També tractem diferents condicions suficients per garantir la unicitat i el cas de reticles de Banach.We study when a Banach space has a unique predual, focusing first on holomorphic functions bounded on the unit disk and analyzing Ando's proof. We consider how to extend the result to several variables, where technical difficulties arise. We also discuss different sufficient conditions to guarantee uniqueness and the case of Banach lattices

La planta municipal y su diversidad: piedra angular del modelo territorial. A propósito de una nueva Ley de gobiernos locales de Catalunya
Get PDFLa planta municipal, amb la seva configuració i, consegüentment, la diversitat territorial que representa, és un dels elements estructurals de qualsevol model territorial en clau local. És a dir, per a configurar un model territorial creiem que és necessari conjugar almenys tres elements substantius: la planta, el règim jurídic local —organitzatiu, competencial i prestacional— i el seu sistema de finançament. I perquè sigui coherent, ple, s’ha de configurar com un tot que es retroalimenta, que s’interrelaciona alhora. Justament per això resulta molt substantiva l’estructura municipal d’un territori, i la seva diversitat, la qual per connexió ens permetrà saber amb una aproximació significativa quin règim juridicoinstitucional serà necessari i quin marc financer haurà de fer-lo viable i operatiu. En aquest sentit, entenem que l’estudi de la planta municipal i la seva diversitat és la pedra angular prima facie a partir de la qual s’han de conjugar la resta d’elements i, alhora, per se condiciona molt substantivament la definició del model territorial. És més, no abordar aquest element sense complexos i alhora amb el màxim rigor polític, jurídic, geogràfic, econòmic, social, etc., fa que de retruc es posposi la definició de tot un model, en definitiva. En efecte, quants municipis hi ha al país i si són prou o són massa, no només motiva el reforç i la configuració d’un nivell —almenys— supramunicipal i intermunicipal, sinó que fa gravitar a partir d’aquesta decisió la resta d’elements esmentats. En aquest article, que coincideix en el temps amb el quarantè aniversari de la Llei de bases del règim local del 1985 —la norma bàsica en la matèria—, abordarem especialment aquesta qüestió, especialment pel que fa al nostre país. I ho farem en el context d’una necessària llei de governs locals de Catalunya que estructuri definitivament, i finalment, un nou model territorial amb tots els seus elements.The municipal plan, its configuration, and consequently, the territorial diversity that ensues, is one of the structural elements of any territorial model in a local key. In other words, in order to configure a territorial model, we believe that it is necessary to combine at least three substantive elements: the plant, the local legal regime —organizational, competence and benefits—, as well as its financing system. And for it to be coherent, full, it must be configured as a whole that feeds back on each other, that interrelates at the same time. Precisely for this reason, the municipal structure of a territory, and its diversity, is very substantive, and by connection this will give us a significant approximation of what legal-institutional regime will be necessary, and what financial framework will have to make it viable and operational. In this sense, the study of the municipal plan and its diversity is understood to be the prima facie cornerstone from which to combine the rest of the elements, and at the same time to condition the definition of one or another territorial model very substantively. Moreover, not to approach this element without complexes, and with all political, legal, geographical, economic, social rigor, etc., means that the definition of an entire model, in short, is postponed. In fact, how many municipalities there are in the country, and whether there are enough or too many, not only motivates the reinforcement and configuration of a —at least— supramunicipal and ntermunicipal level, but also makes the rest of the aforementioned elements gravitate from this decision. In this article, which coincides in time with the fortieth anniversary of the 1985 Law on the Bases of the Local Regime —the basic rule on the matter— we will address this issue in particular, especially with regard to our country. And we will do so in the context of a necessary Law of Local Governments of Catalonia that definitively and finally structures a new territorial model.La planta municipal, con su configuración y, consiguientemente, su diversidad, es uno de los elementos estructurales de cualquier modelo territorial en clave local. Es decir, para configurar un modelo territorial creemos que es necesario conjugar al menos tres elementos sustantivos: la planta, el régimen jurídico local —organizativo, competencial y prestacional— y su sistema de financiación.Y para que este resulte coherente, pleno, debe configurarse como un todo que se retroalimenta, que se interrelaciona a la vez. Justamente por eso resulta muy sustantiva la estructura municipal de un territorio, y su diversidad, y por conexión esta misma nos dará una aproximación significativa de qué régimen jurídico-institucional será necesario y qué marco financiero deberá hacerlo viable y operativo. En tal sentido, entendemos que el estudio de la planta municipal y su diversidad es la piedra angular prima facie a partir de la cual deben conjugarse el resto de elementos, y al mismo tiempo per se condiciona muy sustantivamente la definición de uno u otro modelo territorial. Es más, no abordar el tema de la planta sin complejos y con todo el rigor político, jurídico, geográfico, económico, social, etc., hace que en consecuencia se posponga la definición de todo un modelo, en definitiva. En efecto, cuántos municipios hay en el país y si suficientes o son demasiados, no solo motiva el refuerzo y la configuración de un nivel —al menos— supramunicipal e intermunicipal, sino que hace gravitar a partir de esta decisión el resto de elementos mencionados. En este artículo, que coincide en el tiempo con el cuadragésimo aniversario de la Ley de bases del régimen local de 1985 —la norma bàsica en la materia—, abordaremos esta cuestión, especialmente con respecto a Catalunya. Y lo haremos en el contexto de una necesaria ley de gobiernos locales catalana que estructure definitivamente, y finalmente, un nuevo modelo territorial con todos sus elementos
