligatory for the parties, and which, despite its minimal nature, includes most
of the conditions of this way of working. In addition, it also addresses its
modification and, in both cases, the problems that the legal regulation poses in
practice, as well as the response offered so far by collective agreements, to conclude by pointing to a diagnosis of legal insecurity that the law does not
resolve and that collective bargaining is not yet in a position to respond to.2021-2
From SLA to vendor-neutral metrics: An intelligent knowledge-based approach for multi-cloud SLA-based broker
Cloud computing has been consolidated as a support for the vast majority of current and emerging technologies. However, there are some barriers that prevent the exploitation of the full potential of this technology. First, the major cloud providers currently put the onus of implementing the mechanisms that ensure compliance with the desired service levels on cloud consumers. However, consumers do not have the required expertise. Since each cloud provider exports a different set of low-level metrics, the strategies defined to ensure compliance with the established service-level agreement (SLA) are bound to a particular cloud provider. This fosters provider lock-in and prevents consumers from benefiting from the advantages of multi-cloud environments. This paper presents a solution to the problem of automatically translating SLAs into objectives expressed as metrics that can be measured across multiple cloud providers. First, we propose an intelligent knowledge-based system capable of automatically translating high-level SLAs defined by cloud consumers into a set of conditions expressed as vendor-neutral metrics, providing feedback to cloud consumers (intelligent tutoring system). Secondly, we present the set of vendor-neutral metrics and explain how they can be measured for the different cloud providers. Finally, we report a validation based on two use cases (IaaS and PaaS) in a multi-cloud environment formed by leading cloud providers. This evaluation has demonstrated that, thanks to the complementarity of the two solutions, cloud consumers can automatically and transparently exploit the multi-cloud in many application domains, as endorsed by the cloud experts consulted in the course of this study.2020-2

La responsabilidad solidaria de los administradores por las obligaciones sociales del art. 367 LSC
El presente trabajo analiza el régimen de responsabilidad solidaria de los administradores derivado del incumplimiento de los deberes legales impuestos por el legislador ante la concurrencia de una causa legal de disolución. Especialmente, examina el deber de promover los actos encaminados a la disolución de la sociedad cuando existen pérdidas que dejan reducido el patrimonio neto a una cifra inferior a la mitad del capital social. El estudio pone de manifiesto las principales notas características de este tipo de responsabilidad, diferenciándola de la responsabilidad societaria por daños y de la responsabilidad concursal, así como expone su relación con otros ámbitos jurisdiccionales, debido a la posibilidad de hacer responsable al administrador de obligaciones de diversa naturaleza. Asimismo, analiza la influencia en la materia de las medidas adoptadas para paliar los efectos económicos del COVID-19.2020-2
Evaluación de la calidad de estudios en meta-análisis de eficacia de intervenciones en revistas españolas
In this paper, we reviewed primary study quality assessments in meta-analyses published in the main Spanish psychology journals. Specifically, we analyzed whether the coding and evaluation of the quality of the primary studies in meta-analysis based on the efficacy of interventions is a common practice. The purpose of this evaluation is also to report the relationship between quality and the reported results (effect sizes). It is found that 79% of the meta-analyses analyzed included a quality assessment. The relationship between the lowest quality of studies included in meta-analyses and larger effect sizes is also discussed. Finally, we stress the need to improve the reporting of meta-analyses including high-quality evidence.2020-2
Fuzzy GIS-based MCDM solution for the optimal offshore wind site selection: The Gulf of Maine case
This paper describes a multi-criterion decision-making approach for optimal off-shore wind location assessment by including fuzzy geographical information systems to prioritize the different locations and alternatives. The multi-objective framework involves a variety of elements, such as climatic, geographic, social, environmental, location, and economic factors. The proposed decision-making solution is based on a multicriteria evaluation method divided into two steps: an analytic hierarchy process and a prioritization of the alternatives in comparison to a parallel approach based on a fuzzy geographical information system solution. The Gulf of Maine (USA) is considered as a case example, owing to the relevant offshore wind potential of such an area. A descriptive statistical evaluation of the wind resource was previously carried out to characterize this area with wind speed field measurements for 10 years (2010–2019). A design proposal for a 1 GW offshore wind power plant is used in a case study based on a 15 MW variable speed wind turbine prototype recently proposed by the IEA Wind Task 37. The results include prioritization of optimal offshore wind power plant sites, levelized cost of electricity estimation, and avoided emissions in comparison to traditional supply side scenarios, mainly based on fossil fuel generation units.2021-2

Su punto de partida es el siguiente problema: el proceso de creación de valor ha experimentado un cambio profundo en las últimas décadas en el ámbito de la empresa, sin embargo, existen dudas acerca de si la información financiera tradicional es suficiente para explicarlo. El marco de referencia elegido como objeto de investigación es el sector de los operadores de telecomunicaciones en España. Sustainable Tourism Development and Economic Growth: Bibliometric Review and Analysis
Over the past decade, there has been a growing interest in studying the impact of sustain-
able tourism development on economic growth. However, despite its recent scope, the scientific
literature published so far has not evaluated the performance of the scientific activity of this rela-
tionship. Consequently, this study analyzes the 668 articles published to date in the Web of Science
database on the effect that sustainable tourism development has on the overall long-term progress
of the economy. To this end, we carry out an analysis of the most recognized authors, regions with
the highest percentage of scientific production, most influential organizations, the co-occurrence of
keywords, most prominent citations, publications, and co-authorship among the most recognized
authors. The results obtained show the trend and impact of the literature published to date and the
established and emerging research groups. Also, they identify key research topics in a way that
provides a planning framework for further research in this field.2020-2
