Marriage Certificate and Protection of Children’s Rights Due to the Unregistered Marriage in the Cianjur District in the Post Regional Regulation Number 10 in 2010
The regional regulation number 10 in 2010 talks about the implementation of an integrated population administration. This instruction is a type of a Cianjur District government’s legal breakthrough in terms of the manifestation of an access into justice by marriage certificate (isbat nikah). This rule is due to the phenomenon of unregistered marriage certificate (nikah siri) caused by diverse factors. Here, three organizations collaborate in establishing this marriage certificate. They are Religious Courts, Ministry of Religious Affairs, and Department of Population and Civil Registration. This certificate marriage helps fulfil the basic rights of children and those of family of unregistered-marriage-certificate couples. For example, they have some important documents, such as marriage book, family card, birth certificate, and children’s identity card
The Stylistics of Al-qur\u27an: The Symbolic Meaning and Function of the Art of Reading Al-qur\u27an on the Context of Communication
The study the stylistics of the Qur\u27an cannot be separated from the concept of i\u27jaz al-Quran as a form of uniqueness and privilege of the language of Qur\u27an. When Qur\u27an was delivered to the Arab society, they had used high language and literature. By the emergence of the art of reading the Quran (nagham al-Quran) around the world, and it is believed as one of the forms of appreciation of the Qoran, Muslims in Indonesia receive and appreciate it with pleasure. The Musabaqoh Tilawatil Quran (MTQ), whish is held by the governments and non-governmental institutions of all levels, has been carried out on a regular and continuous basis. As a religious text, the Qur\u27an has a very high literary dimension. The Quran also has some aesthetic and musical-messaging dimensions. This paper attempts to discuss the stylistic styles of language in the aspects of the art of reading the Qoran with a single voice, without the accompaniment of musical instruments, and unrelated to musical tone. This is specifically used for tazyin al-Saut bi tilawah al-Quran. The approach used in this study is Al-Uslub al-Adabi or Literary Stilistica, which focuses on the level of persistence or phonology, which includes phonetics and phonemics. Phonetics is divided into three parts, namely; articulatory phonetic, acoustic phonetics, and auditory phonetics. The discussion on literary stylistics is cannot be separated from emotional aspects, not logical aspects. The analysis of literary stylistics in the art of reading al-Quran (nagham al-Quran) produces the effect of the reader\u27s feelings, sensational feelings and spiritual feeling. Spiritual feeling is divided into religious, ethical, aesthetic, intellectual, social, and personal feeling. Meanwhile, in the aspects of communication generate understanding and scientific knowledge about the principles of transcendent communication, the principle of spiritual communication, the principle of human communication, and finally lead to the Principle of Quranic Communication
Modernization of Islamic Education in South Kalimantan (Socio-historical Perspective of Normal Islam Amuntai)
Islamic educational institutions not only survived, but also began in earnest to make certain adjustment by adopting certain aspects of European education. This can be seen in the rise of madrasah that introduced classical system and curriculum for instance. This in turn affected ‘traditional’ Islamic educational institutions such as pondok or pesantren to also modernize themselvesNormal Islam Amuntai as further developments of Arabische School (1938). This school use modern system but in understand strong hold on the mazhab. Normal Islam became the source of the birth of the madrasahs in Amuntai incorporated in Ittihad Ma\u27ahid al-Islamiyah (IMI). Reconstructing Sharia Economic Dispute Resolution Based on Indonesian Muslim Society Culture
This paper describes the settlement of disputes in the field of Islamic economy based on Indonesian Muslim society culture. The research method used is Library research with normative juridical approach. In business, whether based on conventional or sharia, conflict or dispute sometimes happens and can not be avoided. The settlement of disputes in the Court, takes a long time, the cost is huge and the result is a win-lose, resulting in a sense of unfairness to either party. For that Sulh (peaceful) in resolving the dispute sharia economy becomes the choice of the sharia economic actors if there is a dispute between the parties. Sulh (peace) can be developed with various models, such as negotiation, mediation or arbitration. This dispute resolution model is more acceptable to the society, because philosophically the values of Sulh (peace) already exists intrinsically in the culture of Indonesian society which prioritizes deliberation and harmony in the life of society
The Urgence of Reconstruction the Offense of Adultery in Indonesia: A Form of Protection Against Legal Marriage and Sexual Morals Muslim Society
The aim of this study is to find exact formulation of the offense of adultery. Problems in the research: 1) how Indonesian muslim society understand and act toward adultery, 2) why muslimsociety solve adultery without taking 284 Criminal Code, 3) why reconstruction of adultery law is needed, The research designs are qualitative tradition, constructivism paradigm, socio legal methodology, while its approaches are hermeneutics, philosophy and phenomenological approach. Its analyzing data technique are inductive analysis through data reduction and triangulation.The results show that Indonesian muslimsociety in sanctioning toward people committing intercourse without any legal marriage. In sanctioning is based on local custom and Islamreligion believed by major local community, with its priority on justification principle, between human as individual and as social creatures, and its justification between the victim’s need and the actor’s importance.The conclusion is that adultery criteria based on society is every intercourse without legal marriage, in accordance of religion and state, both is done by heterogeneous gender or homogenous gender. The value on 284 Criminal Code clause does not suit on the believed value by society since it only protects marriage institution. Meanwhile, in the values of Islamreligion, ones whom are protected is not only marriage institution but also the values of sexual moral society, so muslimsociety does not use 284 Criminal Code clause to take an action toward adultery actor.In progressive law, if law has problem therefore it needs to be reconstructed, and it is not the people to be insisted in adopting toward the law, then 284 Criminal Code clause must be reconstructed, because it is not effective and cannot create proper justice for Indonesian society. In the concept of Legal Pluralism, to reconstruct the clause must based on religious law, local custom and state Law, to create perfect justice

A Study of Aisyiyah in Promoting Women’s Muslim Community in Banten Province: Its Ideology, Works, and Challenges
This study examines the role of Aisyiyah, as one of the Islamic women organizations, in improving the status of women in Banten province. As an organization that has been established for almost a century Aisyiyah has given great and influential contributions toward the women’s development. This study focus on the ideology that Aisyiyah convey in running its organization, which is based on the teaching of the Holy Qur’an and Hadith (the sayings of the Prophet Muhammad SAW). The data were taken from the interview with the members of Aisyiyah Banten organization, publication, and documentation. The techniques used to collect the data were through in-depth interview, survey, and participatory observation. According to Aisyiyah men and women are equal in sight of Allah and have the same obligation in committing goodness. In doing its activities Aisyiyah keeps the slogan amal ma’ruf nahi munkar (commanding the goods and forbidding evil) based on the Holy Qur’an and Hadith. Aisyiyah has focused its activity in many sectors as education, health, and social welfare which are considered as women’s domain. During its development Aisyiyah has faced many challenges due to the social and political condition in the society. Kuntowijoyo’s Prophetic Social Science (Chalenges and Consequences)
The dynamics of social science in Indonesia today is likely looking for the ideal form. Kuntowijoyo, in this case, becomes one of the Indonesian Muslim figures who brings fresh air for the social sciences by integrating Islamic paradigm that is transcendental/divine (prophetic). The working device is expected to be applicable in the future in order to look at the social dynamics of the Muslims; its culture, its history of the social and political movements. Thus, the purpose of this study was to see the importance of the Islamic paradigm in the social sciences and also to assure that the application of the scientific framework (that is called by Kuntowijoyo) Prophetic Social Sciences should be started as soon as possible. Therefore, this study is descriptive-comparative. Kuntowijoyo ideas provide a comparison among the opinions of other social scientists to see the relevance of his thoughts within the dynamics of value-laden social science. This study presents that the social observation of the Muslim society so far is not only always value-laden, but also full of certain messages and also unwittingly spread the used paradigm, it is not only pure interpretation. Thus, the working device of developing social science today does not only need critical examination, but also need to be improved to scrape a variety of Muslim social problems; culture, history, social movements, and political. Conversion Out of Islam and Its Legal Implications Under The Laws of Malaysia
The freedom to profess and practice religion is one of the basic rights in Malaysia that often catalysis legal issues and discussions. The provision in Article 11 of the Federal Constitution of Malaysia generally guarantees the said right to a person to practice his religion of choice; however, Muslims or practitioners of Islam are not as free as the non-Muslims in the matter of their conversion or reconversion to another religion. This article focuses on the actions or process for a Muslim’s conversion to other religion and the legal ramifications of such actions. This discussion identifies several actions of apostasy, such as issuing a declaration of conversion via a Deed Poll, requesting a Muslim name to be changed to a non-Muslim’s, and renouncing Islam altogether and reverting to a previously held religion (reconversion). There are legal implications for these said actions, such as fines and detention at Aqidah Rehabilitation Centres, which clearly shows that the freedom to practice religion or conversion to other religions as found in Article 11 of the Federal Constitution of Malaysia applies to non-Muslims only. In cases relating to determination of the status of Islam as a religion, the Shariah Court have been given exclusive jurisdiction to hear those cases, as mentioned in the amendment to Article 121(1A) of the Federal Constitution
Deradicalization Through Multicultural and Local Wisdom Literacies Based Teaching Model at Salaf and Kholaf Pesantren in West Java
Indonesia has been a country with multi-ethnics, cultures, and religions. These diversities become its own wealth and treasures as well as dangers. The differences will create dynamic and meaningful human lives. On the other hand, they posit potential radicalization and conflicts that will explode anytime due to their differing meaning and perception. Education is a solution since it plays a role of social reconstruction. It can not only maintain ethnic, linguistic and cultural diversity but also achieve social inclusion, equity and intercultural understanding. The paper aims to report the result of the first stage of research and development study in developing instructional model based on multicultural, local wisdom, and literacy perspectives at Salaf and Kholaf Pesantren in West Java. The model consists of three variables which are variable of context, process, and product. The expected product is the students’ competencies and awareness of how to cater differences in order to have moderate perspective
